220. Regulation of the Chairman of the Management Board of Österreichische Post Aktiengesellschaft concerning the weekly service period and the working time of certain groups of staff members of the Austrian Post Aktiengesellschaft or a company which , as a result of the measures of the re-establishment of the company within the framework of the existing company law of this company, are assigned to the service (turn-time ordinance 2012-P-WZ 2012)

On the basis of Section 48 (6) of the Civil Service Act 1979, BGBl No. 333, in the version BGBl. I Nr.96/2007.des § 16a of the salary law of 1956, BGBl No. 54 in the version BGBl. 153/2009 and § 17 a (3) of the Postal Structure Act 1996, in the version BGBl. I Nr.96/2007 is being prescribed:

§ 1. (1) The service plan of the handlebars in the area of the carriage of goods by Österreichische Post AG comprises an extended weekly service within the meaning of section 48 (6) BDG. The extended weekly service period includes a weekly service period, which is longer than the weekly service period provided for in § 48 (2) and (4) BDG, in order to ensure that the time of the week is longer than that of the regular service station.

(2) The time between arrival at the destination and the scheduled departure from that place shall be the turning time within the meaning of paragraph 1.

(3) Turning times, which do not exceed 15 minutes in the individual case, are to be counted fully as service time. These periods shall not be taken into consideration for the purpose of regulating an extended weekly service within the meaning of paragraph 1.

(4) periods during which cleaning and maintenance work are incurred are not turning times and entitle neither to extend the weekly service period within the meaning of para. 1, nor to pay the flat-rate payment within the meaning of § 2.

(5) Fallen outside the extended weekly service period within the meaning of paragraph 1 additional service-hours on, so these are to be paid according to the requirements of § 49 BDG.

(6) In the event that the next (return) journey from the destination is not carried out on the same day, the service shall be deemed to be terminated as soon as the tasks scheduled to be carried out on the basis of service after reaching the target location are concerned.

§ 2. The flat-rate compensation for the extended weekly service within the meaning of Article 1 (1) shall be determined as follows:

§ 3. (1) This Regulation shall enter into force on 1 July 2012.

(2) The Federal Government Regulation of 22 December 1981 (BGBl. No 17/1982), which extends the weekly service period for certain categories of staff in the field of postal and telegraph management and the regulation of the Federal Minister of Public Economy and Transport on the fixing of Flat-rate compensation for extended service plans in the area of postal and telegraph management (BGBl. No 471/1991), expire at the end of 30 June 2012.
