494. Regulation of the Federal Minister for labour, Social Affairs and consumer protection, on the assessment of consumer protection policy implications in the context of the effect-oriented impact assessment for regulatory projects and other projects (WFA consumer protection policy regulation WFA-KV)

On the basis of § 17 para 3 Z 3 of the Federal Budget Act 2013 (BHG 2013), Federal Law Gazette I no. 139/2009, I no. 62/2012, is amended by the Federal Act Federal Law Gazette in agreement with the Chancellor and ordered the Federal Minister of Finance:

Subject

1. (1) this regulation lays down the estimate of the effects of consumer protection policy in the framework of action-oriented assessment in accordance with section 17 BHG 2013.

(2) it contains methodological guidelines for the simplified and in-depth assessment of the impact of regulatory projects and projects of extraordinary financial importance in accordance with section 58 subsection 2 2013 BHG.

Simplified estimation

§ 2. In the framework of the simplified assessment is to check whether the effect dimension of consumer protection policy is likely to be significantly affected according to the specifications in Appendix 1. For this, the corresponding Wesentlichkeitskriterien of the EFC General Assembly are to be used.

In-depth assessment

The expected key consumer protection policy implications are § 3 (1) in the framework of the in-depth assessment according to the specifications in Appendix 2 to examine more closely.

(2) according to the specifications in Appendix 2 are a qualitative description and – provided that appropriate data is available - a quantitative estimation of the impact with respect to 1 the ratio of consumers to businesses and this related financial impact on consumers;

2. consumer protection facilities and nationally recognized debt advice;

3. the health or safety of consumers in connection with products or services to carry out.

(3) in the assessment of the effects on particularly vulnerable groups of consumers (E.g., children, seniors, people with disabilities), caution is to take.

Entry into force

§ 4. This Regulation shall enter into force 1 January 2013.

Simplified assessment of consumer protection policy implications

The simplified assessment involves answering the following questions:

Has the scheme / the project

-Impact on the relationship between consumers and companies? How many consumers will be expected to directly or potentially affected?

-direct financial impact on consumers in their relations with companies? What degree will this financial impact have?



(2) consumer protection facilities



Has the scheme / the project legal or financial implications for consumer protection institutions, including nationally recognized debt advice?



(3) health and safety in connection with products or services



Has the scheme / the project affect the health or safety of consumers in connection with products or services?

The in-depth assessment involves answering the following questions:
