119. Regulation of the Federal Minister for Economic Affairs, Family and Youth on the management and organisation of the Metrology Council

Due to § 5 (5) of the Code of Measures and Verification Act (MEG) BGBl. No. 152/1950, in the version of the Federal Law BGBl. I No 28/2012 shall be assigned:

Establishment of the Metrology Council

§ 1. In the Federal Ministry for Economic Affairs, Family and Youth, a metrology board (hereinafter referred to as the Advisory Board) is used.

Tasks of the Advisory Council

§ 2. The tasks of the Advisory Board are determined by Section 5 (2) of the MEG.

Members of the Advisory Council

§ 3. The composition of the Advisory Board is determined by Section 5 (3) of the MEG.

§ 4. (1) The nomination period of the nominated members of the Advisory Board shall be 5 years. Re-nominations shall be admissible.

(2) A substitute member shall be ordered for each member of the Advisory Board. The substitute member shall represent the full member in the event of his/her prevention.

(3) The Chairman of the Advisory Board or the Chairman of the Advisory Board may, if this is deemed necessary by the Council, also be subject to the meetings of the Advisory Board of experts or experts who are not regular members of the Advisory Board, - The Presidency has to comply with the request of more than one third of the members of the Advisory Board after the recovery of such experts or experts. These experts or experts do not have the right to vote in the voting.

§ 5. (1) The Chairman of the Advisory Board shall be chaired by the staff member of the Federal Ministry for Economic Affairs, Family and Youth, who is also a member of the Metrology Council.

(2) The members and substitute members of the Advisory Board shall be convened by the Federal Minister for Economic Affairs, Family and Youth in the event of a waiver or revocation of the proposal by the member or substitute members.

(3) Where a member or a substitute member has failed to comply with three successive invitations to a meeting of the Advisory Board, the Advisory Council shall, after consulting the parties concerned, determine this. The nomination authority shall be informed of this, so that a new member or a substitute member can be made known.

Convening of sittings

§ 6. (1) The Chairperson shall convene the Advisory Board at meetings. The convening shall be made as necessary, with the Advisory Council meeting at least once a year. A convening of the Advisory Board shall also be made if at least one third of the members of the Advisory Board are required to do so for the same reason. The request to convene the Advisory Board shall be to designate and execute the items on the agenda to be considered.

(2) Meetings of the Advisory Forum shall not be public.

(3) The invitation to the meeting shall be sent no later than three weeks before the meeting date, indicating the agenda. Applications to supplement the agenda and request for the use of specialist experts or experts are from the members of the advisory board at the latest one week before the date of the appointment at the Federal Ministry for Economic Affairs, Family Affairs and youth.

Management and conduct of meetings

§ 7. (1) The Chairman or Chairperson shall open and direct the meeting. The final agenda shall be established at the beginning of the sitting.

2. The Advisory Council may decide that its deliberations and the documents on which it is based, as well as the parts thereof, should be kept confidential.

(3) A protocol should be drawn up on the outcome of the deliberations of the Advisory Council. It should be noted that there are any divergent views that differ from the prevailing opinion.

(4) The Advisory Council shall meet in plenary. The Advisory Forum may set up working parties for the preliminary consultation of agenda items.

(5) The presence of at least half of the members according to § 5 para. 3 MEG is required for the decision-making capacity of the Advisory Board. If the members have been duly invited, the Advisory Council shall also be eligible for a quorum if less than half of the members invited are present after 30 minutes from the start of the meeting. The Advisory Council shall endeavour to reach the greatest possible consensus in the decision-making process. It shall take its decisions with the majority of the members present. Abstentions are to be documented in the Minutes.

(6) In the event of a tie, the vote shall be taken by the Chairman or Chairperson.

(7) Meetings shall be held in the Federal Ministry of Economic Affairs, the Family and Youth, unless otherwise provided by the Presidency.

Rules of

§ 8. Detailed rules governing the conduct of business shall be in accordance with the Rules of Procedure. It requires the approval of the Federal Minister for Economic Affairs, Family and Youth.

Office

§ 9. (1) The Federal Ministry for Economic Affairs, Family and Youth supports the Advisory Board and the Chairperson in the performance of the tasks as a business office.

(2) It shall be the responsibility of the office, in particular:

1.

the ongoing operations of the Advisory Board;

2.

to respect the rules of procedure, together with the chairman or the chairman;

3.

prepare the meetings of the Advisory Council;

4.

create and ensure the storage of the protocols;

5.

the decisions to be taken;

6.

to obtain the necessary information;

7.

document the working documents;

8.

to administer the travel expenses and expenses.

§ 10. (1) The activities of the members and substitute members of the Advisory Board shall be a volunteer. You do not deserve a cost replacement.

(2) In accordance with § 4 (3) expert experts or expert experts are due to travel the replacement of the actual adult costs for the travel movement as well as for necessary overnight stays. The necessity of the trip is to be made credible by the technical experts or expert experts to the Chair of the Metrology Council, to be examined by this and to note in the minutes of the meeting.

(3) The cost of the travel movement of experts or specialist experts is limited to the mileage-dependent costs of the 2nd class rail journey. It is only for the use of urban mass transport funds that additional costs are to be paid.

(4) The amount of expenses for the necessary overnight stays by experts or experts is limited to 105 euros per day and night.

(5) For the participation of specialist experts or experts, a meeting fee of EUR 50 per hour is due for each of the hours.

§ 11. This Regulation shall enter into force 1. Jänner 2014 in force.
