496. Regulation of the Federal Minister for Labour, Social Affairs and Consumer Protection on the impact-oriented impact assessment of regulatory projects and other projects relating to social impacts (WFA-Social-Regulation-WFA-SV)

On the basis of § 17 paragraph 3 Z 3 of the Federal Budget Act 2013 (BHG 2013), BGBl. I n ° 139/2009, as last amended by the Federal Law BGBl. I n ° 62/2012, is to be assigned in agreement with the Federal Chancellor and the Federal Minister for Finance:

Subject matter

§ 1. (1) This Regulation regulates the assessment of the social impact in the context of the impact-oriented impact assessment according to § 17 BHG 2013.

(2) It contains methodological requirements for the simplified and in-depth assessment of the effects of regulatory projects and of projects of exceptional financial significance in accordance with § 58 (2) of the BHG 2013.

Definitions

§ 2. For the purposes of this Regulation, the following definitions shall apply:

1.

Employees/Employees are persons with private-law contracts, public service employees and free service workers.

2.

The Europe 2020 social target group includes persons at risk of poverty, significantly materially deprivated persons and persons in households with no or very low labour intensity.

3.

The Group of Persons at risk of poverty includes persons whose household has a net income (earning income, social transfers and other income), which is less than 60% of the national equivalent net median income.

4.

The Group of materially deprivated persons Includes persons who cannot afford basic goods or which cannot cover basic needs financially (for example, adequate heating of the apartment, a telephone or a washing machine are not financially It is not possible to reduce the costs of rent, operating costs or loans in cash or in arrears).

5.

On Households with no or very low labour intensity These are households where the total employment of all household members of working age is less than 20% of the household's employment potential over the course of a year.

6.

Employment multipliers specify the employment effects of demand-related changes and are regularly determined according to scientific methods.

Simplified Estimation

§ 3. In the context of the simplified assessment, it is necessary to examine whether the social dimension is likely to be significantly affected. In this connection, it is to be estimated how many persons are involved in the regulatory project or other projects with regard to the Appendix 1 could be affected. In the context of the simplified assessment of the effects on the labour market, the demand effects of the measure are to be assessed.

In-depth estimation

§ 4. In the context of the in-depth assessment, the likely significant social effects according to the requirements in Appendix 2 more precisely. In the in-depth assessment of the labour market, indirect employment effects resulting from demand-driven changes are also to be taken into account by means of employment multipliers.

Assessment period

§ 5. In each case, the in-depth assessment shall be based on a period of five years from the date of implementation of the scheme or Realization of the other project. By way of derogation, the results of the assessment of the impact on employment shall be presented separately for each of the five years, according to Annex 2 Z 2, according to the employment multipliers.

§ 6. (1) This Regulation shall enter into force 1. Jänner 2013 in force.

(2) The impact on the Europe 2020 social target group (Appendix 1 Z 3 and Annex 2 Z 3) shall not be assessed until 1 July 2013, by way of derogation from paragraph 1.
