284. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management concerning the statistics on the structure of agricultural holdings in 2013 (Agricultural structural statistics-Regulation 2013)

On the basis of § § 4 to 10 and § 32 paragraph 4 Z 1 of the Federal Statistics Act 2000, BGBl. I No 163/1999, as last amended by Federal Law BGBl. I n ° 111/2010 will be in agreement with the Federal Chancellor, with regard to § 13 in addition in agreement with the Federal Minister of Finance and with regard to § 12 on the basis of § 3 of the LFBIS Act, BGBl. No 448/1980, as last amended by Federal Law BGBl. No 505/1994,

Arrangement for the compilation of statistics

§ 1. The Bundesanstalt Statistik Österreich (Bundesanstalt Statistik Österreich) has been responsible for the fulfilment of Austria's obligations under Regulation (EC) No 1166/2008 on farm structure surveys and the survey on agricultural production methods, as well as on the repeal of Council Regulation (EEC) No 571/88, OJ L 57, 28.1.88. No. 14., as amended by the corrigendum OJ L 327, 28.12.2008, p. No. OJ L 308, 24.11.2009, p. 27, to carry out surveys in accordance with this Regulation and to compile statistics on the basis of the data collected by 31 December 2014.

Statistical units, survey mass

§ 2. (1) Statistical units shall be agricultural holdings within the meaning of Article 2 lit. (a) of Regulation (EC) No 1166/2008, which shall reach one of the following thresholds:

1.

a hectare of agricultural land;

2.

25 working wine-growing area;

3.

15 Ar intensively used construction surface area or ten Ar intensively used berry fruit, strawberry, vegetable, hops, flowers or ornamental plants or reb, forst or nursery surface;

4.

an Ar predominantly commercially managed greenhouses (high-glass, foil tunnel, glass);

5.

Livestock farming with three bovine animals, five pigs, ten sheep or ten goats or at least 100 poultry of all kinds.

(2) Statistical units are also forestry holdings with at least three hectares of forest area.

Reference periods, reference periods

§ 3. (1) The following dates shall apply:

1.

1 April 2013 with regard to the characteristics referred to in Annex Point 3.

2.

15 May 2013 as regards the characteristics referred to in Annex Point 1.3. and

3.

31 October 2013 with regard to the other survey characteristics.

(2) Reference periods shall apply:

1.

1 November 2012 to 31. October 2013 as regards the characteristics referred to in Annex Item 4.2., 5. and 6.,

2.

1 October 2012 to 30 September 2013 with regard to the characteristics referred to in Annex Point 2.,

3.

1 January 2011 to 31 December 2013 with regard to the characteristics referred to in Annex Point 7. and

4.

the calendar year 2013 with regard to the characteristics referred to in Annex Point 3., if there is no animal of the animal species held during a holding operation on the cut-off date of 1 April 2013.

Survey type, survey characteristics

§ 4. (1) In the nature of the full survey, the following shall be collected:

1.

the characteristic according to Annex Point 1.1. by drawing up statistics,

2.

the characteristics according to Annex Points 1.3., 2.1. to 2.9., 3.2. and 7. by drawing up administrative data of the agricultural market Austria and

3.

the characteristics according to Annex Point 3.1., 3.3. to 3.7. by drawing up administrative data of the Federal Ministry of Health.

(2) The other survey characteristics shall be collected in the form of the sample survey type by survey of 30 000 statistical units in accordance with § 2.

(3) The selection of the sample holdings must be carried out by the Federal Institute on the basis of a stratified random sample.

(4) In so far as the survey referred to in paragraph 1 is not possible in individual cases by obtaining statistics or administrative data, the survey shall be carried out by questioning the statistical units selected in accordance with paragraph 3.

Implementation of the survey

§ 5. (1) The survey pursuant to § 4 (2) and (4) shall be carried out by the Federal Institute.

(2) For the survey, the Bundesanstalt has to compile uniform survey documents (electronic questionnaires and explanations) and make these available to the parties responsible for providing information.

Obligation to provide information

§ 6. (1) According to § 9 of the Federal Statistics Act 2000, there is a duty to provide information in the surveys.

(2) For the purpose of providing information, those natural and legal persons as well as registered partnerships are obliged to operate a statistical unit in its own name.

(3) In order to provide information in the form of a reasoned empty message, those natural and legal persons as well as registered partnerships are also required to operate either an establishment on which the conditions laid down in accordance with § 2 shall not apply or which have left the establishment.

Obligation to provide information to the parties responsible for providing information

§ 7. (1) The parties responsible for providing information in accordance with § 6 shall be obliged to complete the electronic questionnaire completely and to the best of their knowledge within four weeks after receipt of the access authorization for the electronic questionnaire. to be returned to the Federal Institute within this period.

(2) If the technical possibilities for an electronic message do not exist in the case of the party responsible for the information, the party responsible for providing information shall have this within two weeks after receipt of the access authorization for the electronic questionnaire of the to inform the Federal Institute in writing. In this case, the party responsible for providing information has to comply with his obligation to provide information within six weeks after the written announcement (postmark of the communication).

Other co-action obligations

§ 8. Former managers (farmers) of statistical units are obliged to participate in the determination of the new person responsible for providing information pursuant to § 6 para. 2 by the Federal Institute.

Information on disclosure requirements

§ 9. The Federal Institute has to provide information on the legal consequences according to § 66 of the Federal Statistics Act 2000 in the case of refusal of information and in the case of information which is knowingly incomplete or not to the best of its knowledge.

Duty of participation of the holders of administrative data

§ 10. At the request of the Bundesanstalt, the holders of administrative data pursuant to § 4 (1) (2) and (3) shall transmit the data free of charge to electronic data carriers within four weeks of the Bundesanstalt.

Publication of results

§ 11. The Federal Institute has the main results of the statistics available to the public for free on the Internet without delay after the detailed results of the statistics have been forwarded to the Statistical Office of the European Commission (Eurostat).

Data transmission to the LFBIS

§ 12. The Federal Institute has to submit the individual operating data determined in accordance with § 4 to the Federal Minister for Agriculture, Forestry, Environment and Water Management for inclusion in the agricultural and forestry operating information system (LFBIS).

Cost replacement

§ 13. The Federal Minister for Agriculture, Forestry, the Environment and Water Management of the Federal Institute for Agriculture, Forestry, Environment and Water Management in 2013 and 2014 will pay a fee of € 151 481.50 each in accordance with Section 32 (4) (1) of the Federal Statistics Act 2000.

Override

§ 14. The Regulation shall expire on 31 December 2015.
