167. Proclamation of the Federal Chancellor concerning the change in the Declaration of the Republic of Austria created paragraph 1 of the Convention - in accordance with article 34 of the Treaty on European Union by the Council pursuant to article 24 - on mutual legal assistance in criminal matters between the Member States of the European Union

The Austrian Erklärung1 according to article 24 para. 1 of the Convention signed on 29 May 2000 in Brussels - in accordance with article 34 of the Treaty on the European Union by the Council created - on mutual legal assistance in criminal matters between the Member States of the European Union is amended as follows:

 

To article 24 paragraph 1 of the Convention:

Austria declared pursuant to article 24 paragraph 1, that already in the Declaration concerning article 24 of the European Convention of 20 April 1959 on mutual assistance in criminal matters are responsible designated authorities for the application of the Convention, and shall designate as

 



• within the meaning of article 3 paragraph 1 competent administrative authorities: the local competent district administrative authority (Bezirkshauptmannschaft or organ of a city with its own statute), in matters pertaining to substantive area of effect of the national police headquarters in the territory of a municipality, for which the National Police Directorate is also a security authority of first instance, but the National Police Directorate;

• within the meaning of article 6 paragraph 2 and 8 central authority: the Federal Ministry of Justice;

• within the meaning of article 6 paragraph 5 competent authorities: - for requests for article 12: the public prosecutor in whose area the border is expected to be exceeded, or from whose jurisdiction the controlled delivery; go out

-for requests for article 13: the locally competent public prosecutor's Office;

-for requests for article 14: the public prosecutor's Office, is expected to begin in whose area the use;

• within the meaning of article 6 paragraph 6 competent authorities: the local competent district administrative authority (Bezirkshauptmannschaft or organ of a city with its own statute), in matters pertaining to substantive area of effect of the national police headquarters in the territory of a municipality, for which the National Police Directorate is also a security authority of first instance, but the National Police Directorate;

• in the sense of article 18 and 19 and article 20, paragraphs 1, 2, 3 and 5 competent authority: the locally competent public prosecutor's Office;

• within the meaning of article 20 paragraph 2 for informing competent authority: SIRENE Austria.

 

The modified Austrian Declaration was the Secretary General of the Council of the European Union on 29 April 2013 notified; the reception has been confirmed by the Secretary General on 12 June 2013.
