302. Regulation of the Federal Minister for Labour, Social Affairs and Consumer Protection with regard to provisions for the production of maintenance service statistics as well as further statistical evaluations (Care Service Performance Statistics-Regulation 2012 -PDStV 2012)
On the basis of § 5 (4) of the nursing home care law (PFG), BGBl. I No 57/2011, shall be assigned in agreement with the Federal Chancellor and the Federal Minister for Finance:
Subject matter
§ 1. This Regulation regulates the scope and nature of the data to be transmitted by the Länder to the Federal Statistical Office of Austria for the establishment and management of a maintenance service database for the purpose of drawing up a database for the purpose of creating Maintenance service statistics and further statistical evaluations on behalf of the Federal Minister for Labour, Social Affairs and Consumer Protection in accordance with § 5 PFG.
Definitions
§ 2. For the purposes of this Regulation:

Care and care services (social services): The service areas of the countries and municipalities listed in § 3 (1) (1) to (6) of the PFG in long-term care (which are derived from social assistance and/or social welfare funds). the minimum level of protection (with). It does not include aid for the disabled and basic services. |

Service providers: The care and care services within the defined benefit catalogue are provided by public service providers (countries, municipalities, social welfare associations, other community associations) or private-sector bodies (clubs, Foundations, funds, institutions, corporations, etc.), or provided. |

Power Hours: Number of Calculated Power Hours in the reporting period. In the notes to this survey characteristic, it is to be found how a power hour is quantitatively defined at the service provider, which accounting units are provided and from which components it is composed. |

Visit days: number of calculated visit days during the reporting period. |
|||||||||
| 5. |
Settlement days: number of days calculated in the reporting period. |
|||||||||
| 6. |
Places: Number of places available at the end of the day. Should be in individual care services areas (insb. Partial inpatient services and short-term care) no such fixed contingent is available, the number of places actually occupied in the year under review must be reported. |

Clients: Number of persons cared for under the Social Services without self-payers. |
|||||||||
| 8. |
Self-paying persons: persons who do not benefit from social assistance or social assistance. Minimum security is to be subsidised. |

Age groups: differentiation according to age groups "under 60 years", "60 to under 75 years", "75 to under 85 years", "85 years and older". |

| 10. |
Caregivers and caregivers: number of persons employed on the date of care and care of unselfemployed persons, free employees and new self-employed persons. |

| 11. |
Full-time equivalents: The calculation shall be based on the paid weekly normal working time of the respective category of employees according to the collective contract to be applied. Part-time workers are calculated as aliquot according to their respective weekly hours of hours. |

| 12. |
Gross expenditure: sum of social assistance-or Minimum security expenditure for the respective care and care services during the reporting period. Gross expenditure also includes the turnover tax and the possible replacement of a depreciation for manufacturing and maintenance costs, but not investments and provisions. |

| 13. |
Contributions and revenues: the sum of the contributions and revenues collected by the Land or the service providers, the persons concerned, the relatives and the third parties, such as the heirs, the gift-taker. |

| 14. |
Other revenue: Sum of any other revenue in the Land, such as VAT, funds from the State Health Fund, extraordinary income during the reporting period. |

| 15. |
Net expenditure: sum of social assistance-or Minimum security expenditure for the respective care and care services during the reporting period, which are not covered by contributions and revenue collected by the Land and other revenue. |

§ 4. For the purpose of setting up the online application and carrying out the surveys, the Länder have a list of the Federal Statistics Austria for the purpose of setting up the online application and for carrying out the surveys in the care and care services in law or in contract. to provide service providers under the guidance of name and address as well as the care and care services of the service provider by 30 June of the following year in electronic form at the latest.
Statistical units
§ 5. Statistical units are the service providers in accordance with § 4, which offer care and care services within the defined service catalogue.
Continuity, periodicity
§ 6. The data referred to in § 3 shall be collected once a year. With the transmission of the data to the Bundesanstalt Statistik Austria, the data collection for the material performance section of the Austrian nursing home management report is in each case also referred to in Article 12 (2) of the agreement between the Federal Government and the Länder. pursuant to Art. 15 a B-VG on joint action by the Federal Government and the Länder for persons in need of care, BGBl. No 866/1993.
Type of data transmission to the Bundesanstalt Statistik Austria
§ 7. The transmission of the data for the reporting period takes place in automation-supported form via an online application set up for this purpose by the Federal Statistical Office Statistics Austria and has until 30 September of the following year at the latest, for the first time up to 30 September 2012, complete and free of charge.
Obligation to contribute
§ 8. The countries may entrust service providers as third parties with the performance of the obligations arising out of § 3 of this Regulation. The service providers are obliged to provide the data necessary for the compilation of statistics.
Reporting periods, stitch tag
§ 9. The reporting period (presentation period) is a calendar year. To the extent that key dates are to be collected, the reference date shall be 31 December of the reference year.
Publication
§ 10. The Federal Statistical Office of Statistics Austria shall publish the main results of the survey on the Internet free of charge by the end of the calendar year following the end of the reference year.
Cost replacement
§ 11. The Federal Ministry of Labour, Social Affairs and Consumer Protection has the Federal Statistical Office of Statistics Austria in accordance with § 32 of the German Federal Statistical Office (Bundesanstalt Statistik Österreich), which is connected with the surveys, the management of the database and the compilation of the statistics under this Regulation. Federal Statistics Act 2000. The flat-rate cost compensation for this amounts to EUR 65 000 as of the reporting year 2011. The above-mentioned cost rate is based on the "consumer price index 2010" (or "consumer price index 2010"), which is determined by the Federal Institute. of the index which may be replaced by the index), with the index number for the month of January 2012 forming the basis of the starting point. This safeguard clause shall only be applied in each case where an increase or decrease in the rate of cost increases by at least 5% is achieved through the application of the said safeguard clause. The index value on which such application of the value-retention clause is based then applies to the next calculation as the base number. Payment is made in two instalments. The first instalment shall be 50% of the total amount by 31 December of the reference year, and the second instalment shall be 50% of the total amount due to 31 December of the year following the reference year.
Use of gender-specific form
§ 12. To the extent that personal terms are used in this Regulation, they do not have a gender-specific meaning. They are to be used in the application to specific persons in the gender-specific form.
Transitional provision
§ 13. As far as survey characteristics or The characteristics of the features referred to in § 3 above the catalogue of survey characteristics included in Appendix 1 to the PFG, and are not available at the time of entry into force of this Regulation, shall be available from the the following reporting period and, at the latest, however, for the preparation of the service statistics for the reference period 2013, to be fed into the online application of the Bundesanstalt Statistik Austria.

§ 14. This Regulation shall enter into force at the end of the day of its operation.
