380. Regulation of the Federal Minister for agriculture and forestry, environment and water management through the allocation of milk quotas in the twelve-month period 2012/2013 (milk quota allocation regulation 2012)
On the basis of § 10 par. 2 of the market organisation Act 2007 (MOG 2007), Federal Law Gazette I no. 55/2007, as last amended by Federal Law Gazette I no. 21/2012, is prescribed:
§ 1. This regulation serves the implementation

Regulation (EC) No 1234 / 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (single CMO Regulation), OJ No. L 299 of the 16.11.2007 p. 1 and 2 of Regulation (EC) No. 595/2004 laying down detailed rules for the application of Regulation (EC) no 1788/2003 of establishing a levy in the milk sector, OJ No. L 94 of 31.3.2004 p. 22.
§ 2. For the enforcement of this regulation and of the legal acts referred to in section 1 is the market place "Agrarmarkt Austria" (AMA) responsible.
§ 3. 30 000 tons milk quota for deliveries of milk producers are allocated with effectiveness from the twelve-month period of 2012/2013.
Submission of the
Unless a milk producers in the year 2012 no aid application has issued, but otherwise according to § 10 para 2 Z 1a MOG 2007 meets the requirements, he has 4. (1) no later than December 14, 2012 following a pattern set by the AMA at the AMA to apply for the allocation of milk quota.
(2) If a milk producer has submitted an aid application in 2012 and according to § 10 para 2, Z 1a MOG 2007 meets the conditions, he may withdraw December 14, 2012 in writing the request for allocation of quotas at least. This letter is to introduce in the AMA.
§ 5 (1) for the calculation of the allocation is einzelbetrieblich related to quota for deliveries of operations (main operations and branches) as well as any alpine plants and the representative fat content of the quota for deliveries of the main operation at the date 31 March 2012 significantly.
(2) the licence is in accordance with section 10 para 2 Z 1 MOG 2007 on the main operation.
§ 6. The AMA has to decide on the requests for allocation and to inform the allocated quotas for deliveries, as well as their representative fat content with effective beginning April 1, 2012 milk producers. The quotas for deliveries are be rounded to integers each commercial.
