60. Federal Act, which changes the passport law in 1992

The National Council has decided:

The Federal Act on Passport for Austrian Citizens (passport law 1992), BGBl. No. 839, as last amended by the Federal Law BGBl. I n ° 135/2009, shall be amended as follows:

1. In § 5

(a) the following points 2a to 2c shall be inserted in paragraph 1 after Z 2:

" 2a.

the Presidents and Vice-Presidents of the highest courts,

2b.

the President of the Court of Auditors,

2c.

members of the People's Office, "

(b) the following paragraph 3 is added:

"(3) The passport holder shall immediately return the service pass to the issuing authority for the devaluation of the service after termination of the function which is relevant for the issuing of the service passport."

2. § 6 reads:

" Diplomatic passports

§ 6. (1) Diploma passports shall be issued for:

1.

the Federal President,

2.

the Presidents of the National Council, the President and the Vice-Presidents of the Federal Council,

3.

the members of the Federal Government and the State Secretaries,

4.

Members of the Foreign Policy Committee of the National Council, as well as Members of the European Parliament elected in Austria,

5.

Executive staff of the Federal Ministry of European and International Affairs,

6.

other officials of the higher external service, with the exception of retired civil servants,

7.

other contract staff of the higher external service after successfully completed service verification;

8.

Members of the diplomatic staff of Austrian professional representative bodies,

9.

the heads of coordination offices of the Austrian Association for Development Cooperation and their alternates,

10.

other persons who are employed by the Republic of Austria in diplomatic or consular functions abroad,

11.

Persons acting in a senior position within the framework of international organisations and bodies, where such activity is in the interests of the foreign policy of the Republic of Austria, and

12.

the spouses or registered partners of the persons referred to in Z 1, 8 and 9, the minor children of the persons referred to in Z 8 and 9, if they live with them in the common household, and other persons living in the common household Family members of persons listed in Z 8 and 9.

(2) The entitlement to a diplomatic passport shall be terminated with the termination of the function which is relevant for the issument of a diplomatic passport. The passport holder shall immediately return the diplomatic passport to the issuing authority for the devaluation of the holder. "

3. In § 15 para. 4, the quote shall be " 2 " by quoting " 2 and 2a " replaced.

3a. In Section 24 (1), in Z 1 the word "or" by a dash, in Z 2 after the word "used" the following by the word "or" replaced, followed by the following Z 3:

" 3.

in spite of the request of the authority, the obligation to postpone the passport for devaluation in accordance with § 5 para. 3 or § 6 para. 2, does not comply, "

(4) The following paragraph 15 is added to § 25:

" (15) § § 5 (1) and (3), (6), (4) and (24) (1) (1) to (Z) (3) in the version of the Federal Law BGBl (Federal Law Gazette). I No 60/2012 shall enter into force at the end of the day in which they are held. Diplomatic passports issued prior to the entry into force of this Federal Act and in respect of which the conditions for an exhibition pursuant to § 6 are no longer available in the version of this Federal Act, shall be lost upon expiry of three months after this Act.
