17. Federal Act to amend the Explosives Act 2010 (Explosives Act-Novel 2012)

The National Council has decided:

The Explosives Act 2010 (SprG), BGBl. I n ° 121/2009, as last amended by the Federal Law BGBl. I No 50/2012, shall be amended as follows:

1. The following entry is inserted in the table of contents in accordance with § 47:

" § 47a

Regulations "

Section 2 (7) reads as follows:

" (7) The provisions relating to labelling (§ § 11 and 12) shall not apply to:

1.

Pulsinous cords (safety suits) and other ignition cords that are the priming agents under this federal law,

2.

Explosives that are unpacked or transported in a mixing device are delivered and loaded directly into the borehole, and

3.

Explosives produced at the site of the intended use and loaded immediately after manufacture (in-situ production). "

3. § 11 together with the title is:

" Labelling

§ 11. (1) Persons who manufacture, process, transfer or import into Austria according to the provisions of this Federal Law shall be obliged to apply to shooting and explosives and to any smallest packaging unit. clear identification.

(2) Persons acting in accordance with the provisions of this Federal Law with shooting and explosives and repackaging them shall be obliged to affix a clear identification on shooting and explosives and the smallest packaging unit.

(3) The Federal Minister of the Interior has, by means of Regulation, the exact nature and manner of the clear marking and its affixing in accordance with Directive 2008 /43/EC establishing a procedure for the identification and tracing of Explosives for civil use in accordance with Council Directive 93 /15/EEC, OJ L 80, 23.3.1993, p. 4. § 47 (2) and (3) shall be replaced by the following paragraphs 2 to 4:

" (2) § 38 (1) and (2) and § 44 (1) in the version of the Federal Law BGBl. I N ° 50/2012 will enter into force on 1 September 2012.

(3) § § 11 and 12 in the version of the Federal Law BGBl. I n ° 121/2009 do not enter into force with 5 April 2012.

(4) § § 2 (7) and 11 (1), (1), (3) and (4) together with the title in the version of the Federal Law BGBl. I N ° 17/2013 will enter into force on 5 April 2013. Section 11 (2) in the version of the Federal Law BGBl. I n ° 17/2013 and § 12 in the version of the Federal Law BGBl. I n ° 121/2009 enter into force with 5 April 2015. "

5. In accordance with § 47, the following § 47a and heading is inserted:

" Regulations

§ 47a. Regulations on the basis of this Federal Act may already be issued from the day following its proclamation; however, they may be put into effect at the earliest with the entry into force of this Federal Law. "
