Statement by the Federal Chancellor concerning the amendment of the Declaration of the Republic of Austria pursuant to Article 24 (1) of the Convention, drawn up by the Council in accordance with Article 34 of the Treaty on European Union, on mutual assistance in criminal matters between the Member States of the European Union

The Austrian Declaration 1 pursuant to Article 24 (1) of the Convention, signed in Brussels on 29 May 2000, drawn up by the Council in accordance with Article 34 of the Treaty on European Union, on mutual assistance in criminal matters between the Member States of the European Union changed as follows:

On Article 24 (1) of the Convention:

Austria declares, in accordance with Article 24 (1), that the authorities already designated in the Declaration on Article 24 of the European Convention of 20 April 1959 on Mutual Assistance in Criminal Matters, for the application of the Convention , and appoints as

the competent administrative authorities referred to in Article 3 (1): the local administrative authority (district authority or body of a city with its own statute), in matters relating to the factual scope of action of the National police directorates in the territory of a municipality, for which the State Police Directorate is at the same time the security authority of the first instance, but the State Police Directorate;

the central authority responsible for the purposes of Article 6 (2) and (8): the Federal Ministry of Justice;

competent authorities within the meaning of Article 6 (5):

-

in the case of a request referred to in Article 12, the public prosecutor's office where the border is likely to be exceeded or where the controlled delivery is to be carried out by the sprint;

-

for the request referred to in Article 13: the local public prosecutor ' s office;

-

in the case of a request under Article 14, the Public Prosecutor's Office, where the application is expected to commend;

the competent administrative authorities referred to in Article 6 (6): the local administrative authority (district authority or body of a city with its own statute), in matters relating to the factual scope of action of the National police directorates in the territory of a municipality, for which the State Police Directorate is at the same time the security authority of the first instance, but the State Police Directorate;

within the meaning of Articles 18 and 19 and Article 20 (1), (2), (3) and (5): the local public prosecutor ' s office;

within the meaning of Article 20 (2), for the information competent authority:

SIRENE Austria.

The amended Austrian Declaration was notified to the Secretary-General of the Council of the European Union on 29 April 2013; the reception was confirmed by the Secretary-General on 12 June 2013.
