148. Federal law amending the Land and Forest Law Teachers Service Law (Administrative Jurisdictions-Adaptation Act-BMLFUW)

The National Council has decided:

The Land and Forest Forestry Teachers ' Service Law, BGBl. No 296/1985, as last amended by the Federal Law BGBl. I No 120/2012, shall be amended as follows:

1. In § 12 (7), § 19 (8), § 96, in the headline to § 106 and in § 106 the word "vocation" by the word "Complaint" replaced.

Section 75, together with the title, reads:

" Complaint

§ 75. The teacher shall be entitled to the complaint against the decision of the authority appointed for the performance of the performance. "

3. The previous text of § 83 receives the sales designation "(1)" ; the following paragraph 2 is added:

" (2) The Disciplinary Lawyer or Disciplinary Lawyer shall be granted the right to:

1.

Appeal to the Administrative Court against the decision of the Disciplinary Commission pursuant to Art. 132 (5) B-VG

2.

against the recognition of the Administrative Court in accordance with Art. 133 (8) B-VG Revision to the Administrative Court

"

4. In § 88, paragraph 2 is deleted.

5. In § 88 (3a) the phrase shall be: "Appointment to the competent authority for this purpose" through the phrase "Complaint to the Administrative Court" replaced.

6. § 88 (6) reads:

"(6) The appeal against a suspension or against a decision on the reduction (repeal) of the abbreviation does not have suspensive effect."

The last sentence of Section 90 (3), Section 100 (2) of the last sentence and section 102a (2) shall be deleted.

8. In § 103, paragraph 4 is deleted.

§ 105a reads as follows:

" Section 105a. Legally binding disciplinary findings and final decision-making decisions shall be published without delay by the chairman or chairperson of the authority responsible for carrying out the disciplinary proceedings in an anonymized form. "

10. § 119g reads:

" § 119g. The following regulations apply within the scope of this federal law as federal laws:

(11) The following paragraph 54 is added to § 127:

" (54) In the version of the Federal Law BGBl. I n ° 148/2013 § § 12 (7), 19 (8), 75 and the title, 83, 88 (3a) and 6, 96, 105a and 106, together with the title, shall be replaced by 1. January 2014 in force; at the same time, § § 88 (2), 90 (3), last sentence, 100 (2), last sentence, 102a (2) and 103 (4) shall not apply. "
