General terms and conditions

1 section

General information

Sport-political order

A social concern is to enable § 1 exercise and sports for the whole Austrian population. The efforts aims to encourage 100% of the population and especially children and young people to exercise and sports. This concern requires a common effort of and other social sectors such as mainly of education and health services. According to the social importance of sport in Austria sports funding by the Federal Government intended following sports policy general objectives: 1. the contribution to the achievement of public interest to the performance and elite sports, as well as at the grassroots to the promotion of the common good;

2. the planned development of international sport achievements, taking into account the fight against doping;

3. the long-term pre-accession of sportsmen and sportswomen to the provision of sport-specific international excellence;

4. run up more people to movement and sports and their binding it;

5. the development of the performance and competitive sport as a basis for the elite level and below the elite;

6. the social integration of people with a migrant background;

7 as far as possible inclusion of people with disabilities;

8. the assurance of the Club and Association network in sports.

Targeted, scope and autonomy of sport

§ 2 (1) to fulfil the sport-political mission objectives of federal sport funding are in accordance with § 1 in particular 1 the structure and the development of professional association structures in sport, 2. the establishment of a complex training and competition control of youth level up to the elite level, 3. that strengthening of sports science and medicine, as well as the fight against doping, 4. the usage and the training of highly qualified trainers and coaches, in the preliminary stage instructors and instructors as well as exercise instructors and speakers , 5. the development and support of the performance and top-class sports, 6 the promotion and support of club sports, 7 strengthening sports infrastructure, 8 strengthening the dimension of 'Health through sport movement' and 9 the provision of sport-specific for sport or Club-distant people.

(2) the objectives referred to in paragraph 1 include as well the sport exercise with people with body, mental or sensory disability.

(3) the responsibilities of the countries are not affected by this federal law.

(4) that support the fulfilment of the sport-political mission and the goals of the Federal Sports funding, also by the European Union recognized, specificity of sport in full respect of the autonomy of sports federations and organizations. Including in particular the right to self-determination of their organization, their own decision-making and management and the right to emergence and existence of falls.

Definitions

§ 3. Mean in the sense of this federal law: 1. selection criteria: criteria; used for the selection of measures and projects to promote

2. grassroots: Sport, which is exerted mainly in the Leisure and not to achieve national or international excellence, but from joy of exercise, physical fitness or health aspects;

3. Gesamtösterreichische organizations with special task in sport: a) sport organization that represents the concerns of the entire Austrian sports (Austrian Federal Sports Organization - BSO);

b) sports organisation representing the Olympic movement in Austria (Austrian Olympic Committee - ÖOC);

(c) Sport organisation representing the Paralympic Movement in Austria (Austrian Paralympic Committee (ÖPC);

(d) sport organization that represents the interests of people with disabilities in sport (Austrian disabled Sports Federation - ÖBSV);

(e) sports organisation representing the Special Olympics movement in Austria (Special Olympics Austria - SOÖ);

4. Gesamtösterreichische (Championship) competition event: event (Championship), in which a federal - Federation as organizer occurs or appoints the technical officials for the event;

5. basic support: support for the specific tasks to maintain administrative and sporting operations by sports organizations by providing money donations;

6 International (International Championship) event: event, which takes place in the framework of the IOC or IPC or of the European Olympic committees (EOC) or an organization of the international organization of sport for disabled (IOSD) or an International Federation or named the technical officials for the event of these;

7 performance sports/sports: Wettkampforientierter sport with the aim to produce national or international excellence;

8. measures and project funding: Support of clearly delineated, repeated measures or a time-limited project in the field of sports promotion;

9 total Austrian meaning projects: projects that go beyond the area of interest of a country or several countries on its own;

10 member clubs: clubs, which belong to a sport organization of total Austrian importance;

11 sportswoman/athletes:


Athlete/sports / sport operates with the explicit aim to achieve excellence in the international scale;

12 sports organizations of total Austrian meaning in the grassroots: a) General Sports Association (governing body): sports organisation, - at least 3 000 member associations in Austria, - which at least 75% of the sports who represented by Federation - Federation and - which is represented in at least seven countries through a regional association;

b) Gesamtösterreichischer Association of Alpine clubs: sports organization, – belong to at least 75% of the clubs in Austria, where mountaineering is exercised, and - which are at least 400 000 active contribution-paying members;

13 sports organization of total Austrian importance in competitive sport (Federal - sport Association): a) sports organisation, the Member and sole representative of in Austria in the relevant international sports federations is the Member of ASOIF (Association of summer Olympic international federations) and the AIOWF (Association of International Olympic Winter sports federations) is, and thus in the program of the Olympic Games or b) sports organization that meets the following criteria: aa) which are at least 75% of sport clubs active compete in any sport in Austria and sportspeople/athletes , bb) is a member and sole representative of in Austria in the relevant international sports federations that belongs to the SportAccord or comparable international organization, cc) of at least 30 clubs belong to, where at least 900 clearly captured members of the represented sports, dd) is represented in at least six provinces by a regional association, ee) the Austrian championships organized and carried out, ff) that regularly sends participants to world or European Championships and whose qualification apply , gg) that represents any kind of sport, representing a combination of sports, which is already covered by one or more eligible sport organizations as well as hh) own, sports dominant, motor activity of anyone who operates, the goal has. 14 sports facility: facility, which serves exclusively or predominantly of conscious physical activity, as well as the activity in the athletic competition (E.g. Types of promotion and distribution of federal funds

Allocation of federal funds and dual support system

Basics of promotion

Performance-based promotion award

Section 6 (1) for the specific promotion of performance and top-class sports is to create a sequence of Federation - Federation by the Federal Sports Promotion Fund on the basis of the assessment of the performance of.

3. the weighting of the criteria to each other;

4. the survey of the criteria by a standardized assessment form.

(4) for the assessment of the criteria referred to in paragraph 2, the respective Federation - Federation has Nos. 1 and 2 to present a "structural and strategic concept".

(5) the sequence is the assessment of funding requests by the Federal Sports Promotion Fund, and in particular as a supplementary criterion of measures and project funding.

2. section

Basic funding

Contents and areas of promoting basic

In total at least 50% of the funds pursuant to § 5 para 2 are § 7 (1) for the basic funding of the performance and top-class Sports Federation - sport Association to provide Z 1.

(2) the basic funding is set by the Federal Sports Promotion Fund, taking into account the specific requirements of the respective Federation - Federation and is governed by the principles of action orientation. (5) for the annual promotion of basic performance and top-class sports activities of representative Football Federation - Federation, at least 12.5% of the funds pursuant to § 5 para 2 are no. 1.

Measures and project funding

Content and areas of action and project funding

§ 8 (1) in the field of performance and elite Z can be funded from funds remaining after the deduction of basic funding pursuant to § 7 pursuant to § 5 para 2 1 actions and projects of the Federation - Federation, which serve the objectives set out in article 2. (3) the Federal Sports Promotion Fund has to create a promotion program each year for the following calendar year and to announce in an appropriate manner. The program contains at least the following parameters: 1. definition of the circle of entitled on promotion;

2. determination of support areas (emphasis) pursuant to paragraph 2;

3. promotion period (start and end);

4. any promotion amount limits of the individual funding areas;

7 specific application components of the individual funding areas;

8. information about the current guidelines for the granting and settlement of funds.

(4) the Federal Sports Promotion Fund has been known in addition legislative objectives, specifying the target achievement indicators to give.

(5) the request for action and funding is to provide the Federal Sports Promotion Fund. He shall at least contain: 1 content and organizational representation of individual measures and projects (promotion positions) as well as their goals within the areas of the promotion;

4. the resulting from the representations referred to in no. 1 to 3 amount of support requested.

(6) for grants in the field of disabled sports, Z 3 are lit for the organisations referred to in article 3. c to provide to e 2.5% of funds pursuant to § 5 para 2 subpara 1. From these funds, no. 3 is lit for the organisation in accordance with article 3. d to provide 1% of the funds pursuant to § 5 para 2 subpara 1 as advanced basic funding.

(3) on the information referred to in paragraph 2, use evidence with regard to the measures and funding has to contain a representation of the effect achieved with the means of promotion, specifying appropriate indicators pursuant to § 8 para 4.

(4) the use of funds from promoting dedication is to prove to the Federal Sports Promotion Fund and to confirm (base control) through this.

3. services referred to in paragraph 4;

4. expenses in accordance with paragraph 5.

(2) the resources referred to in paragraph 1 are set by the Federal Sports Promotion Fund for a period of four years. You fees the federations each equally.

(3) the associations have a concept for the fulfilment of the requirements resulting from par. 4 to 10 to submit.

(4) the umbrella organisations have to provide at least the following services according to para 1 No. 3 of the basic funding for the member associations and their members: 1. education and training;

2. support national competition operation by contributions in kind and/or provision of the necessary infrastructure;

3. consulting services in Club-specific legal issues relating to the financing of sports facility construction and conservation, trade, liability and insurance issues in connection with sports events and sports operation;

4. other assistance, as for measures of public relations and the infrastructure necessary for the operation of the Club.

(5) the associations have at least 40% of the basic funding for the following expenses according to para 1 Z 4 to the member clubs to pass on (Federal Association grant): 1. use of trained educator/trainer (practice managers/trainers, instructors/instructor);

2. implementation of training measures;

3. participation in and implementation of competitions;

4. establishment, maintenance, hire and maintenance of sports facilities with particular attention to accessibility;

5. purchase and maintenance of sports equipment.

(6) the federations have to create internal policies for passing the Federal Association grant to their member clubs. These guidelines are to bring the Federal Sports Promotion Fund.

2. implementation of training measures;

3. participation in and implementation of competitions;

4. establishment, maintenance, hire and maintenance of sports facilities;

5. purchase and maintenance of sports equipment.

5. measures for more movement in the kindergarten and primary school age;

6 structural improvement programmes and innovation activities;

7 co-financing projects with promotion of donors in the health sector;

8. measures within the framework of the coordination of the nationwide network for promoting movement (section 26 No. 1 lit. d).

Meetings and decisions of the Federal Sports Conference

Board of Trustees

Also an individual Member may request Board of Trustees, a report, but only on the organ. Reporting rejects the Federal Sports Conference or conducting business, so the report may be required only when a total of three Board members support the request. The Chairperson of the Board of Trustees may require a report without support from another Member.

(4) the Board of Trustees can the books and writings of the Federal Sports Promotion Fund, as well as the assets, the Fund Office and the holdings of securities, are that check, and check. The Board of Trustees may delegate individual members or for specific tasks, special expert thus.

(5) the Board of Trustees in particular the following tasks 1 are in addition the discharge of the Federal Sports Conference, 2. the approval of the annual budget of the Federal Sports Promotion Fund on the proposal of the Federal Sports Conference and reporting to the Federal Minister / the Minister of national defence and sports, 3. the approval of the report of the carried out basic checks and delivery to the Minister / the Minister of national defence and sports, 4. the review and approval of the annual accounts and the annual report of the Federal Sports Promotion Fund , 5. the receipt of reports on the economic management and the internal budget control of the Federal Sports Promotion Fund, 6 approval of the establishment plan of the Federal Sports Agency after submission by the Federal Sports Conference and of transactions, which have an ongoing or multi-year financial burden the Federal Sports Promotion Fund to the subject, as well as 7 resolutions concerning the submission to the Minister the Minister of national defence and sports on approval of the rules of procedure of the Board of Trustees.

(6) for the inspection of the activities of the Fund in accordance with the financial regulation, the Board of Trustees in accordance with the provisions of the Federal procurement law to order 2006 two auditors, of which to propose is by the Federal Sports Conference has.

(2) the members must have special knowledge about the popular sport in Austria.

(3) the Management Board has to deal with the promotion Advisory Board for the area of grassroots sport 1 prior to granting of subsidies in the field of grassroots sport and 2nd in the evaluation of funded projects in the field of grassroots sport to submit of a recommendation.

(4) the promotion Advisory Board for the area of grassroots sport has made recommendations for the granting of funding from and relating to the evaluation of projects to justify in writing that the Federal Sports Conference only for important reasons, which are to be documented, may differ from.

(5) Presidency, ordering of the members, Beschlussmodalitäten and Protocol management are to govern in a rules of procedure to be decided unanimously by the members of the Promotion Board. Membership in the promotion Advisory Board for the area of grassroots sport is an unbesoldetes voluntary work.

Promotion Advisory Board for the area of performance and top-class sports

42. (1) the promotion Advisory Board for the area of performance and top-class sports consists of six members, as follows ordered are 1 three members by the Federal Minister / the Federal Minister of national defence and sports and 2 three members by the Federal Sports Conference.

(2) the members have special expertise on the national and international performance and elite sports.

(3) the Management Board has the promotion Advisory Board for the area of performance and elite 1 prior to granting of subsidies in the field of performance and top-class sports and


2. in the evaluation of funded projects in the field of performance and top-class sports to submit of a recommendation to deal.

(4) the promotion Advisory Board for the area of performance and top-class sports has made recommendations for the granting of funding from and relating to the evaluation of projects to justify in writing that the Federal Sports Conference only for important reasons, which are to be documented, may differ from.

(5) Presidency, ordering of the members, Beschlussmodalitäten and Protocol management are to govern in a rules of procedure to be decided unanimously by the members of the Promotion Board. The promotion Advisory Board for the area of performance and elite membership is an unbesoldetes voluntary work.

Business leadership

The ongoing operations of the Federal Sports Promotion Fund are section 43 (1) full-time CEO / the Executive Director to do. / He is the Chief of all full-time employees of the Federal Sports Promotion Fund and is responsible the Federal Sports Conference. 2. the preparation of the support programmes of the Federal sports promotion funds pursuant to §§ 8 par. 3, 15 para of 4 and 18 para 3;

3. the preparation of the funding of the Federal Sports Promotion Fund including the implementation of the Association talks according to § 30 para 2 subpara 1 and their operations;

4. preparation of the adoption of the applications referred to in §§ 8 par. 5, 15 para of 4 and 18 para 3;

5. the evaluation of promotion programmes and funding;

6. the implementation of basic control;

7. the assessment of the Fund's assets in accordance with the Austrian Federal financing agency;

8. the creation of a report carried out basic checks and submission to the Board of Trustees.

(5) the Management Board has the promotion being the Federal Sports Conference at the request of at least three members in all give evidence concerned questions

Funding database

Setting up, content and public

Section 44 (1) to increase transparency in the area of federal sport funding and information of the population has to set up a promotion database of the subsidies granted under this federal law Federal Minister / the Federal Minister for defence and sports.

(2) the database shall contain 1. identification of the promotion's, 2. amount of funding, 3. promotion purpose and short description of the development project 4th calendar year of promoting.

Final provisions

Implementation of this federal law

45. (1) the provisions of this Federal Act do not apply supplier for the promotion of sports activities of federal employees, as well as by members of the presence, militia - and reserve status or education service by the after of the resort membership relevant federal/Federal Minister.

Preparatory actions

section 48. The Federal Minister the Minister of national defence and sports is empowered to take all necessary measures to ensure that the Federal Sports Promotion Fund as of 1 January 2014 can properly record its activity after announcement of this Federal Act. In addition, the organs of the Federal Sports Promotion Fund can be ordered before 1st January 2014 and preparatory decisions for the first funding cycles, which are subject to the provisions of this Federal Act.

Home and expiry

49. (1) this federal law 1 January 2014 into force.

(2) with the Federal Sports Promotion Act 2005 (BSFG) is the entry into force of this Federal Act, Federal Law Gazette I is no. 143, override where the subsidies granted by 31 December 2013 continue to apply it.

Transitional provisions

§ 51.
