Regulatory content

§ 1. This Regulation lays down

1.

the training in the dental assistant,

2.

the qualification profile of the dental assistant,

3.

Continuing training in the prevention of prophylaxis,

4.

the qualification profile of the prophylactic assistance and

5.

recognition of foreign qualification certificates for dental assistance and prophylaxis assistance.

Training in the dental assistant

Section 1

General

Dual training

§ 2. (1) The training in the dental assistant lasts three years and comprises at least 600 hours of theoretical and at least 3 000 hours of practical training.

(2) The theoretical training takes place in a training course for dental assistance and includes the following Appendix 1 -defined training content.

(3) The practical training is carried out in a service relationship in accordance with § 81 Section 1 of the Dental Act, BGBl. I n ° 126/2005, as amended by the BGBl version. I n ° 38/2012, to the extent of at least 24 hours per week.

(4) If the service relationship according to paragraph 3 is terminated during the theoretical training and no new service relationship is concluded, the theoretical training can be continued for three months. A continuation beyond this period shall be allowed, provided that the practical training is complete.

Section 2

Framework conditions for training

Line

§ 3. (1) The legal entity of a course for dental assistance has to appoint a manager and a deputy head/s who have a professional qualification as a member of the dental profession for the training.

(2) The course management shall be responsible for the organisational and technical management. It shall include in particular the following tasks:

1.

Planning, organization, coordination and control of the entire theoretical training;

2.

Safeguarding the quality and pedagogical quality of teaching in the individual subjects;

3.

Feedback with the persons responsible for the training at the participants ' duty stations;

4.

Personnel management of the teaching and professional staff and the other staff of the course;

5.

Organization and coordination of and participation in the acceptance of the participants in the course of the course, as well as participation in the exclusion from the course;

6.

Calculation of examinations and practical exercises;

7.

organisation, coordination and chairmanship of the Commission's missions;

8.

Create a course order.

§ 4. (1) The legal entity of the Dental Assistance Course has to use teaching staff for the theoretical instruction and skilled staff for the practical exercises.

(2) As teaching staff for the individual subjects according to Appendix 1 the following persons shall be used:

1.

Members of the dental profession or profession of dentist,

2.

Medical specialists for oral, maxillofacial and facial surgery,

3.

Members of the dental assistant or prophylaxis assistant,

4.

other competent persons,

which are professionally qualified and didactically suitable for the relevant course subject and which have a corresponding professional experience.

(3) Persons skilled in the art shall be trained as professionals in accordance with paragraph 2, who are professionally qualified and have the appropriate professional experience. The tasks of the experts include, in particular, the following activities:

1.

Guidance of the participants in the practical exercises and

2.

Support of teachers within the framework of the theoretical teaching.

Responsible for training

§ 5. (1) In the case of an employment relationship according to § 81 (1) Z 1 ZÄG, the service provider (s) is responsible for the practical training.

(2) In the case of an employment relationship in accordance with § 81 (1) Z 2 to 4 ZÄG, the practical training must be determined by a person responsible for training at the place of employment. The division of the function to two persons is allowed.

(3) The person responsible for the training must ensure the achievement of the training objectives in the course of practical training at the place of employment and to exercise supervision over the trainee.

(4) The person responsible for the training shall be entitled to a professional qualification as a

Members of the dental profession or of the Dentist profession, or

2.

Medical specialist for oral, maxillofacial and facial surgery

, and to be suitable for the training of dental assistants.

Audit Commission

§ 6. (1) From the legal entity of the Dental Assistance Course, an examination committee is to be established for the conduct of the Commission's final exams. The following persons shall be included in the examination board:

1.

the course management or its deputy as chairperson,

2.

a representative of the locally competent State Dentists ' Chamber,

3.

the teaching force of the respective examination subject.

(2) As observers, the Examination Committee may

1.

a vom/from the Landeshauptmann/-ms dispatched/r representative and

2.

/e representative of the interests of the employees

shall be dispatched.

(3) The examination committee shall decide on the outcome of the examination in accordance with paragraph 1 in a non-public meeting with a simple majority of votes.

(4) The examination board shall be quorum if all the Commissioners and observers have been duly summoned and, in addition to the chairman or his/her deputy, the other members of the Commission or the other members of the Commission, Alternate members are present in accordance with paragraph 1.

Commitment to participation

§ 7. (1) The participants are obliged to participate in the lessons, including the practical exercises in the course of the training course for dental assistance. In the case of electronically supported teaching and learning forms within the scope of the teaching, participation is considered to be a participation.

(2) More detailed rules on justifiable absences of absence and the failure of training periods should be laid down in the course regulations (§ 8).

Teaching order

§ 8. (1) The course management of a course has to draw up and ensure compliance with a course regulations in order to ensure the proper functioning of the training establishment.

(2) The system of training has in particular more detailed rules on:

1.

the rights and obligations of the teaching staff and the teaching and professional staff,

2.

the behaviour and the rights and obligations of participants in the course of training,

3.

co-determination and co-design of participants,

4.

-justifiable absences and the failure of training periods, including the way in which examination dates are to be set, if there are justified absences, and

5.

Measures to ensure the safety of participants

.

(3) Before taking up the training establishment, the course regulations must be submitted for approval by the Landeshauptmann/Landeshauptfrau (Land Hauptmann/Landeshauptfrau). If the authorisation fails to be modest within three months, it shall be deemed to have been granted.

(4) The authorisation of the system of training shall be refused in accordance with paragraph 3 if the

1.

is in breach of legal provisions,

2.

contrary to an orderly training establishment,

3.

the safety of the participants is not guaranteed; or

4.

it does not serve to achieve the training objectives.

(5) In the event of a change in the system of courses, paragraphs 3 and 4 shall be adopted.

(6) The course regulations must be brought to the attention of the participants as well as to the teaching and professional staff.

Inclusion

§ 9. (1) The course management shall decide on the admission to a course for dental assistance in agreement with the legal entity of the course.

(2) In the case of admission, the applicants have to prove:

1.

the successful completion of the 9. School level or compulsory school degree-Examination according to compulsory school leaving certificate-examination law, BGBl. I No 72/2012,

2.

the existence of an employment relationship according to § 2 (3) including the declaration of consent of the service provider (s) for the admission,

3.

the health fitness required for the exercise of the profession,

4.

the trustworthiness required for the exercise of the profession.

(3) In cases where the applicant has such a degree of general education that can be expected to be able to follow the training, the proof referred to in paragraph 2 Z 1 can be waiver in individual cases.

(4) Prior to admission to a course for dental assistance, a recording interview or a recording test can be performed.

Accounting-Theoretical Training

§ 10. (1) Examination and practical exercises in Austria within the framework of

1.

training for a health profession,

2.

a middle or higher education in general or vocational education,

3.

a university or university of applied sciences degree or

4.

of an apprenticeship in a teaching profession

5.

Training in dental assistance or dental ordination assistance in accordance with § 87 ZÄG,

have been successfully completed, are to be counted on the appropriate examinations and practical exercises of a training in dental assistance by the course management in so far as they are equivalent in terms of content and scope.

(2) Examinations and practical exercises successfully completed abroad within the framework of a state-recognized training in the dental assistant are based on the appropriate examinations and practical exercises of an education in the To count dental assistance by the course management to the extent that they are equivalent in terms of content and scope.

(3) The offsetting referred to in paragraphs 1 and 2 shall be exempt from the obligation to deposit the examinations and to participate in the theoretical instruction and in the practical exercises in the respective subjects.

(4) Instatement of exams to the Commission's final examination is not allowed.

Accounting-Practical training

§ 11. (1) The service provider has successfully completed internships on practical training in the following cases:

1.

in the case of change of the employer in the course of the training in the dental assistant,

2.

If you change from teacher training in dental assistant to training in the dental assistant,

3.

Internships completed abroad within the framework of a state-recognized training in the dental assistant.

(2) On the basis of an opinion of the Austrian Dentistry Chamber, the calculation of the practical training must be carried out on the basis of the content and the degree of equivalence of the practical training completed.

Exclusion and automatic extermination

§ 12. (1) A participant may be excluded from the further visit of the course for the following reasons:

1.

lack of trustworthiness,

2.

a lack of health competence,

3.

serious breach of duty in the course of training or

4.

serious infringements of the system of training courses.

(2) The course management shall decide on the exclusion in accordance with paragraph 1 in agreement with the legal entity of the course. The service provider (s) shall be informed of the decision.

(3) Before decision on the exclusion, the person concerned shall be given the opportunity to justify it.

(4) An automatic departure from the training leads to:

1.

the unsuccessful use of the repetition of tests in the framework of theoretical training; or

2.

the termination of the service, taking into account the provisions of Section 2 (4).

Section 3

Quality assurance of training

Qualification Profile Curriculum

§ 13. (1) The training in the dental assistant has to teach the skills of the qualification profile according to the Appendix 2 target.

(2) The participants must be encouraged to deal responsibly with each other in the course of their training. They are at the highest possible level of openness, tolerance and acceptance of the diversity of socio-cultural backgrounds of people and of respect for the life, dignity and fundamental rights of every human being.

(3) The Federal Minister for Health may recommend a curriculum on the essential knowledge and skills to be provided within the framework of theoretical and practical training, after hearing the Austrian Dentists ' Chamber, if this is the case. Securing the quality of training is required. The training content in the curriculum is based on the training objectives in the sense of the qualification profile according to the Appendix 2 .

Training principles

§ 14. (1) The planning, organization and placement of the theoretical training contents are based in particular on the following basic training principles, teaching and learning strategies:

1.

Orientation of the situation and course of action in the processing of the topics, questions and problems in training;

2.

Exemplary learning in order to give preference to the preparation and understanding of fundamental principles and basic knowledge in relation to superficial knowledge transfer;

3.

Taking into account the didactical principle of "From simple to complex";

4.

Promotion of key qualifications for the occupational fields of activity;

5.

the possibility of using electronically supported forms of teaching and learning with appropriate technical equipment, with a maximum of 50% of the theoretical training being carried out in the form of electronically supported teaching and learning forms; All examinations and practical exercises are excluded;

6.

Entanglement of theoretical and practical training to enable optimal theory-practice transfers.

(2) The planning, organisation and implementation of practical training shall, in particular, be based on the following basic training principles, teaching and learning strategies:

1.

Within the framework of practical training, the participant is integrated into the team and actively participates in the respective field of action.

2.

In the course of practical training, the participants will be documented in a documentation template made available by the course, which corresponds to the qualification profile (§ 15).

3.

In the course of practical training, a person responsible for the training may at most two or, if at least one trainee is in the second or third year of training, at most three persons at the same time.

4.

The suitability of a workplace with regard to safety and health protection is given.

5.

The practice guidance by the training officer/s is carried out in the form of a feedback with the course management for the achievement of an optimal theory-practice transfer.

Documentation of practical training

§ 15. (1) In the course of practical training at the place of employment, the participants shall have a documentation concerning the acquisition of competence in the sense of the qualification profile in accordance with Appendix 2 , The documentation is to be checked by the person responsible for the training and signed and signed.

(2) The documentation of the practical training serves as proof of the successful placement of the training contents. The documentation shall include in particular:

1.

the duration and content of practical training and

2.

the competence acquisition that has been accepted

.

(3) The documentation shall be continued in the event of a change of service.

Section 4

Performance and assessment

General

§ 16. (1) Within the framework of the theoretical training in the dental assistant, the training success of the participants in the sense of the acquired competence acquisition is, as in the qualification profile according to the Appendix 2 to review and assess the situation.

(2) In the course of the theoretical training, the teaching staff and experts have to convince themselves of the learning progress of the participants and to document the learning process.

(3) The performance and assessment shall be carried out on the basis of objective assessment criteria based on the acquisition of competence.

Performance assessment

§ 17. (1) Individual audits carried out in accordance with Appendix 1 may be carried out in the form of an oral or written procedure. The participants must be informed about the form and dates in a timely manner. Sufficient preparation time shall be ensured.

(2) In the case of the individual examinations, the following assessment levels shall be used for the assessment of the performance of the participants:

1.

"very good" (1),

2.

"good" (2),

3.

"satisfactory" (3),

4.

"sufficient" (4),

5.

"Not enough" (5).

A positive assessment is given in the assessment stages according to Z 1 to 4.

(3) In the teaching subjects referred to in Appendix 1 if an individual examination is provided, the performance of the participant (s) with "not sufficient" is to be assessed in case of unjustified absence during the examination date.

(4) In assessing the performance of the participants in the teaching subjects in which, in accordance with Appendix 1 only participation is provided for, the following assessment levels shall apply:

1.

"successfully participated",

2.

"not enough".

(5) The teacher has to document the results of the performance assessment and assessment.

Negative Performance Evaluation-Recap

§ 18. (1) In the case of a negative performance assessment in accordance with § 17 (2) Z 5 and (4) (2) (2), the participant/participant is a repeat examination or a reexamination. Examination at the earliest possible date, however, at the earliest after one week.

(2) The result of the re-examination shall take the place of the assessment "not sufficient". If the performance assessment is negative again, a second option is open.

(3) If, after completion of the theoretical training, the performance of the participant in one or at most two subjects is assessed on the basis of the number of repetitive possibilities with the grade "not sufficient", the person concerned shall be entitled to Subject to an additional partial examination in the course of the final examination.

(4) If, after completion of the theoretical training in the dental assistant, the performance of the participant in more than two teaching subjects after exhausts of the repetition possibilities with the grade "not sufficient" is assessed an admission to the Commission's final examination (§ 19) is not possible. The theoretical training can be repeated in accordance with § 27.

Admission requirements for the final examination

§ 19. One participant is to be admitted to the final examination by the instructor, if:

1.

the subjects taught in accordance with Appendix 1 have been positively completed, taking into account Section 18 (3), and

2.

At least 3 000 hours of practical training within the scope of a service pursuant to § 2 para. 3 in a documentation (§ 15).

Commission's final audit

§ 20. (1) At the end of the training in the dental assistant, a final examination is to be carried out.

(2) The final examination of the Commission shall include the following partial examinations:

1.

Conserving dentistry

2.

Prosthetical dentistry

3.

Dental surgery

Preparation of the Commission's final examination

§ 21. (1) The course management has to determine the dates of the examination. The examination dates of the final examination are immediately and verifiably notified to the participants.

(2) The members of the Examination Committee and the observers shall be duly charged no later than four weeks before the final examination of the final examination. The members of the Commission and the observers are to be followed by a list of candidates before the commencement of the final examination.

Implementation of the Commission's final examination

§ 22. (1) The teaching force of the relevant course of the final examination has to carry out the relevant part-examination and to review the competence acquisition comprehensively and in an integrated manner by means of practical examples.

(2) In addition to the teaching force, the other members of the Examination Commission are also entitled to ask questions.

(3) The teachers of the partial exams of the Commission's final examination have to propose an assessment for the respective part-examination after the final examination of the final examination of the examination board.

Performance appraisal within the framework of the Commission's final examination

§ 23. (1) The Examination Committee has the competence acquisition of the candidate in accordance with the qualification profile in accordance with Appendix 2 to identify and assess. The following assessment levels shall apply:

1.

"Passed with excellent success"

2.

"passed"

3.

"failed"

A positive assessment is given in the assessment stages according to Z 1 and 2.

(2) A prerequisite for the assessment "with excellent success" is that a positive assessment and of at least two teachers for the assessment of the respective part-examination "with excellent success" " has been proposed. Additional partial exams according to § 18 (3) exclude the assessment "with excellent success".

Additional partial exams within the framework of the Commission's final examination

§ 24. (1) Additional partial exams pursuant to § 18 (3) shall be carried out at the commencement of the final examination of the relevant teaching by the relevant teacher. The assessment levels in accordance with § 17 (2) shall apply.

(2) If an additional partial examination in accordance with paragraph 1 is considered negative, the second sentence of Section 18 (4) shall be used. The final examination is to be cancelled.

Commission's final audit-absence

§ 25. (1) If a participant is prevented from entering the final examination on the basis of a justified absence in the sense of the teaching order, it is to be made available at the earliest possible date.

(2) If a participant fails to perform a final examination on the basis of unjustified absentia, the Commission's examination of the mission shall be assessed "not passed".

(3) The assessment of whether justified absences are available within the meaning of the apprentice order is the responsibility of the course manager (s) after hearing the participant (s) and, if necessary, the employer (s).

Commission final examination-Repeal possibilities

§ 26. (1) If the Commission's final examination is "not passed", it may be repeated twice before the Examination Commission.

(2) The first recurrence of the Commission's final examination shall be within three months after the first final examination, the second repetition shall be provided within three months after the date of the first repetition.

(3) The dates for the repetition of the final examination are to be determined by the course management.

(4) If the second examination of the final examination of the final examination is assessed with "not passed", the participant will automatically be taken out of the course. The theoretical training can be repeated in accordance with § 27.

Repeat the training

§ 27. (1) The repetition of the theoretical training in the dental assistant is permitted at most once. The Examination Committee has to decide which of the individual examinations completed in the course of the initial implementation of the training are to be considered and which do not need to be completed again.

(2) If the repetition in accordance with paragraph 1 leads to a negative result after exhausts of the repetition possibilities, the participant from the course in the dental assistant will automatically be left out of the course. A further repetition of the training or of training parts is no longer permissible.

Audit Audit Log

§ 28. (1) A protocol is to be made on the Commission's final examination. In particular, the audit report shall contain:

1.

Names and functions of the members and observers of the Examination Commission,

2.

the date of the Commission's final examination,

3.

Name of the participant (s),

4.

Examination questions and

5.

Performance assessment.

(2) The audit protocol shall be signed by the members of the Examination Board.

(3) The audit record shall be kept for at least 10 years.

3. Main piece

Further training in prophylaxis assistance

Section 1

General

Continuing vocational training

§ 29. (1) The training in the prevention assistance shall include the following training: Appendix 3 content provided. The theoretical part shall comprise at least 64 hours and the practical part shall comprise at least 80 hours including 30 findings .

(2) The continuing training is to be carried out in a part-time manner and must be completed within two years.

Section 2

Quality assurance of continuing training

Qualification Profile-Curriculum participation

§ 30. (1) The training in prophylaxis assistance has to teach the skills of the qualification profile according to the Appendix 4 target.

(2) The Federal Minister for Health can recommend a curriculum on the essential knowledge and skills to be mediated in the course of further training after hearing the Austrian Dentists ' Chamber if this is to safeguard the quality of training is required. The content of the continuing training is based on the training objectives in accordance with the qualification profile according to the Appendix 4 .

(3) The training principles shall be applied in accordance with § 14 with the proviso that:

1.

in the implementation of practical training at the place of employment of the training keys 1: 2 and

2.

in the course of the practical exercises in the context of the training key lessons 1: 5

is complied with.

(4) The participants are obliged to participate in the classroom, including practical exercises in the course of continuing education. In the case of electronically supported teaching and learning forms within the scope of the teaching, participation is considered to be a participation.

Documentation of the practical part of continuing training

§ 31. (1) In the practical part of the training, the participants have in the prophylaxis assistance according to Appendix 3 a documentation on the acquisition of competence in the sense of the qualification profile according to Appendix 4 , The documentation is provided by the line or to be signed by the service provider with signature and date.

(2) The documentation serves as proof of the successful placement of the training contents. In the documentation are

1.

the duration and content of the practical part of the training, including findings, and

2.

the competence acquisition that has been accepted

.

Section 3

Framework conditions for continuing training

Line

§ 32. (1) The legal entity of a continuing training course in the prophylaxis assistant has to order a head and a deputy head/s who have a professional qualification as a family member of the dental profession.

(2) The management is responsible for the organisational and technical management of continuing training. It shall include in particular the following tasks:

1.

Planning, organisation, coordination and control of continuing training;

2.

ensuring the quality and pedagogical quality of the teaching;

3.

Personnel management of the teaching and professional staff and the other staff of continuing training;

4.

To lay down justifiable absences for teaching or teaching the final examination, which must be communicated to the participants; the regulations have to be based on an approved course of study in accordance with § 8;

5.

organisation, coordination and participation in the reception of the participants in continuing training and in the exclusion of continuing training;

6.

Organisation, coordination and chairmanship of the Commission's final exams.

Lehr and skilled workers

§ 33. (1) The legal entity of continuing training in the prevention assistant has trained teachers for the theoretical part and skilled workers for the practical part of the training according to Appendix 3 to use.

(2) The following persons shall be used as teaching staff for each subject:

1.

Members of the dental profession or profession of dentist,

2.

Members of the Prophylaxis Assistance,

3.

other competent persons,

which are professionally qualified and didactically suitable for the relevant course subject and which have a corresponding professional experience.

(3) Persons skilled in the art shall be trained as professionals in accordance with paragraph 2 (2) (1) and (2) who are professionally qualified and have an appropriate professional experience. The tasks of the experts include, in particular, the following activities:

1.

Guidance of the participants in the practical exercises and

2.

Support of teachers within the framework of the theoretical teaching.

Audit Commission

§ 34. (1) From the legal entity of continuing training in the prophylaxis assistant, an examination committee is to be set up for the conduct of the mission's final examination. The following persons shall be included in the examination board:

1.

the management or its deputy as chairperson,

2.

a representative of the locally competent State Dentists ' Chamber, who is concerned with prophylactic matters, or his/her deputising,

3.

a teaching force of the respective examination subject.

§ 36. (1) A participant may be excluded from the further visit to the training for the following reasons:

a lack of health competence,

serious breach of duty in the course of continuing training.

(2) The management shall decide on the exclusion in accordance with paragraph 1 in agreement with the legal entity of further training. The service provider (s) shall be informed of the decision.

(3) Before decision on the exclusion, the person concerned shall be given the opportunity to justify it.

(4) An automatic departure from the continuing training leads to the unsuccessful use of the repeat possibilities of the final examination.

§ 38. Nostrification

Nostrification Procedure

§ 42. (1) Persons who have a state-recognised training in the dental assistance or Have completed the prevention assistance, which is not covered by § 38, are entitled to receive the recognition of their qualification certificate (Nostrification) by the State Governor of that country, in the area of the country's main office

(3) The documents referred to in paragraph 2 are to be presented in the original or in certified copy, together with the translation by a translator (s) in court.

(4) Apart from the submission of individual documents pursuant to paragraph 2 (2) (3), it may be waived if, within a reasonable period of time, the applicant is credited with the fact that the documents cannot be taught and the documents submitted are for a Decision is sufficient.

(5) For refugees pursuant to Article 1 of the Convention on the Status of Refugees, BGBl. (8) If the equivalence is not entirely present, the nostrification shall be linked to the successful deposition of one or more additional exams in the context of a supplementary training (§ 43).

(9) The fulfilment of the conditions imposed in accordance with paragraph 8 shall be entered by the Austrian Dentist Chamber in the notification of nostrification. § 43. (7) The certificates shall be in copy or electronic form

§ 47.
