78th Federal Act amending the Higher Education Act 2005 (Administrative Jurisdiction-Adaptation Act-Federal Ministry of Education, Arts and Culture, Department of Teacher Education Universities)

The National Council has decided:

The Higher Education Act 2005 (HG), BGBl. I n ° 30/2006, as last amended by the Federal Law BGBl. I No 73/2011, shall be amended as follows:

1. In the table of contents, the line relating to § 26 is deleted.

2. § 17 (3) Z 2 reads:

" 2.		Opinion on Appeal decisions pursuant to Section 14 of the Administrative Court Procedure Law-VwGVG, BGBl. I No 33/2013 in the case of complaints in matters of study which, in the case of submission to the Administrative Court of the complaint, is to be attached to the complaint, "

3. § 25 receives the sales designation "(1)" and the following paragraph 2 is added:

" (2) Complaints in study matters shall be submitted to the institution which has issued the communication. If the complaint is not inadmissible or delayed, the latter shall submit the appeal with the entire act immediately to the Study Commission, which may give an opinion on the complaint. In the event of such an opinion, the decision of appeal shall be made in accordance with the opinion of that opinion. If the complaint is submitted to the Administrative Court, the opinion of the Study Commission shall be connected. "

Section 26, together with the title, shall be deleted.

5. In § 44 (1) the word order shall be "no appeal" through the phrase "no legal remedy" replaced.

6. § 71 (6) deleted.

7. The following paragraph 7 is added to § 80:

" (7) The following provisions of this Federal Act in the version of the Federal Law BGBl. I No 78/2013 shall be as follows: except for power:

1.		§ 17 para. 3 Z 2, § 25 as well as § 44 para. 1 shall occur on the 1. Jänner 2014 in force.
2.		The line of the table of contents, § 26, and the title, as well as § 71 (6), shall be repeal on 31 December 2013. "
