27. Revocation of the Federal Chancellor on the annulment of the phrase "does not, however, refer to sound or image recordings and" in Section 52 (1) of the Code of Criminal Procedure in 1975 by the Constitutional Court
According to Art. 140 (5), (6) and (7) B-VG, and in accordance with Section 64 (2) of the Constitutional Court Act 1953, BGBl. No. 85, is made known:
The Constitutional Court, with the recognition of 13 December 2012, G 137 /11-15, was sent to the Federal Chancellor on 10 December 2012. January 2013, on the request of the Oberlandesgericht Wien 13. December 2011, Zlen. 21 Bs 407 /10x, 21 Bs 340 /11w, rightly recognized:

However, the phrase "does not refer to sound or image recordings and" in § 52 (1) of the Code of Criminal Procedure in 1975, BGBl. No. 631 idF BGBl. I n ° 52/2009, is unconstitutional. |

The repeal shall enter into force on the expiry of 31 December 2013. |

Previous legal provisions do not enter into force again. |

IV. |
The repeal of the phrase shall no longer apply to the courts in all the criminal proceedings on which the above request is based. " |
