172. Regulation of the Federal Minister for Economic Affairs, Family and Youth, amending the Regulation on the supervision of liquefied petroleum gas conversion vessels

Due to § § 10 sec. 1 Z 3 and § 19 of the Kesselgesetz, BGBl. No 211/1992, as last amended by BGBl. No 28/2012, and in application of Article 2 (3) to (7) of Regulation (EC) No 765/2008 laying down rules for the accreditation and market surveillance relating to the marketing of products and repealing Regulation (EEC) No 339/93 , OJ L 327, No. OJ L 218, 13.8.2008 p. 30.

The Regulation on the monitoring of liquid gas conversion containers, BGBl. II No 136/2012, shall be amended as follows:

1. § 3 (3) reads:

" (3) Liquid gas rebuilding containers according to § 1 (2), which are in operation at the time of entry into force of this Regulation and in which no assessment of the qualitative execution of the Ronden-Welding is available, may be up to 15 years, calculated by the At the end of the year in which their conversion was carried out, the following measures shall be applied:

The filling with liquid phase may only be carried out if the filling level of the container to be filled is at least 5% of the filling volume; with a smaller filling level, the filling with gas phase is to be carried out in accordance with the gas-pendulating method.

2.

The gas-tightness of the liquid-gas rebuilding containers shall be checked by means of gas sensing or equivalent methods. The review shall be carried out at least twice a year in liquid-gas conversion containers, which shall be filled more than five times a year in the sliding average over a period of three years. The gas-tightness test shall be carried out at least once a year on liquefied petroleum gas conversion containers with a lower annual frequency of filling.

In order to check the gas-tightness by means of gas-sensing tests, the liquefied gas containers are to be inspected by 30 June 2013 with gas-sensing probes, the design and arrangement of the gas-sealing containers, and the type and execution of the respective gas-sealing units. The container must be determined.

The gas detection test or equivalent method shall be carried out,

a)

of the personnel of the liquid gas supply undertaking responsible for the filling or assembly of the liquefied gas installations, which has been verifiably culled for this purpose by a boiler test site

or

b)

from a boiler test site.

In the context of the periodic external investigation (Section 15 (3) of the boiler law) of the liquefied petroleum gas container, the boiler test site, which is carried out, is independent of the tank test site according to Z 4 lit. a test carried out in order to check the gas tightness at any rate to carry out a gas-sensing test or to carry out an assessment in accordance with equivalent methods.

Methods which are reproducible as equivalent to the gas-sensing test and which have proven to have at least the same accuracy and reliability of the determination of the gas-tightness measurement are valid. The detection has to contain leakage measurements on an earth-laid liquid gas container equipped with leaks, as well as requirements for the test personnel and the equipment equipment. Evidence shall be provided by means of an expert opinion in relation to the boiler inspection body responsible for the monitoring.

If, on the basis of the gas detection test or equivalent methods, there is a suspicion of leak tightness of the container, the boiler test site must be notified immediately and the container may be removed, if necessary. The boiler inspection bodies have to inform the Federal Minister for Economic Affairs, Family and Youth about any intitities that have been identified or reported.

If liquefied petroleum gases already in operation are brought to another site or if such containers have not been in operation for more than one year, the boiler law shall be carried out prior to resumption of the operation in accordance with Section 15 (5) of the Kesselgesetz (Kesselgesetz). To supplement the audit with an assessment of the qualitative execution of the Rondeneinwelded in accordance with paragraph 1. "

2. In § 4 (3) the expression "Z 1" by "Z 3" replaced.

3. § 4 (4) reads:

" (4) The results of the gas sensing tests or equivalent methods according to § 3 (3) (4) and (5) shall be documented and shall be connected to the test book by the boiler inspection body. In the case of the examination pursuant to § 3 paragraph 3 Z 4 lit. a are the test results documented by the personnel responsible for the filling or assembly of the liquefied gas plant before they are connected to the test book by the boiler test site and confirm the plausibility of the test results. "

4. § 5 Z 2 and 3 are:

" 2.

the equipment of the containers with gas-sensing probes (§ 3 (3) (3) (3)) and

3.

the performance of the gas-detection test or equivalent methods (§ 3 para. 3 Z 4 lit. b and Z 5) "

5. § 6 Z 1 and 2 are:

" 1.

the carrying out of the gas-sensing test or equivalent methods (§ 3 para. 3 Z 4 lit. a) and

2.

the performance of the filling (§ 3 (3) (1) (1)) "
