481. Regulation of the Regulatory Commission of E-Control, which changes the system usage fees regulation 2012 (SNE-VO 2012)

The regulation of the Regulatory Commission of E-Control, which determines the charges for the use of the system (system usage fee-regulation 2012), BGBl. II No 440/2011, shall be amended as follows:

1. § 3 Z 12 reads as follows:

" 12.		The use of electrical energy for auxiliary and ancillary installations which is necessary for the operation of the network shall be exempted from the netting of the network usage charge; "

2. § 4 (1) (1) (1) to (8) and (2) are as follows:

(2) For the network use of network-level 3 systems of the transmission system, the following net payments, which are the annual amounts, shall be paid in twelve equal instalments to the Austrian Power Grid AG each month.

4. § 8 reads as follows:

" § 8. The following charges shall be determined for the system service charge to be paid by feed-in, including power plant parks, of more than five MW:

a)			Austrian area:							Cent 0 ,1790/kWh
b)			Region Tyrol:							Cent 0 ,1790/kWh
c)			Vorarlberg region:							Cent 0 ,1790/kWh "

5. § 11 (1) Z 6 reads as follows:

" 6.		Verification of measuring equipment owned by the network operator at the request of the network user

a) on site	40,00 €
b) by a competent inspection body	70.00 € "

6. In § 11 para. 3, second sentence, the word order shall be " Paragraph 1, Z 1, 2, 3, 4 and 6 " replaced by the phrase " 1 Z 1 to 4 and 6 " .

7. § 13 reads as follows:

" § 13. (1) The compensatory payments shall be determined as net payments in TEUR, which represent annual amounts, and shall be paid in twelve equal instalments per month.

(2) The following compensation payments shall be established for the region of Lower Austria:

1.		EVN Netz GmbH pays TEUR 13.8 to Stadtwerke Amstetten.

(3) The following compensatory payments shall be established for the Steiermark network area, the payments being made between the individual network operators in accordance with the following statement:

(4) The following compensatory payments shall be established for the Tirol network area, the payments being made between the individual network operators in accordance with the following list:

(5) The following compensatory payments shall be established for the Vorarlberg network area, the payments being made between the individual network operators in accordance with the following list:

(6) The following compensation payments are to be made for the network area Upper Austria, whereby the payment of the payments by the Energie AG Netz GmbH must be carried out:

(7) The following compensation payments are to be made for the Linz network area, whereby the settlement of payments by the Linz Strom Netz GmbH must be carried out:

8. The following paragraph 3 is added to § 14:

" (3) § § 3, 4, 6, 8, 11 and 13, as amended by the SNE-VO 2012-Novelle 2013, shall be replaced by 1. Jänner 2013 in force. "
