153. Federal law amending the Executive Code of Law and the Verwundetenmedaille Act

The National Council has decided:

Article 1

Amendment of the Executive Services Act

The Executive Code of Law (EDZG), BGBl. No 521/1985, as last amended by the Federal Law BGBl. I No 50/2012, shall be amended as follows:

1. The Title Federal Law of 26 November 1985 on the creation and conferral of the Executive Service (Executive Service Law-EDZG) " shall be replaced by the title Federal law on the creation and award of the executive service and recognition mark (EDuAZG) " replaced.

2. The previous text of § 1shall be the sales designation "(1)" preceded and § 1 para. 1 Z 1 lit. (b) reads:

" (b)

(3) The following paragraph 2 is added to § 1:

" (2) For the recognition of special merits of people for the maintenance of public peace, order and security, including the first general assistance obligation, the recognition mark of the Federal Ministry of the Interior or of the Federal Ministry of Justice. § § 3 and 4 shall apply accordingly. "

4. § 2 Z 2 reads:

may be awarded the recognition mark of the Federal Ministry of the Interior or the Federal Ministry of Justice, unless another visible distinction can be given for this achievement.

(2) The recognition mark shall be awarded in the area of the Federal Ministry of the Interior to the police director of the Federal State in whose sphere of action the recognition-worthy performance has been performed, in the area of the Federal Ministry of Justice Director of the executive director. A multi-award ceremony is possible. "

7. § 4 reads:

" § 4. The costs associated with the award of the EDZ or of a recognition mark shall be borne by the Federal Government. There is no legal claim to the award of the EDZ or the recognition mark. "

8. In § 5, the following paragraph 2a is inserted after paragraph 2:

" (2a) The badge for special bravery consists of a slightly arched, eight-pointed, white enamelled, golden-borded cross with a diameter of 60 mm with red enamelled edges. In the middle of the crossbar there is a white enamelled, golden borded, circular medallion with smooth, red enamelled ring. The ring contains the inscription "Federal Ministry of the Interior" or "Federal Ministry of Justice" as well as in the middle the inscription "VERDIENST". "

9. In § 5, the following paragraph 5 is added:

" (5) The appearance and the manner of carrying the recognition mark is determined in the area of the Federal Ministry of the Interior by regulation of the Federal Minister of the Interior, in the area of the Federal Ministry of Justice by regulation of the Federal Minister for Justice. "

10. In § 6 the amount shall be "3 000 S" by the amount "220 Euro" replaced.

(11) In § 7, the following paragraph 4 is added:

" The title, § § 1, 2, 2a, 2b, 4, 5 para. 2a and 5 as well as § 6 in the version of the Federal Law BGBl. I N ° 153/2013 will enter into force on 1 September 2013. "

Article 2

Amendment of the Verwundetenmedaillengesetz

The Verwundetenmedaillengesetz, BGBl. No. 371/1975, as last amended by the Federal Law BGBl. I No 50/2012, shall be amended as follows:

1. § 1 (1) (lit). b is:

" (b)

Persons belonging to or belonging to the Federal Ministry of the Interior or any of its subordinated service, "

2. In § 2 para. 1 Z 2 the word order shall be "a safety authority" through the phrase "of the Federal Ministry of the Interior or one of these subordinate service authorities" replaced.

3. In accordance with § 3, the following § 3a is inserted:

" § 3a. The wounded medal may be awarded as a medal in the home if a staff member of the Federal Ministry of the Interior or a subordinated service is responsible for the direct performance of his duties, with the exception of training and participation in training and practice sessions, suffer from damage to the body which results in a reduction in the working capacity of at least 30 calendar days. 4. In § 4 paragraph 4 lit. b and § 8 lit. b will be the phrase "a safety authority" through the phrase "the Federal Ministry of the Interior or one of these subordinated service authorities" replaced.

5. § 6a (3), the following paragraph 4 is added:

" (4) The § § 1 (1), 2 (1), 3a, 4 (4) and § 8 in the version of the Federal Law BGBl. I N ° 153/2013 will enter into force on 1 September 2013. "
