100. Agreement in accordance with Art. 15a B-VG between the Federal Government and the Land of Lower Austria amending the Agreement in accordance with Art. 15a B-VG between the Federal Government and the Land of Lower Austria on the establishment and operation of the Institute of Science and Technology -Austria together with appendix

The National Council has decided:

The conclusion of the present agreement pursuant to Art. 15a B-VG is hereby approved.

The Federal Government, represented by the Federal Government, and the Land of Lower Austria, represented by the Governor of the State of Lower Austria, have agreed to conclude the following agreement in accordance with Article 15a B-VG.

The agreement in accordance with Art. 15a B-VG between the Federal Government and the Land of Lower Austria on the establishment and operation of the Institute of Science and Technology-Austria together with the appendix, BGBl. I No 107/2006, is hereby amended as follows:

1. Art. II is as follows:

" Article II

Obligations and authorities of the Federal Government

(1) The Federal Government undertakes to permanently establish the Institute of Science and Technology-Austria as a legal person under public law by means of federal law with its own legal personality and, together with the Land of Lower Austria, to . The Institute of Science and Technology-Austria serves top-level research. It is called to open up and develop new research fields. The teaching serves a high-quality postgraduate education in the form of PhD and Post Doc programmes.

(2) The Federal Government shall fulfil its conservation obligations in such a way that it provides the following benefits for the expenses incurred in the performance of the tasks of the Institute of Science and Technology-Austria:

1.		an annual global amount of EUR 15 million by the end of 31 December 2011,
2.		of 1. January 2012 to the end of 31 December 2015, an annual global amount of EUR 20 million,
3.		of 1. From January 2016 to the end of 31 December 2016, an annual global amount of EUR 40 million,
4.		of 1. January 2007 until the end of December 31, 2016, the Federal Government will increase the amount of third-party funds awarded by the Institute of Science and Technology-Austria to a maximum of the amount of the amount of the amount entered annually, with the sum of this amount being added to the amount of the sum of the sum of the amount of the amount of the amount The increase is limited to EUR 95 million, and

2. Art. III is as follows:

Obligations and authorizations of the Land of Lower Austria

(1) The country shall meet its conservation obligations in such a way as to ensure that:

1.		by the end of 31 December 2011, investments in buildings and infrastructure with a total amount of EUR 80 million,
2.		by the end of December 31, 2016 for the Institute of Science and Technology-Austria from the start of the current operation, with regard to buildings and infrastructure, as well as Facility Management for a total amount of the total amount required of up to 30 million euros,
3.		Investments in buildings as well as in infrastructure of 1. January 2012 up to the end of December 31, 2026, with a total amount of up to 270 million euros, if required,
4.		the Institute of Science and Technology-Austria from 1. January 2017 until the end of December 31, 2026 for buildings, infrastructure, operational expenses as well as facility management, with proven demand, provides services and cash in total of up to 98 million euros.

(2) The agreement between the Land and the Institute of Science and Technology-Austria is a prerequisite for the expansion of the Spin-Offs area in respect of the construction, operation and utilization of the spin offs.

(3) The country creates a direct public transport line from the Institute of Science and Technology-Austria with connection to the centre of Vienna from the start of the current operation of the Institute of Science and Technology-Austria, with a value of 1.5 Millions of euros.

(4) The country shall be entitled to commission third parties with the performance of its obligations under this Agreement-in particular from the area of facility management-and will inform the federal government thereof. "

3. Art. IV is as follows:

" Article IV

Dismissal

(1) Ends shall be cleared immediately and shall be handed over to the country in accordance with Article I.

(2) If the current operation ends before 31 December 2051, the Federal Government shall reimburse the country to the amount corresponding to the sum of all the total investment costs which have not yet been repaid at that time. "

4. Art. V is as follows:
