219. Regulation of the Federal Minister of Health, amending the poultry hygiene regulations in 2007

On the basis of § 2 (1) to (3) of the Animal Health Act (TGG), BGBl. I n ° 133/1999, as last amended by the Federal Law BGBl. I n ° 142/2003 and the Federal Law BGBl. I n ° 3/2009, will be in agreement with the Federal Minister for Finance and the Federal Minister for Agriculture, Forestry, the Environment and Water Management:

The Poultry Hygiene Regulations 2007, BGBl. II No 100/2007, as last amended by the BGBl Regulation. II No 355/2008, shall be amended as follows:

2. § 1 para. 3, first sentence reads:

" Provisions of the Food Safety and Consumer Protection Act (LMSVG), BGBl. I n ° 13/2006, the Animal Health Act (TSG), RGBl. No 177/1909, as well as the provisions of the Internal Market Regulation 2008 (BVO 2008), Federal Law Gazette (BGBl). II No 473/2008 and the Veterinary Import Regulation 2008 (VEVO 2008), BGBl. II No 474/2008, remain unaffected. '

3. The previous text of § 2 receives the sales designation "(1)" and the following paragraph 2 is added:

4. § 7 (1) reads:

" (1) Only water, which is the microbiological requirements of the Drinking Water Ordinance, BGBl, may be used in establishments according to § 1 (1). 5. § 9 (2) last sentence reads:

"Samples of the same kind (soil samples, feed nap samples, tear samples, etc.) may be combined into pools of five samples."

6. § 9 (5) reads:

" (5) Stallspaces and areas shall not be allowed until after the completion of cleaning and disinfection in accordance with paragraph 1 and-in the case of para. 2-after the existence of a control result confirming the success of the disinfection measures, but not at the earliest seven days. After the last herd has been left out, it has been refilled with poultry. This period shall be 14 days after measures within the meaning of § 27 or section 42 (6) (determination of a salmonella infection). "

7. In Section 9 (6), the phrase "Regulation (EC) No 1774/2002" through the phrase " Regulation (EC) No 1069/2009 of 21 May 2009. 8. § 15 para. 2 reads:

"(2) If animals are obtained from other States, they shall comply with the relevant provisions of the VEVO 2008 or BVO 2008 as appropriate."

10. In § 19 paragraph 1 Z 1 lit. a becomes the phrase "two weeks before entry into the legee phase" through the phrase "two weeks before the transition to the laying phase or the legee unit" replaced.

11. § 19 (1) Z 1 lit. b sublit. bb is:

" bb)

In the case of young animals aged four weeks and in the case of sampling two weeks before the transition to the laying phase or the laying unit, either five pairs of paired boots, each with 20% of the poultry area, shall be sampled, or Co-mixing samples taken from separate samples of fresh cots weighing at least one gram each; samples of feces shall be taken at different points of the room in which the animals are kept; has a sample of the samples taken from the sample. 12. § 19 (1) Z 2 reads:

" 2.

Adult Breeding poultry herds (Legephase)

a)

At least every two weeks shall be sampled and examined in all herds during the laying phase.

b)

In herds whose eggs are supplied to hatcheries with a breeding capacity of less than 1000 eggs per breeding pass, and in herds of farmed farms approved for trade within the European Union, the samples shall be taken in accordance with lit. a in the parent animal holding according to the under Z 1 lit. b sublit. bb and cc listed criteria. The sampling in the holding can also be carried out by a person who is verifiably trained by the care veterinarian or by the care veterinarian and by the district managing authority in relation to the named operating person. Every twelve weeks, the sampling shall be carried out by the care veterinarian or by the care veterinarian.

c)

In the case of herds whose eggs are supplied to a hatchery with a gross capacity of at least 1000 eggs per gross pass, the samples shall be in accordance with lit. a is taken in the hatchery. The samples shall include:

aa)

at least one mixed sample of visibly polluted hatching hatching (chicks), which can be taken as a random sample from five different places, until a total area of at least 1 m² is reached (should the hatching eggs be from a breeding heat in several incubators, such a mixed sample is to be taken from each of the incubators), or

bb)

if there are no hordendresses used, a sample of 25 grams taken from a mixture of 10 grams of egg shell residues to be extracted from 25 different hatchery hordes, to be crushed and mixed.

d)

13. § 19 (1) Z 3 reads:

" 3.

Investigation of Salmonella gallinarum pullorum (Legephase)

14. § 22 (1) reads:

15. § § § 24 to 27:

§ 24. a treatment according to § 27 Z 1 lit. b, or

in accordance with § 10 of the Animal Material Act, BGBl. I n ° 141/2003, to be destroyed.

(2) The measures referred to in paragraph 1 shall also apply to eggs of these herds already supplied to the brethren. To this end, the Brüterei shall be notified without delay by the farmer of the delivery company via a positive examination report.

Handling of herds in case of positive findings

§ 25. (1) In the case of herds in which the samples according to § § 19 to 21 in the hatchery have a positive result with regard to the presence of Salmonella enteritidis, Salmonella typhimurium, Salmonella gallinarum pullorum, Salmonella infantis, Salmonella virchow and Salmonella hadar, the following shall be taken as follows:

1.

After the notification in accordance with Article 23 (2), the district administrative authority shall, in order to confirm the initial results, immediately subject the stock to an official sampling.

2.

In the case of an official sampling according to Z 1, five pairs of paired boots and two dust samples of 100 g each, each of which are taken at a number of points representative of the stables, shall be drawn in each herd. If no boot samples can be taken on the basis of the superstition system, five samples of 200 to 300 g of faeces in each case in natural mixture of feces, bandscratches or from deep pits can be taken instead. The samples must not be pooled and should be examined for Salmonella in accordance with Z 1. A test for the detection of antimicrobial agents or of an effect of the samples which inhibits the growth of bacteria is to be carried out.

3.

The herd is considered to be positive if a positive result has been found on the salmonella to be studied. The flock is also considered to be positive as long as antimicrobial agents or bacterial growth inhibitory effects are detected. The test should then be repeated until no effect of inhibiting the growth of bacteria is found or the Zuchtherde is destroyed.

4.

The district administration authority may require a reasonable larger sample number if necessary.

5.

In cases of suspiciations in which the district administrative authority has reason to accept false negative results of the first official test, a second official test according to Z 2 may be carried out.

(2) In the case of herds in which the samples according to § § 19 to 21 in the stock (in the stable) have a positive result with regard to the presence of Salmonella enteritidis, Salmonella typhimurium, Salmonella gallinarum pullorum, Salmonella infantis, Salmonella The herd is considered to be positive. If the district administrative authority finds no reasons for the assumption of false positive results, it has the presence of Salmonella enteritidis, Salmonella typhimurium, Salmonella gallinarum pullorum, Salmonella infantis, Salmonella virchow and Salmonella hadar to be officially confirmed. In cases where the district administrative authority has reason to accept false positive results of the probation of the stock, it is necessary to proceed in accordance with paragraph 1 (1) (1) to (5).

(3) In the case of herds in which the samples have shown a positive result in respect of other salmonella in accordance with § § 19 to 21, the herd concerned shall be subject to § 26 in respect of the determination of the source of contamination.

Further investigation

§ 26. In case of suspicion or if it is necessary to determine the source of contamination, the official veterinarian shall:

1.

Carry out investigations into salmonella, including feed, water, litter, dust and operating personnel,

2.

to check whether the rules and controls on the disposal and processing of animal waste have been complied with,

3.

control measures to ensure salmonella-free fodder in accordance with Article 7 (2); and

4.

shall carry out any further appropriate investigation or have it carried out.

Procedure in operation upon confirmation of a salmonella suspicion

§ 27. (1) The occurrence of Salmonella enteritidis, Salmonella typhimurium, Salmonella gallinarum pullorum, Salmonella infantis, Salmonella virchow, Salmonella hadar or Salmonella arizonae in an operating building, or in the case of a review pursuant to § 25, shall be carried out in the case of a review pursuant to § 25. of the corresponding run-out area shall be subject to the following provisions:

1.

The animals may only be brought out of the relevant building with the consent of the district administration authority and only for the following purposes:

a)

Destruction and destruction in accordance with the relevant provisions relating to the use of animal body or

b)

Slaughtering of the clinically healthy poultry in a slaughterhouse designated by the district administrative authority under official supervision in accordance with § 13 of the meat examination ordinance, BGBl. II No 109/2006; the official veterinarian or authorised veterinarian responsible for the slaughterhouse in accordance with the Food Safety and Consumer Protection Act (LMSVG), BGBl. I n ° 13/2005, as last amended by the Federal Law BGBl. I No 135/2006, must be informed of this decision at least three days before the shipment; this must be submitted in accordance with Section 38 (2) of this Decision.

The unincubated eggs from the building concerned are either in accordance with the relevant provisions of Regulation (EC) No 1069/2009 and of the Animal Materials Act (TMG), BGBl. No 141/2003, to be destroyed or, after appropriate labelling, to be put under surveillance at a plant approved for the manufacture and treatment of egg products, where they are in accordance with the requirements of the Regulation (EC) No 853/2004 laying down specific hygiene rules for food of animal origin (OJ L 327, 30.11.2004, p. In the case of herds who have been stabled in the same premises and in which the investigations in accordance with § § 19 to 21 have not revealed any suspicion, the district administration authority may, with the consent of the district administrative authority, by means of measures in the sense of the Z 1 distance if the veterinary surgeon or the care veterinarian confirms that the herds in question are complete due to their structure, scope and functions in terms of accommodation, posture, care and feeding separate production units, so that the infection in question can not spread from one flock to another. 16. In Section 28 (1) (1) (1), the phrase "according to § 25 Abs.1 Z 2" through the phrase "according to § 25" replaced.

17. In Section 28 (2) and Section 34 (1), the word order shall be "Regulation (EC) No 1774/2002" through the phrase "Regulation (EC) No 1069/2009" replaced.

Section 30 (3) reads as follows:

"(3) If hatching eggs, chicks or young animals are obtained from third countries, the suitability for the purposes of para. 1 and 2 shall be proved by the submission of a cross-border veterinary clearance certificate in accordance with § 33 VEVO 2008."

20. § 37 (1) last sentence reads:

30. § 41 (1) to (3) are:

" (1) All laying hens which are subject to this Regulation and which are also registered in accordance with the marketing standards for eggs, BGBl II No 365/2009, shall be required to have each herd examined for salmonella in an approved laboratory.

(2) The probation of all the laying hens shall be carried out at the instition of the farmer or the farmer at least every 15 weeks by the care veterinarian or by the care veterinarian, the first-time trial at the age of 22 up to 26 weeks.

In the case of holdings with several small herds with a total of up to 2000 animals forming an epidemiological unit, all herds may also be jointly tested at different ages, with a separate pair of boots for each flock. is used. Tests for the detection of antibiotics and antimicrobial effects in the laboratory are to be carried out on the samples according to Z 1 to 3. "

31. § 42 reads:

" § 42. (1) If a sample has a positive effect on salmonella or antibiotics or anti-microbial effects in accordance with § 41, this shall be done in the case of an operational control by the care veterinarian or by the care veterinarian and in the case of to report official control by the official veterinarian or the official veterinarian of the district administration. In the event of a positive result of the examination for antibiotics or antimicrobial effects, the Landeshauptmann shall immediately be responsible for any reason within the meaning of Section 13 of the residue control regulation, BGBl. (2) If there is a positive result for Salmonella enteritidis or Salmonella typhimurium, the farmer or farmer shall have the following:

1.

to check the hygiene measures in accordance with the second main item of this Regulation by the veterinary surgeon or the care veterinarian and to have it recorded in accordance with the requirements of the Austrian Poultry Health Service, and

2.

to draw up a recovery plan based on a vulnerability analysis.

(3) If it is confirmed by the Austrian reference laboratory for salmonella that a positive result is a vaccine strain, and if the competent authority has not been brought to the attention of human diseases with that strain, the following shall be: may be removed from measures within the meaning of paragraph 2 and 4, but the herd shall be officially sampled after a period of three weeks.

(4) If a sample in accordance with § 41 results in a positive finding on Salmonella enteritidis or Salmonella typhimurium or by the farmer or the farmer, respectively, where the farmer has not complied with the provisions of this Regulation, the following shall apply:

1.

the eggs are subject to Annex II D Z 2 of Regulation (EC) No 2160/2003 on the control of salmonella and other specified food-borne zoonotic agents, OJ L 327, 31.12.2003, p. No. 1), as last amended by Regulation (EU) No 1086/2011 amending Annex II to Regulation (EC) No 2160/2003 of the European Parliament and of the Council and Annex I to Commission Regulation (EC) No 2073/2005 in respect of salmonella in fresh poultrymeat, OJ L 327, 28. 2.

in the case of the flock concerned, the Austrian poultry health service database shall immediately enter into the ban on the marketing of fresh eggs in accordance with the marketing standards for eggs;

3.

the competent district administrative authority shall establish the existence of the marketing ban of fresh eggs with a communication with the farmer or the farmer, and the veterinary surgeon or the care veterinarian, as well as the to inform the competent food authority thereof;

4.

in the case of the exclusive detection of antibiotics or anti-microbial effects, the official sampling must be repeated immediately.

(5) If the district administrative authority has the reasonable suspicion of false positive results of the investigations in accordance with § 41, the marketing restriction according to paragraph 4 Z 1 may be lifted if it is to be carried out from another immediately official sampling

1.

a negative result from the studies referred to in Annex II D Z 4 of Regulation (EC) No 2160/2003, and

2.

a negative result of tests for the detection of antibiotics and antimicrobial effects in the laboratory from a collection sample to 60 sites representative of the stables to a total of 150 g is available.

(6) A substantiated suspicion pursuant to paragraph 5 may also be made by the farmer or the holder. be expressed by the farmer to the district managing authority, but only if

the operation in the previous 24 months was not affected by the same type of salmonella serotype,

2.

the last official control in accordance with § 14 has not been subject to any complaint concerning hygiene conditions; and

3.

in the case of membership of the poultry health service, the animal health service surveys which have been carried out since the previous official control do not have any unresolved complaints in the areas of hygiene, animal health status and Management/attitude (points 2, 3. and 6. of the QGV-Operating Survey Protocol).

For the possibility of a cancellation of the marketing restriction pursuant to paragraph 4 (1) (1) following this suspicion, paragraph 5 shall apply mutatily.

(7) Where an official sampling is carried out in the context of the declarations of outbreak in accordance with the Zoonoses Act, BGBl. I n ° 128/2005, which confirms the epidemiological link with outbreaks of disease caused by salmonella infection in humans, the district administration authority has to order a killing of the herd. For eggs from this herd shall be valid until the date of killing (4).

(8) The second main item of the Animal Health Act shall apply to the compensation of the animal owners in the case of an order for a killing as provided for in paragraph 7. "

Annex B

Sampling and sampling

1. Inquiry into animal feed

In accordance with § 26 of the 2007 poultry hygiene regulations, in case of suspicion or if it is necessary to determine contamination sources, feed on salmonella according to the indicated method is to be investigated:

6. Special provisions for the investigation of salmonella

a) The samples shall be sent to the laboratory within 24 hours after sampling. If the delivery is not carried out within 24 hours, the samples shall be stored in a cool place. The samples can be transported at room temperature, provided that excessive heat (above 25 ° C) and solar radiation are avoided. In the laboratory, samples shall be stored in a cool place until examination, which shall be carried out within 48 hours of the receipt and within four days of sampling.
