63. Regulation of the Management Board of E-Control on the detailed regulation of the data collection for the performance of the monitoring tasks referred to in § 131 (1) GWG 2011 (Gas Monitoring Regulation-CMO-VO)

On the basis of Section 131 (2) of the German Gas Law 2011-GWG 2011, BGBl. I n ° 107/2011, iVm § 7 para. 1 Energy Control Act-E-ControlG, BGBl. I No 110/2010 in the version of the Federal Law BGBl. I No 107/2011, shall be arranged:

Subject-matter

§ 1. This Regulation lays down the survey mass, units and characteristics required for the performance of the monitoring tasks in the field of natural gas management in Section 131 (1) of the GWG 2011, feature approval, data format, frequency, time intervals and Procedure for the ongoing data collection and determines the person responsible for providing information.

Definitions

§ 2. (1) For the purposes of this Regulation, the following definitions shall apply:

1.

"customer groups" means the division of the end consumers (customers) into the following collection groups

a.

Non-performance customers. They are to be divided, on the one hand, by standard load profiles, and also by the household, trade and other groups and, on the other hand, by the following size classes of last year's levy to end consumers:

-

up to and including 5,600 kWh,

-

More than 5,600 kWh, including 55,600 kWh,

-

over 55,600 kWh;

b.

Performance-measured customers. They are to be broken down according to the size classes of last year's supply to final consumers, where gas-fired power plants with a contractual agreed maximum output of at least 50,000 kWh/h are to be given separately as the sum value:

-

up to and including 278 MWh/a;

-

over 278 MWh/a up to and including 400 MWh/a;

-

More than 400 MWh/a up to and including 2.778 MWh/a;

-

More than 2,778 MWh/a up to 5,595 MWh/a;

-

5,595 MWh/a up to and including 27,778 MWh/a;

-

27.778 MWh/a up to and including 277,778 MWh/a;

-

277.778 MWh/a;

2.

"limitation" reduction of the maximum available power;

3.

"import quantities" means all quantities of gas which are fed via cross-border cross-border coupling points;

4.

"Network access request" means a formal request for network access from the end user to the network operator, at least the one in Appendix 1 of the Gas Market Model Regulation 2012-GMMO-VO 2012, BGBl. II No 171/2012 idgF, as specified;

5.

"network access request" means a formal request for access to the network by the end user to the network operator containing at least the minimum content referred to in Annex 1 to the GMMO-VO 2012;

6.

"unplanned supply disruption" does not intend to interrupt the supply of natural gas to final consumers.

(2) In addition, the definitions of the GWG 2011, the Gas Statistics Regulation 2012-GStat-VO 2012, BGBl. II No. 475/2012 idgF, the Gas Network Service Performance Quality Regulation, BGBl. II No. 172/2012 idgF, the GMMO-VO 2012, the Exchange Ordinance Gas 2012, BGBl. II No 196/2012 idgF, and the load-profile regulation 2006, published in the Official Journal of the Vienna newspaper no. 245 of 20 December 2006 idgF.

Hourly-Monthly Hebrews

§ 3. In each case for the period of the reporting month 6 a.m. to the month of the month following the month following the reporting month 6 a.m., the market area manager in the market area East shall report as hourly values per day of the day:

1.

Network utilization in accordance with Regulation (EC) No 715/2009 for all relevant points of the transmission networks referred to in Regulation (EC) No 715/2009 on the conditions for access to the natural gas transmission networks, OJ L 327, 30.4.2009, p. No. 36, as well as for the points of entry and exit from the transmission system in storage facilities in accordance with Section 74 (2) of the GWG 2011:

a.

the maximum technical capacity for load flows in kWh/h;

b.

the total contracted capacity in kWh/h, separately according to the contractually binding capacity according to GMMO-VO 2012 and § 2 para. 1 Z 6 and § 2 para. 1 Gas-System-Use-charges-Regulation 2013, BGBl. II No 309/2012 idgF, and interruptible capacity;

c.

the total nominated capacity in kWh/h at the last time of renomination, separately in accordance with contractually binding and interruptible capacity;

d.

the actual measured load flows in kWh/h, separately in accordance with contractually binding and interruptible capacity;

2.

Network buffer (Linepack) gem. § 29 para. 2 GMMO-VO 2012 in kWh;

3.

Market area saldo gem. § 26 para. 7 GMMO-VO 2012 in kWh/h;

4.

Balancing energy supply via virtual trading point (stock exchange):

a.

the trade volumes of the standardised products which the market area manager buys or sells in accordance with § 26 para. 4 GMMO-VO 2012 to compensate for the daily unbalance of individual balance sheet groups, in kWh/h per balance sheet group, separately after purchase and Sale;

b.

the trade quantities of the standardised products which the market area manager buys or sells for the under-acting structuring pursuant to Article 26 (7) of the GMMO-VO 2012, in kWh/h and the respective price in Euro/MWh, separately after purchase and sale;

5.

Balance-of-balance energy according to § 26 para. 6 Z 1 GMMO-VO 2012 per balance group, separated after delivery (positive deviation from the timetable) and sub-delivery (negative deviation from the timetable) in kWh/h and structural contribution in euro/MWh.

§ 4. In each case for the period from 6 a.m. to the month of the month following the month following the month following the reporting month, 6 a.m. should be reported by the distribution area manager as hourly values:

1.

Network utilization in accordance with Regulation (EC) No 715/2009 for the limit coupling points at the distribution network level:

a.

the maximum technical capacity for load flows in kWh/h;

b.

the total contracted capacity in kWh/h separately in accordance with contractual and interruptible capacity;

c.

the total nominal capacity in kWh/h at the last renomination time;

d.

the actual measured load flows in kWh/h;

2.

the volume of the usable net buffer (linepack) in the distribution area in kWh;

3.

Distribution area delta in kWh/h.

§ 5. In each case for the period from 6 a.m. to the month of the month following the month of the month following the month following the reporting month 6 a.m., the balance sheet group coordinators shall be reported as hourly values by market areas:

1.

Physical balancing energy procurement via virtual trading point (stock exchange): in each case the trade volumes of the standardized products in MWh/h and the respective price of the compensating energy product in Euro/MWh per hour and day of gas, separately after purchase and Sale;

2.

Physical balancing energy procurement via Merit Order List:

a.

Compensatory energy offers in MWh/h and Euro/MWh according to compensation energy providers, separately after purchase and sale;

b.

Demand quantities of physical balancing energy in MWh/h and Euro/MWh according to compensation energy providers, separately after purchase and sale;

3.

Clearing price in Euro/MWh, separately after purchase and sale;

4.

For network users according to § 18 (6) or § 37 para. 6 GMMO-VO 2012 the hourly quantities of the balance energy in accordance with the balance. Section 7 (1) Z 2 of the GWG 2011 in kWh/h according to balance sheet groups, separately after over-and under-delivery as well as the gem. Section 32 (2) and Section 44 (3) of the GMMO-VO 2012 market-based compensation energy prices in Eur/MWh;

5.

Reference quantities of the special balance sheet groups according to § 24 GMMO-VO 2012 in the distribution area in MWh;

6.

the total supply to final consumers and to the net loss balance groups in each case separately by balance sheet group in MWh;

7.

Network transfer quantities of the network operators in MWh.

Daily Values-Monthly Hebrews

§ 6. In each case for the period from 6 a.m. to the month following the month following the month following the month following the reporting month, 6 o'clock shall be reported by the balance group coordinators to market areas for each day of the day:

1.

for network users according to § 18 (5) and (7) or § 37 para. 5 and 7 GMMO-VO 2012 the daily quantities of the balance energy according to § 7 para. 1 Z 2 GWG 2011 in kWh/h by balance sheet groups, separately according to over and under delivery per day of gas as well as those according to § 32 para. 3 and/or Section 44 (1) GMMO-VO 2012 determined market-based compensation energy prices;

2.

for network users according to § 24 GMMO-VO 2012 the daily quantities of the balance energy according to § 7 (1) Z 2 GWG 2011 in kWh/h by balance sheet groups, separately after transmission and sub-delivery per day of gas as well as the according to § 32 para. 4 GMMO-VO 2012 determined market-based compensation energy prices.

§ 7. The weighted average value of the calorific value (Nm3/kWh) of the weighted average of the calorific value (Nm3/kWh) shall be the weighted average value of the calorific value (Nm3/kWh) for each day of the day for each day of the month from the month of the month of the reporting month 6 a.m. to the month of the month following the month the total gas fed into a market area (excluding storage facilities).

§ 8. In each case for the period from 6 a.m. to the month following the month following the month following the reporting month, 6 a.m., the operator of the virtual trading point in the market area of East shall report for each day of the day:

1.

aggregate OTC trading volumes in MWh, aggregate number of trading participants, and market concentration data separately after purchase and sale;

2.

aggregate trading volumes of the commodity exchange with natural gas in both MWh and by product, as well as market concentration data, separately after purchase and sale;

3.

Reference price on the stock exchange for day-ahead and weekend products in Eur/MWh;

4.

aggregate trading volumes of the futures exchange with natural gas in both MWh and by product, as well as market concentration data, separately after purchase and sale;

5.

Reference price on the futures exchange by product in Eur/MWh;

6.

Registered gas dealers at the VHP on the last month of the survey month;

7.

Number of natural gas dealers who have submitted nominations to the VHP.

§ 9. For each day of the month following the month following the month following the month of the month following the month following the month of the month, 6 o'clock shall be reported by the storage companies for each day of the day:

1.

Information about the in-and out-of-memory performance:

a.

technically maximum performance in kWh/h and kWh/day;

b.

Performance contracted in kWh/day in accordance with storage contracts, binding and interruptible;

c.

(measured) performance in kWh/day, binding and interruptible;

2.

Information on the volume of work gas:

a.

Technically maximum working gas volume in GWh at 6 o'clock of the following calendar day of the reporting month;

b.

the operating gas volume contracted in GWh at 6 o'clock of the following calendar day of the reporting month;

c.

Stand working gas volume in GWh at 6 o'clock of the following calendar day of the reporting month;

3.

In-and out-of-memory limitations, both start and end times:

a.

Planned: limitation of the input and/or storage capacity in kWh/h;

b.

Unplanned: limitation of the input and/or storage capacity in kWh/h;

4.

Day ahead storage capacity sold on the basis of Article 17 (3) of Regulation (EC) No 715/2009, separated by interruptible and fixed capacity in kWh/h (input and storage capacity) and GWh (working gas volume).

§ 10. For each day of the month following the month following the month following the reporting month, 6 o'clock for each day of the month, the transmission system operators shall report for each day of the day:

1.

Number of restrictions per entry and exit point in the network;

2.

At the beginning and end time of the restrictions, each divided by planned and unplanned limitation in kWh/h of the transport performance.

Month Values-Monthly Survey

§ 11. In each case for the period from 6 a.m. to the month of the month following the month following the month following the reporting month, 6 o'clock shall be reported by the feed-in excluding feed-in of biogenic gases:

1.

quantity-weighted average import price in Cent/kWh without taxes and charges after transfer point and cross-border coupling point;

2.

Import quantity in kWh after transfer point and cross-border link point;

3.

Weighted average purchase price in Cent/kWh for domestic producers after a contractual transfer point and a network coupling point;

4.

Purchase quantity of domestic producers in kWh after a contractual transfer point and a network coupling point.

§ 12. In each case for the period from 6 a.m. to the month of the month following the month following the month following the reporting month, 6 o'clock shall be reported by the distribution system operators:

1.

Levy to end users in kWh, in total and separately according to performance-measured end consumers, in which gas-fired power plants with a contractual agreed maximum output of at least 50,000 kWh/h shall be specified as a sum value separately, and after Suppliers;

2.

Number of changes in supply (switched counting points) by network level, customer groups and suppliers;

3.

Number of counting points shutdowns and the number of resumption of deliveries after switching off, in each case separately for power and non-power-measured end-users, the number of shutdowns on suspension of the power supply the contract and the number of shutdowns in case of contract termination due to breach of contractual obligations to be specified separately;

4.

Number of last reminders with registered letter in accordance with § 127 (3) of the GWG 2011 separately for final consumers measured and not measured.

§ 13. In each case for the period from 6 p.m. to the month following the month of the month following the month following the reporting month, 6 o'clock shall be the calculated quantity weighted average energy prices for performance measured by the suppliers Final consumers in Euro Cent/kWh, without taxes and charges, to be reported separately according to customer groups.

Half-year values-Half-year survey

§ 14. In each case for the period of 1. From 1 July to 31 December of the reference year, from 1 July to 30 June, the average volume-weighted energy prices for non-performance consumers in euro cent/kWh, excluding taxes and charges, are calculated by suppliers, in each case separately according to customer groups.

Monthly values-Annual surveys

§ 15. For each calendar year, the distribution system operators shall be reported as monthly values:

1.

Number of unsuccessfully completed changes to network levels and customer groups as well as reasons for rejection and suppliers;

2.

Number of new connections (new installations), including the average processing time in days, separated by network level;

3.

the maintenance and repair services carried out and the time required in hours, broken down by network level;

4.

Number and duration in minutes of planned supply interruptions, including the number of final consumers affected, separated by network level;

5.

Number and duration in minutes of unplanned supply interruptions separately by reason and number of end users affected, separately by network level and by property or debt (if established);

6.

Number of customer complaints and requests from non-performance customers, as well as the average processing duration of complaints from non-performance customers in working days. The breakdown of the subject matter of the inquiries and complaints shall be made at least in the following categories:

a.

Account-related inquiries/complaints;

b.

Technical questions/complaints;

c.

Other inquiries/complaints.

§ 16. For each calendar year, the number of customer complaints and requests for non-performance customers, as well as the average processing duration of complaints from non-performance-measured customers, shall be the monthly values of the suppliers. Report customers in working days. The breakdown of the subject matter of the inquiries and complaints shall be made at least in the following categories:

a.

Account-related inquiries/complaints;

b.

Technical questions/complaints;

c.

Other inquiries/complaints.

Annual Values-Annual Survey

§ 17. For each calendar year, the transmission system operators shall be notified of the method of calculation of the capacity offered to third parties on a interruptible basis.

§ 18. For each calendar year, the distribution system operators shall report:

1.

Number of final consumers (counting points) at 31 December 24h, separated by network levels, customer groups and suppliers;

2.

Supply to end users in kWh, broken down by network level, customer groups and suppliers;

3.

Number of pre-payment meters installed and used as of 31 December 24h;

4.

number of home connections at 31 December 24h, broken down on the one hand by network level and by active and inactive connections;

5.

Number of new registrations, broken down by new registrations with the existing connection of end users, and new registrations for newly built connections, according to network levels, customer groups and suppliers;

6.

Number of logins by network level, customer groups, and utilities;

7.

number of total network access requests and their average processing time in days and broken down by network level and type of final consumer according to Appendix 1 of the GMMO-VO 2012;

8.

number of complete network access applications and their average processing time in days and broken down by network level and type of end user according to Appendix 1 of the GMMO-VO 2012 and type of connection (active, inactive, new);

9.

Number of final accounts according to customer groups within the 6 weeks according to § 6 (4) of the Gas Network Services Quality Regulation, separately according to network accounts and accounts (network and energy), if available;

10.

Number of final accounts according to customer groups sent out later than six weeks after the termination of the contract, separately according to network accounts and accounts (network and energy), if any.

§ 19. For each calendar year, please report to the suppliers:

1.

Number of final consumers (counting points) per customer group and per network area at 31 December 24h;

2.

Delivery quantity in kWh of supplied end users per customer group and per network area;

3.

Number of new customers per customer group and per network area, exchange of supply units per customer group and per network area are to be specified separately;

4.

Number of customers on the basis of the supplier of last resort (basic supply) according to § 124 GWG 2011 of end consumers (customers) per customer group and per network area;

5.

Number of exits from end users (customers) per customer group and network area;

6.

Number of last reminders with registered letter according to § 127 (3) of the GWG 2011 per customer group and network area;

7.

Number of final accounts by customer group, separately according to energy bills and accounts (network and energy);

8.

Number of final accounts sent out later than six weeks after the end of the contract, broken down by customer groups according to energy bills and accounts (network and energy);

9.

Number of non-performance customers (end users), where the same supplier has a product change on customer request.

Notifiable data formats

§ 20. (1) Reporting companies within the meaning of this Regulation are all balance sheet group coordinators, market area managers, distribution area managers, exchanges, virtual trading point operators, network operators, storage companies, feed-in (excluding Feed-in of biogenic gases) and supply.

(2) The holder or the body responsible for the external representation of a reporting company shall be subject to information.

(3) The data forming the subject-matter of the reporting obligation shall be transmitted electronically to the E-Control using the formats specified by the E-Control.

Reporting

§ 21. (1) The data in accordance with § § 3 to 14 shall be submitted by the party responsible for the information at the latest by the time of the 20. The calendar day of the month following the reporting period or the survey date to be transmitted to the E-Control.

(2) The data in accordance with § § 15 to 19 shall be transmitted to the E-Control at the latest by 15 February of the year following the reporting period. Excluded from this are the data according to § 15 Z 4 and 5 and § 18 Z 7 and 8. These shall be transmitted to the E-Control until 31 March of the year following the reporting period at the latest.

(3) The data in accordance with § 3 Z 4 and 5 and § 5 shall be transmitted immediately to the E-Control after the second clearing has been completed.

Transitional and final provisions

§ 22. (1) This Regulation shall enter into force on 1 March 2013.

(2) For those values which are collected for the period of one year (monthly values/annual survey, annual values/annual survey), the notification obligation for the year 2013 shall be the period from the date of presentation of the Regulation until 31 December. major.

(3) The date-related information according to § 18 Z 1, 3 and 4 shall be reported by the distribution system operators and in accordance with § 19 Z 1 shall be reported by the suppliers for the calendar year 2013 in addition to the cut-off date of 1 March 2013. This notification shall be made by 15 April 2013 at the latest.
