63. Regulation of the Board of the E-control over the more detailed control of data collection to the perception which in article 131, paragraph 1 MLA 2011 monitoring tasks (gas monitoring regulation CMO-VO)

On the basis of § 131 section 2 Gas Act 2011 - MLA 2011, Federal Law Gazette I no. 107/2011, in conjunction with article 7, paragraph 1 Energy Control Act E-ControlG, Federal Law Gazette I no. 110/2010 in the version of Federal Law Gazette I is no. 107/2011, prescribed:

Subject

§ 1. This regulation regulates the MLA to the monitoring tasks in the sphere of natural gas industry in article 131, paragraph 1 2011 required population, units and features, characteristic value, data format, frequency, intervals and ongoing data collection procedures and determine the accountability of individuals.

Definitions

The term may refer to section 2 (1) within the meaning of this Regulation:



1. "Customer groups" the classification of the end users (customers) into the following groups of acceptance a.
Inadequate performance customers. You are to divide a standard load profiles, in addition to the groups budget, trade, and other gradually to another following size classes of last year's sale to final consumer: - kWh up to including 5,600, - over 5,600 up including 55.600 kWh - about 55.600 kWh;

b. Leistungsgemessene customers. They are to be broken down by the size classes of last year's sale to final consumer, with gas-fired plants separately with a contractual agreed maximum power rating of at least 50,000 kWh/h as a checksum value: - up including 278 MWh/a.

-more than 278 MWh/a-including 400 MWh/a;

-over 400 MWh/a to including 2.778 MWh/a;

-over 2.778 MWh/a to including 5,595 MWh/a;

-over 5,595 MWh/a to including 27.778 MWh/a;

-over 27.778 MWh/a to including 277.778 MWh/a;

-over 277.778 MWh/a;

2. "Constraint" reduction of the maximum available power;

3. "Import quantities" all quantities of gas fed on cross-border border coupling points;

4. "Network access request" a by the end user to the operator-oriented formal search on network access, the at least the in Appendix 1 of the gas market model regulation 2012 - GMMO-VO 2012, Federal Law Gazette II No. 171/2012 as amended, contains listed information.

5. a "Network access request" from the end user to the network operator-oriented formal application on network access, that contains at least the minimum contents listed in annex 1 of the GMMO regulation 2012;

6 "unplanned supply disruption" does not intend any interruption of the supply of consumers with natural gas.

(2) in addition the definitions of the GWG shall apply the gas statistics regulation 2012 - 2011, GStat-VO 2012, Federal Law Gazette II No. 475/2012 as amended, the gas network service quality regulation, Federal Law Gazette II No. 172/2012 as amended, the 2012 GMMO-VO, the changing regulation of gas 2012, Federal Law Gazette II No. 196/2012 as amended, and the load profile regulation in 2006, Austria in the Official Gazette of the Wiener Zeitung No. 245 of 20 December 2006 as amended.

Hour values - month surveys

§ 3 each 6 o'clock are 6: 00 for the period of the month until the first of the month of the month following the reporting month to sign East of the market area manager in the market area as hourly values per day of gas:



1. network utilization according to Regulation (EC) No. 715/2009 for all relevant points of the transmission grids in accordance with Regulation (EC) No. 715/2009 on conditions for access to the natural gas transmission networks, OJ No. L 211 of August 14, 2009 p. 36, as well as for the entry and exit points of the transmission system in storage facilities in accordance with section 74 paragraph 2 MLA 2011: a. the maximum technical capacity for flows in kWh/h;

b. the entire capacity contracted in kWh/h, separated after contractually binding capacity in accordance with GMMO-VO 2012 and § 2 para 1 No. 6 and article 2, paragraph 1 gas system usage fees regulation 2013, Federal Law Gazette II No. 309/2012 of sub-plans and interruptible capacity;

c. the entire nominated capacity in kWh/h to the last re nomination time, divided into contractually binding and interruptible capacity;

(d) the actual measured load flows in kWh/h, separated after contractually binding and interruptible capacity;

2. network buffer (Linepack) gem. § 29 par. 2 GMMO VO 2012 in kWh;

3. market area balance gem. § 26 para 7 GMMO VO 2012 in kWh/h;

4. Balancing energy procurement via virtual trading point (stock exchange): a. each the trade volumes of standardized products, the market area manager pursuant to § 26 para 4 buys GMMO-VO 2012 balance groups individual to compensate for the imbalance of the day or sold in kWh/h per balance sheet group, divided into buying and selling;

b. each-the trading volume of standardized products, which the market area manager in accordance with § 26 par. 7 2012 GMMO-VO spends under active structuring or sold in kWh/h and the respective price in euro/MWh, separated after buying and selling;

5. Balance sheet balance energy pursuant to § 26 para 6 Z 1 GMMO-VO 2012 per balance sheet group, separated according to tradition (positive deviation from the roadmap) and under delivery (negative deviation from the schedule) in kWh/h and structuring contribution in euro/MWh.

§ 4. 6 o'clock are 6: 00 for the period from the first of the month of the month until the first of the month of the month following the reporting month to report the distribution area manager as hourly values:



1. network utilization according to Regulation (EC) No. 715/2009 for the border linking points at distribution level: a. the maximum technical capacity for flows in kWh/h;

b. the total capacity contracted in kWh/h separately after contractually binding and interruptible capacity;

c. the entire nominated capacity in kWh/h to the last re-nomination time;

(d) the actual measured load flows in kWh/h;

2. the volume of usable network buffer (Linepack) in the distribution area in kWh;

3. distribution area Delta in kWh/h.

§ 5 6 o'clock are 6: 00 for the period from the first of the month of the month until the first of the month of the month following the reporting month to report as hourly values of the balance group coordinators to market areas:



1 physical balance energy procurement via virtual trading point (stock exchange): respectively the trade volumes of standardized products in MWh/h and respective compensation energy product price in euro/MWh per hour and gas day, separately after buying and selling;

2. physical balance energy procurement through merit order list: a. balance energy deals in MWh/h and Euro/MWh for balance energy supplier, disconnected after buying and selling;

b. the demand quantity of physical balance energy in MWh/h and Euro/MWh for balancing energy provider, separately after buying and selling;

3. clearing price in euro/MWh, divided into buying and selling;

4. for power users pursuant to § 18 paragraph 6 and § 37 para 6 GMMO-VO 2012 the hourly amounts of bilanziellen balance energy gem. § 7 para 1 Z 2 MLA 2011 in kWh/h after balance groups, separated by above and under delivery as well as the gem. § 32 paragraph 2 or article 44, para. 3 GMMO-VO 2012 established market-based compensation energy prices in EUR/MWh.

5. quantities of special balance group in accordance with § 24 GMMO-VO 2012 in the distribution area in MWh;

6 whole delivery to end users, as well as on the net loss balance sheet group separately to the balance group in MWh;

7 power transfer quantities of operators in MWh.

Tag values - month surveys

§ 6 6 o'clock are 6: 00 for the period from the first of the month of the month until the first of the month of the month following the reporting month to sign of the balance group coordinators according to market regions for each gas day:



1. for Web users according to § 18 paragraph 5 and 7 or § 37 para 5 and 7 GMMO-VO 2012 the daily quantities of bilanziellen balance energy in accordance with § 7 paragraph 1 Z 2 MLA 2011 in kWh/h after balance groups, separated by above and under delivery per day of gas as well as in accordance with article 32, paragraph 3 or article 44 para GMMO-VO 2012 determined market-based compensation energy prices;

2. for power users in accordance with § 24 GMMO-VO 2012 the daily quantities of bilanziellen balance energy in accordance with article 7, paragraph 1 Z 2 MLA 2011 in kWh/h after balance groups, separated by above and under delivery per day of gas as well as the determined GMMO-VO 2012 pursuant to § 32 para 4 market-based compensation energy prices.

§ 7 6 o'clock are 6: 00 for the period from the first of the month of the month until the first of the month of the month following the reporting month market area manager in the market area to East for daily gas of the weighted average of the burning value (Nm3/kWh) of the whole, fed into a market area gas (with the exception of storage facilities).

§ 8 6 o'clock are 6: 00 for the period from the first of the month of the reporting month until the first of the month of the month following the reporting month to report East gas daily by the owner of the virtual trading point in the market:



1. aggregate OTC trading volumes in MWh, aggregate number of trading participants and Marktkonzentrationsdatengetrennt by buying and selling;

2. aggregate trade volumes of the commodity market with natural gas in MWh and according to product and market concentration data distribution by purchase and sale;

3. reference price on the commodity market for day-ahead and week-end products in EUR/MWh;

4. aggregate trade volumes of the derivatives exchange with natural gas in MWh and according to product and market concentration data distribution by purchase and sale;

5. reference prices on the futures market by product in EUR/MWh;

6.

registered gas trader on the VHP on the last day of the month of the survey month;

7. number of gas traders, who have submitted nominations to the VHP.

§ 9 6 o'clock are 6: 00 for the period from the first of the month of the month until the first of the month of the month following the reporting month by the memory company for gas daily to report:



1. information using on / off memory performance: a. technically maximum performance in kWh/h and kW/day.

b. contracted performance in kWh/day under storage contracts, binding and interruptible;

c. used (appropriate) performance in kWh/day, binding and interruptible;

2. details of working gas volume: a. technically maximum working gas volume in GWh at 6: 00 of the next calendar day of the reporting month.

b. foreign working gas volume in GWh at 6: 00 of the next calendar day of the reporting month.

c. booth working gas volume in GWh at 6: 00 of the next calendar day of the month;

3. limitations- and from storage performance, each starting and ending date and time: a. planned: restriction and/or from storage performance in kWh/h;

b. unplanned: restriction and/or from storage performance in kWh/h;

4. on the basis of article 17 paragraph 3 of Regulation (EC) No. 715 / 2009 sold day ahead storage capacity, separated after interruptible and firm capacity in kWh/h (on and off memory performance) and GWh (gas volume).

§ 10 6 o'clock are 6: 00 for the period from the first of the month of the month until the first of the month of the month following the reporting month by the transmission system operators for gas daily to report:



1. number of constraints per input and exit point in the network;

2. start and end time of the restrictions, each subdivided according to planned and unplanned constraint in kWh/h of transport performance.

Monthly values - month surveys

§ 11 6 o'clock are 6: 00 for the period from the first of the month of the month until the first of the month of the month following the reporting month except by the a risers by biogenic gases to report single feeders:



1. volume weighted average import price in cents/kWh without taxes and duties after contractual transfer point and cross-border boundary coupling point;

2. import quantity in kWh to contractual transfer point and cross-border boundary coupling point;

3. volume weighted average purchase price in cents/kWh in respect of domestic producers to contractual transfer point and mains coupling point;

4. purchasing amount of domestic producers in kWh to contractual transfer point and mains coupling point.

§ 12 6 o'clock are 6: 00 for the period from the first of the month of the month until the first of the month of the month following the reporting month to report of the distribution system operators:



1. sale to final consumer in kWh, total and separately after performance measured consumers with gas-fired plants separately with a contractual agreed maximum power rating of at least 50,000 kWh/h as a checksum value, and utilities;

2. number of switching (substitute counting points) after power levels, customer groups, and utilities;

3. number of shutdowns of metering points and the number of the resumption of supply after shut down, each divided into appropriate to the performance and not the performance end users, with the number of shutdowns at the suspension of the contract and the number of shutdowns termination due to breach of contractual obligations are to be specified separately;

4. number of final reminders by registered mail pursuant to article 127, paragraph 3 MLA 2011 disconnected performance measured and unmeasured power consumer.

§ 13 each for the period by the first of the month of the month 6: 00 until the first of the month of the month following the reporting month 6: 00 are providers cleared volume weighted average energy prices for consumer performance measured in euro cents/kWh, not including taxes and duties, each separated log to customer groups.

Half-year values – half-year survey

§ 14 are charged average volume-weighted energy prices for inadequate performance consumer in euro cents/kWh for the period from 1 January to 30 June, from 1 July to 31 December of the year of the providers, without separately logging taxes and fees, according to customer groups.

Monthly values - year surveys

§ 15 are for the calendar year to report of the distribution system operators as monthly values:



1. number of non-successful changes to network levels and customer groups, as well as reasons for rejection and suppliers;

2. number of new connections (new equipment) including the average processing time in days, divided into levels of power;

3. carried out maintenance and repair services, and required time in hours, divided into levels of power;

4. number and duration in minutes of planned disruptions including number of consumers affected, divided into levels of power;

5. number and duration in minutes of unplanned supply disruptions separately to cause and the number of consumers affected, disconnected to power levels as well as equity or causes (if determined);

6. number of customer complaints and requests of non performance measured customers, as well as the average processing time of complaints of inappropriate performance customers in working days. The breakdown of the subject of enquiries and complaints are each at least in the categories: a. Verrechnungsrelevante requests/complaints;

b. technical inquiries/complaints;

c. other requests/complaints.

§ 16 each are for the calendar year by the providers as monthly values to report the number of customer complaints and enquiries by inappropriate power customers, and the average processing time of complaints of inappropriate performance customers in working days. The breakdown of the subject of enquiries and complaints are each at least in the categories:



a. Verrechnungsrelevante requests/complaints;

b. technical inquiries/complaints;

c. other requests/complaints.

Year values - annual survey

§ 17 each for the calendar year is the method of calculating the capacity offered to third parties on an interruptible basis, to report by the transmission system operators.

§ 18 are for the calendar year by the distribution system operators to report:



1. number of end users (counting points) at December 31, 24 hours, divided into network levels, customer groups and providers;

2. sale to final consumer in kWh, divided into network levels, customer groups and providers;

3. number of installed and used pre-payment meters at December 31 at midnight;

4. number of laterals at midnight on December 31 divided based on power levels, as well as for active and inactive connections;

5. number of new applications, divided according to new sign-ups for an existing connection by end users, and new applications for newly-built ports, network levels, customer groups and providers;

6. number of cancellations after network levels, customer groups and providers;

7. number of full network access requests as well as their average processing time in days and divided power levels and type of the end user in accordance with Annex 1 of the GMMO regulation 2012;

8. number of full network access requests as well as their average processing time in days and disaggregated by power levels and type of the end user in accordance with Annex 1 of the GMMO regulation 2012 as well as the type of connection (active, inactive, new);

9 number of accruals according to customer groups within the 6 weeks pursuant to section 6 para 4 gas network service quality regulation, separated by power bills and accounts (power and energy), if any;

10 number of calculation according to customer groups, less than six weeks after termination of the agreement were, sent out separately to power bills and accounts (power and energy), if available.

§ 19 are for the calendar year by the providers to report:



1. number of powered consumer (count points) per customer group and grid area at December 31 at midnight;

2. output energy in kWh to supply end users per customer group and grid area;

3. number of new customers per customer group and grid area, switching each customer group and grid area separately to be specified;

4. number of customers relying on the provider of last resort (primary care) in accordance with § 124 MLA 2011 by end users (customers) per customer group and network area.

5. number of exits by end users (customers) per customer group and grid area;

6. number of final reminders by registered mail pursuant to article 127, paragraph 3 MLA 2011 per customer group and network area.

7 number of calculation according to customer groups, divided into energy bills and accounts (power and energy);

8 number of accruals, which later than six weeks after termination of the contract were sent out to customer groups separated according to energy bills and accounts (power and energy);

9 number of inappropriate performance customers (consumers), where the same supplier, a product change request has taken place.

Disclosure, data formats


Section 20 (1) all balance group coordinators, market area manager, distribution area manager, exchanges, operator of the virtual trading point, network operators, storage companies, feeder (except feeder of biogenic gases) and utilities are reporting companies within the meaning of this regulation.

(2) the owner or the external representation-authorised body of a reportable business is required to report.

(3) data forming the subject-matter of the notification must be communicated by using the formats provided by E-control electronically E-control.

Registration dates

The data referred to in articles 3 to 14 are § 21 (1) of the respondents to submit no later than the 20th calendar day of the month following the reporting period and the date of the survey on the E-control.

(2) the data referred to in sections 15 to 19 are to submit each no later than February 15 of the year following the reporting period on the E-control. Except the data in accordance with § 15 are Nos. 4 and 5 and § 18 Nos. 7 and 8. These are to provide each no later than 31 March of the year following the reporting period on the E-control.

(3) that are § 3 Z 4 and 5 and § 5 data in accordance with to deliver promptly to the E-control after the second clearing.

Transitional and final provisions

22. (1) this regulation with 1 March 2013 enter into force.

(2) for those values, which are charged for the period of one year (month values/annual survey, annual values/annual survey), the period of publication of the regulation until 31 December is the notification obligation for the year 2013.

(3) that Z are reporting date according to § 18 1, 3 and 4 of the distribution system operators and in accordance with section 19 are Z 1 to log providers for calendar year 2013 in addition to the date March 1, 2013. This message has to be carried out no later than April 15, 2013.
