444. Federal Ministry of Defence and Sport Ordinance on the setting of the journal service allowances and on-call compensation for the Federal Ministry of National Defence and Sport (Journal Service allowances-and Standby compensation ordinance-BMLVS 2012-JDBEV BMLVS 2012)

Due to § § 17a and 17b in connection with § 15 paragraph 2 of the salary law 1956 (GehG), BGBl. No. 54, and Section 22 (1) of the Contract Law Act 1948 (VBG), Federal Law Gazette (BGBl). No. 86, both last amended by the Federal Law BGBl. I. No 87/2012, shall be assigned with the consent of the Federal Chancellor:

General

§ 1. (1) The officials and contract staff employed in the field of the Federal Ministry of Defence and Sport outside the service hours prescribed in the service plan for a journal service shall be charged for those in the journal service. On-call time and the provision of services for the service of journal services in accordance with the provisions of § 2.

(2) The official and contract staff in the field of the Federal Ministry of Defence and Sport, who are outside the service hours prescribed in the service plan.

to be held in a service or at a certain other place in order to be able to take up their duties on the spot where necessary, or

2.

can be reached (willingness to call),

shall be charged for on-call compensation in accordance with the provisions of § 3.

(3) As a reference to this Regulation, the salary level of salary level 2 of service class V is applicable in accordance with Section 118 (5) of the salary law in 1956 (GehG), BGBl. N ° 54, as last amended by the Federal Law BGBl. I n ° 87/2012, including all-time inflation allowances.

Journal service allowance

§ 2. (1) The journal service allowance for periods of one of the following journal services on working days, which are not compensated for in free time, shall be the following hundreds of references per hour of the reference approach:

Journal service for the maintenance of the medical service at the Heeresspital (HSp), in

the military hospitals (MSp) and the Feldambulances (FAmb) for military doctors with special contract (MA2)

Journal service of the officers of the military medical

§ 3. The amount of time spent on stand-by is per hour of a call for call pursuant to section 17b (3) of the salary

for the persons referred to in Article 1 (2) (1) (1) (1) (1) of the remuneration, the remuneration for a period of overtime corresponding to the duration of the willingness in accordance with § § 16 and 17 GehG and

2.

for the persons referred to in Article 1 (2) (2) (2) (2), the following thousand sets of reference

§ 4. With the entry into force of this Regulation, the Regulation of the Federal Minister for National Defence of the Federal Republic of Germany on the setting of the journal service allowances and on-call compensation for the area of the Federal Ministry for National Defence, made in the Federal Ministry of Defence No. 99/1997, in connection with BGBl, in the publication of the Federal Ministry of Defence. II No 202/1997, except for force.
