132.Verordnung of the Federal Ministry of economy, family and youth, with the mining waste regulation is amended

On the basis of §§ 109 para 3, 114 para 2, 119a, 119b, and 181 of the mineral raw material act - MinroG, Federal Law Gazette I No 38/1999, I will be amended by the Federal Act, Federal Law Gazette No. 144/2011, insofar as to regulations on the protection of the environment, in consultation with the Federal Minister of agriculture and forestry, environment and water management:

Ordinance of the Federal Minister for economy, family and youth, with the provisions on the management of mining waste (mining waste regulation) issued, Federal Law Gazette II No. 130/2010, is amended as follows:

1 in § 1 para 2 the expression is omitted in the Z 3 "and" and the point is replaced in the Z 4 with a comma and the word "and" attached. Following Z 5 is added:

"5. the decision 2009/335/EC on technical guidelines for the establishment of the financial guarantee in accordance with Directive 2006/21/EC, OJ "No. L 101 of April 21, 2009 S. 25."

2. in article 2 par. 3, the introductory phrase is:

"(3) § 5 ABS. 3 penultimate sentence and paragraph 4 shall not apply."

3. in article 4, the expression "the surface affected by the waste disposal plant" is replaced by the expression "of the area polluted by the waste disposal plant" Z 3.

4. in article 4, the expression "in A category" eliminates Z 8.

5. 5 paragraph 3 the following sentence is added to §:

"A change in the person of the mining during the operational phase the current information and records has been shown at the new mining authorized are to pass on."

6 5 para 4, the following sentence is added at §:

"Also is to provide for the technical development and the training of staff employed in the operation of waste management facilities."

7 § 5 the following paragraph 5 is added:

"(5) a substantial change of a waste disposal facility (section 119a para 8 Z 1 MinroG) occurs when the change may have significant negative effects on human health or the environment."

8 paragraph 6 subsection 2:

"(2) section 1 does not apply to tailings ponds set aside until May 1, 2008."
