34. Federal Act, which amends the Federal Road Act 1971

The National Council has decided:

The Bundesstraßengesetz 1971 (BStG 1971), BGBl. No 286/1971, as last amended by the Federal Law BGBl. I No 62/2011 shall be amended as follows:

1. § 2 para. 2, first sentence reads:

" Connections will be used to connect

1.

to the rest of the public road network,

2.

to freight terminals, freight terminals or freight transport centres (railway lines within the meaning of Section 10 of the Railway Act 1957, BGBl. 60), with a land use of at least 50 ha;

3.

to airports within the meaning of § 64 of the Aviation Act, BGBl. No 253/1957, or

4.

to ports within the meaning of § 2 Z 20 of the Shipping Law (SchFG), BGBl. No 62/1997, or in the sense of Section 2 (23) of the SchFG, which shall be accessible to ships with a carrying capacity of more than 1 350 tonnes;

2. In § 26 (1) the expression " 3 " by the expression " 2 to 4 " replaced.

3. In § 26, paragraph 4 receives the sales designation "(5)" ; the following new paragraph 4 shall be inserted:

" (4) The federal government (federal road administration) may allow access and departures to and from military properties of the Federal Army for military purposes, provided that it is ensured that no traffic safety on the federal road is guaranteed. Disadvantages are to be expected. The expenses incurred by the Federal Government (Bundesstraßenverwaltung) in this way must be deducted. "
