262. Regulation of the Federal Minister of Justice, by means of which the Rules of Procedure for the courts I and II. Instance (Geo.) is changed

Because of the nature. VII of the Sixth Court Relief Novella, BGBl. N ° 222/1929, shall be assigned:

Article 1

The Rules of Procedure for the Courts I and II. Instance (Geo.), BGBl. No 264/1951, as last amended by the BGBl Regulation. II No 451/2010, shall be amended as follows:

1. In Section 11 (1) (3), the phrase shall be: "Amts and Gerty Days" by the word "Office Days" replaced.

2. § § 69, 70 and 71 together with the headlines shall be repealed; in the title of § 72 the word shall be deleted. "Other" .

3. In Section 102 (1), the word order shall be "from the head of the court (§ 99 para. 1) or on a court day (§ 70)" through the phrase "from the head of the court or from the court ruler (§ 99 para. 1)" replaced.

4. In § 449 (1), the phrase "or at the time of the return of the judge who took over the land of land on the court" shall not be taken into account.

Article 2

entry into force

This Regulation shall enter into force 1. § § 11 (1) Z 3, 69, 70, 71, 72, 102 (1) and 449 (1) Geo. in the version applicable until the end of September 30, 2012 for the version according to Appendix 2 of the Agreement according to Art. 15a B-VG between the Federal Government and the Land of Lower Austria via the district court organization in the Land of Lower Austria, BGBl. No 585/1991, are to continue to be applied.
