339. Regulation of the Federal Minister for health, with the prohibition of the placing on the market of genetically modified potato products (Solanum tuberosum L. line EH92-527-1) is extended for the purpose of cultivation in Austria for three years
On the basis of § 60 para 1 of the gene technology Act - GTG, BGBl. No. 510/1994, as last amended by Federal Law Gazette I no. 13 / 2006 and by the Federal Ministry of law amendment of 2009, Federal Law Gazette I no. 3/2009, is prescribed:
§ 1. The placing on the market of products from the following are described GMOs or those included, for the purpose of cultivation in Austria is prohibited:
1 potatoes (Solanum of cloth L), which transformed pHoxwG were transformed to achieve a higher Amylopektingehalts of strength by means of Agrobacterium using the vector to line EH92-527-1 (BPS-25271-9). The product contains the following DNA sequences in two gene cassettes: a) gene cassette 1: A from the Tn5 nptII gene, conferring kanamycin resistance, regulated by a Nopalin-synthase promoter expression in plant tissue and terminated by a Polyadenylierungssequenz of the Nopalin synthase gene from Agrobacterium tumefaciens.
(b) gene cassette 2: regulated by antisense orientation, a segment of the gene of gbss of potato / Earth Apple, that was for the Gbss-protein bound to granules, gbss promoter isolated from potato and terminated by a Polyadenylierungssequenz of the Nopalin synthase gene from Agrobacterium tumefaciens.
2. the unique identifiers of the product is: BPS-25271-9.
3. these products were of the company BASF Plant Science (formerly Amylogen HB) in accordance with Directive 2001/18/EC on the deliberate release of genetically modified organisms into the environment and repealing Directive 90/220/EEC of the Council, OJ No. L 106 of the 17.04.2001 p. 1, as last amended by Directive 2008/27/EC, OJ No. L 81 of March 20, 2008 p. 45, signed by the European Commission decision 2010/135/EU concerning the placing on the market of a genetically modified potato product (Solanum tuberosum L. line EH92-527-1) with increased Amylopektingehalt in the thickness in accordance with Directive 2001/18/EC of the European Parliament and of the Council OJ No. L 53 of the 04.03.2010 approved S. 11 of March 2, 2010 and by the Swedish authorities on March 31, 2010 for the placing on the market for the cultivation and industrial purposes approved.
§ 2. The ban on gem. § 1 includes also potatoes (Solanum tuberosum L. line EH92-527-1) emerged from crosses of genetically modified potato product with other potato genotypes.
§ 3. This Regulation shall at the end of the 30th November 2015 override.
