344. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the Statistics on Aquaculture Production 2012 (Aquaculture Statistics Regulation 2012)

Due to § § § 4 to 10 of the Federal Statistics Act 2000, BGBl. I n ° 163/1999, as last amended by the Federal Law BGBl. I n ° 111/2010, will be in agreement with the Federal Chancellor, with regard to § 12 in agreement with the Federal Minister of Finance and with regard to § 11 on the basis of § 3 of the LFBIS Act, BGBl. No 448/1980, as last amended by the Federal Law BGBl. No 505/1994,

Arrangement for the compilation of statistics

§ 1. The Federal Institute of Statistics Austria (Bundesanstalt) has been responsible for fulfilling Austria's obligations under Regulation (EC) No 762/2008 on the submission of aquaculture statistics by the Member States and repealing Regulation (EC) No 762/2008. No 788/96, OJ No. No. 1, to carry out surveys in accordance with this Regulation and to compile statistics on aquaculture production on the basis of the data collected by the end of each year.

Statistical units, survey mass

§ 2. For the purposes of this Regulation, statistical units shall be undertakings which constitute aquaculture within the meaning of Article 2 (1) (1) (1). b of Regulation (EC) No 762/2008.

Periodicity, continuity

§ 3. The statistical surveys shall be carried out annually in the statistical units referred to in § 2 over the previous calendar year (year of reporting calendar year).

Survey characteristics

§ 4. The following characteristics shall be collected:

1.

the production of aquaculture without any rearing facilities and in accordance with Annex II to Regulation (EC) No 762/2008,

2.

the production in incubation and rearing installations in accordance with Annex IV to Regulation (EC) No 762/2008 and

3.

the structure of the aquaculture sector referred to in Annex V to Regulation (EC) No 762/2008.

Survey Type

§ 5. The characteristics in accordance with § 4 are to be collected in the form of a full survey by means of a survey of statistical units in accordance with § 2.

Obligation to provide information

§ 6. (1) According to § 9 of the Federal Statistics Act 2000, there is a duty to provide information in the surveys.

(2) For the purpose of providing information, those natural and legal persons as well as partnerships of the commercial law are obliged to operate a statistical unit according to § 2 in its own name.

Implementation of the survey

§ 7. (1) The survey pursuant to § 6 (1) shall be carried out by the Federal Institute.

(2) For the purpose of the survey, the Bundesanstalt has to compile uniform survey documents (questionnaires and explanations) and make these available to the parties responsible for providing information both in electronic form and in paper form.

Obligation to provide information to the parties responsible for providing information

§ 8. The parties responsible for providing information in accordance with § 6 shall be obliged to complete the questionnaire of the Federal Institute within three weeks of receipt of the information in full and to the best of the knowledge and to return it to the Federal Institute within this period.

Other co-action obligations

§ 9. Former owners of statistical units according to § 2 are obliged to participate in the determination of the new information subject pursuant to § 6 (2) by the Federal Institute.

Information on the obligation to provide information

§ 10. The Federal Institute has to provide information on the legal consequences according to § 66 of the Federal Statistics Act 2000 in the case of refusal of information and in the case of information which is knowingly incomplete or not to the best of its knowledge.

Transmission of data to the LFBIS

§ 11. The Federal Institute has to send the collected individual data to the Federal Minister for Agriculture, Forestry, Environment and Water Management for inclusion in the agricultural and forestry operating information system (LFBIS).

Cost replacement

§ 12. The Federal Minister for Agriculture, Forestry, Environment and Water Management has a one-time payment of 25 570,-Euro to the Federal Institute in 2012.

Entry into force; external force

§ 13. This Regulation shall enter into force at the end of the day of the presentation of the Regulation, and the Regulation on the statistics of aquaculture production, BGBl, shall take place in the same time. II No 288/2003, except for force.
