45. Ordinance of the Federal Minister of Justice, with which the ordinance of the Federal Minister of Justice on formal requirements in judicial proceedings carried out with the aid of automation-assisted data processing, as well as creation of errands in an abbreviated form (ADV-Form Regulation 2002-AFV 2002)

On the basis of § 247 (1) and § 250 (2) of the Code of Civil Procedure, RGBl. N ° 113/1895, as last amended by the Federal Law BGBl. I n ° 30/2012, § 79 (5) of the GOG, RGBl. No 217/1896, as last amended by the Federal Law BGBl. I n ° 35/2012, and Section 54a of the Executive Order, RGBl. No 79/1896, as last amended by the Federal Law BGBl. I No 50/2012, shall be arranged:

The ordinance of the Federal Minister of Justice on Former Requirements in judicial proceedings carried out with the aid of automation-assisted data processing, as well as the creation of accusations in a shortened form (ADV-Form Regulation 2002-AFV 2002), BGBl. II No 510/2002, as last amended by the BGBl Regulation. II No 63/2007, shall be amended as follows:

1. In Section 1 (1), the word sequence shall be deleted "the replayed in the plants" and the clip expressions "(Annex A)" , "(Annex B)" and "(Annex C)" .

2. In Section 1 (2), the turn shall be "Website of the Federal Ministry of Justice" through the turn "Website of the judiciary" replaced.

3. In § 1 para. 3, the citation shall be "§ 7 ERV 2005" by "§ 7 ERV 2006" replaced.

4. § 5 (1) reads:

" (1) The court has to comply with the instructions of the Federal Minister for Justice (VJ-Online-Handbuch) in the case of a written sentence in accordance with § 1 or § 2 in the case of automation-supported data processing. The VJ-Online-Manual is to be made available to all employees in court who have to process such pleadings electronically. "

5. In accordance with Article 7 (5), the following paragraphs 6 and 7 are added:

" (6) The Annexes A and C, respectively as amended by the Regulation BGBl. II No 63/2007, and Annex B, as amended by the BGBl Regulation. II No 506/2003 shall take place at the end of the 31. Jänner 2013 repeal.

(7) § 1, § 5 (1) and § 7 (7), each in the version of the BGBl Regulation. II No. 45/2013 enter into force on 1 February 2013 "
