2. network access charge and 3 network deployment charge;

Definitions

The term may refer to section 2 (1) within the meaning of this regulation

'dynamically assignable capacities (DZK)' a capacity that can be offered only in combination with specified on or off dining points as fixed capacity and use in connection with other one - off dining points or the virtual trading point only on an interruptible basis is possible (section 3 para 2 No. 2 gas-market model regulation 2012 (GMMO-VO 2012), Federal Law Gazette II No. 171/2012).

"Umrechnungsbrennwert" of the volume-based during the transfer of the existing transportation contracts on energy based on and off power contracts to identify of the capacity in kWh/h used calorific value kWh / nm ³ (0 ° C). This is for the market area east of 11.19 kWh / nm ³ (0 ° C).

Distribution area (Baumgarten): 0,63 7 distribution area (Oberkappel): 0,63 (7) the fee for interruptible capacity basically corresponds to the pay for the same performance on a fixed basis. In case of interruptions, a refund is the power user to grant. Any refund will be deducted from the fee for the relevant month of performance within one month of service. Refundable by the transmission system operator to pay (ERm) is calculated according to the formula in accordance with Appendix 1 interruptible transportation services on the basis of dynamic attributable capacities are excluded from the refund.

(8) the network license fee at network coupling points in the transmission system, where several crucial points in accordance with § 39 2011 meet GWG, is determined 2011 based on contractually agreed performance, as follows MLA for interruptible transportation exclusively between these relevant points referred to in section 39 for contracts with a term of one year or longer for the following entry and exit points, (the exit point in brackets referred to those exit point , whose combined transport is offered):

1 überackern SUDAL (überackern-ABG): power supply: 0.14 Board: 0.14 of 2 überackern-ABG (überackern SUDAL): power supply: 0.14 Board: 0.14 (9) the network license fee for the feed in the transmission system or the Board of the transmission system for contracts with a duration of less than one year shall be calculated on the basis of the charges (S) referred to in paragraph 2 to 8 using the following formulas:

1. for quarterly products: (E/365) * number of days of each quarter * 1.25;

2. for products of the month: (E/365) * number of days of each month * 1.5;

3. for day products: (E/365) * 1.75;

4. for the rest of the day – and within day products: (E/8760)*(Rest-)Stundenzahl of the day * 1.

(10) in the case of limitations of transport services due to unscheduled maintenance, which by the transmission system operators shall not, in accordance with point 3.3 subpara 1 lit g of annex 1 of Regulation (EC) No. 715/2009 42 days in advance were published, is to grant the Web user for the duration and the extent of the transport restriction a fee reduction. The fee reduction will be deducted from the fee for the relevant month of performance within one month of service. The fee reduction to be granted by the transmission system operator (EKM) is calculated according to the formula in annex 2. The hourly rate provided by the transmission system used by the network user does not, or not fully, the hourly rate provided is decisive for the calculation of the fee reduction.

Network usage charge for storage companies

Fees are § 4 (1) for the network usage charge for the Board of the transmission system in storage facilities determined that, if not expelled, are indicated in EUR/kWh/h per year and per- or exit point and where the compressor energy costs are included. The fee must also be paid if for booked capacity not by the respective storage company or only partially is nominated.

(2) the network usage charge for the Board of the transmission system in storage facilities is determined for contracts with a duration of one year for the following exit points, based on contractually agreed performance for solid, assignable off dining capacities as follows:

1. memory of 7 fields: 0.36 2 memory MAB: 0.36 (3) the network license fee for the Board of the transmission system in storage facilities is for contracts with a term of one year for the following exit points, based on the agreed performance for dynamically assignable from supply capacities, determined as follows (the dining points in brackets refer to those single exit points in their combination of transport is offered guaranteed) :

1. memory of 7-fields (Oberkappel): 0.14 2. program MAB (Baumgarten): 0.14 (4) the fee for interruptible capacity basically corresponds to the pay for the same performance on a fixed basis.

(5) in the case of limitations of transport services due to unplanned maintenance according to the according to § 32 MLA 2011 approved the General conditions for network access to Fernleitungsnetzten, a fee reduction is the network user for the duration and the extent of the transport restriction to grant.

Network access charge in the transmission grid

§ 5. Through the network access charge, all reasonable and appropriate market prices expenses are compensated operator which are directly connected with the first time making of a connection to a network or the amendment of a connection due to an increase of the power of a network user. The network access fee is to be paid only once and to present the network users in a transparent and comprehensible way. Provided is paid for the power supply of the network user, the amount of the network access fee is to reduce accordingly. The network access charge is to charge cost-oriented, and the operator may provide an opting for similar power user.

Determination of network deployment pay in the transmission grid

§ 6. The net provisioning charge is in the manufacture of the mains supply or increase the contractually agreed performance as a performance-related lump sum for the already made and necessary expansion of the network to enable the port to charge. It is calculated according to the agreed level of network usage and on the occasion of the completion of the network access agreement or increase the contractually agreed performance once billed to be. The network provisioning charge for performance-appropriate plants and storage facilities of the transmission power level is determined as follows:

1. for fixed capacity: 3,00 EUR / kWh / h.

2. for interruptible capacity: 1.50 EUR / kWh / h compensation

Section 7 (1) the compensation between transmission system operators are called net payments, which represent annual amounts, laid down and are payable in 12 equal amounts of part monthly.

(2) the following compensation be set:

1 gas connect Austria GmbH pays BOG GmbH EUR 7.046.983,88;

2 day GmbH pays BOG GmbH EUR 8.366.148,02.

Rules for auctions

§ 8 (1) for capacities that 2012 will be awarded GMMO-VO in accordance with § 6 auction apply the respective fees pursuant to § 3 as a starting price for the auction. For day-ahead capacity according to § 6 ABS. 3 GMMO VO 2012 is considered notwithstanding § 3 par. 9 for all single exit points of the market area of East starting price 1/365 of the fee pursuant to section 3 para 2 No. 1 and for all exit points of the market area of East 1/365 of the respective fee pursuant to section 3 para 3.

(2) for capacities that 2012 will be awarded GMMO-VO pursuant to § 6 para 1 auction, pay the difference between the initial price and the price in the auction (extra charge) in addition to the starting price for the respective duration of the contract by the network user. To change the charges pursuant to § 3 during the contract period, the total price is to adjust the starting price and extra charge represents the difference between the original and the new starting price.

(3) in accordance with § 4 GMMO-VO 2012 combined to limit coupling points offered capacities the respective fee pursuant to section 3 is part of the start price of the auction of the combined capacity. For bundled offered day-ahead capacity according to § 6 ABS. 3 GMMO VO 2012 is the corresponding fee referred to in paragraph 1 sentence 2 part of the starting price for the auction of bundled capacity.

Entry into force
