312. Regulation of the Federal Minister for Labour, Social Affairs and Consumer Protection for the temporary employment of foreigners in winter tourism

Due to § 5 paragraph 2 Z 1 of the Foreigners Employment Act-AuslBG, BGBl. No. 218/1975, as last amended by the Federal Law BGBl. I No 72/2013, shall be arranged:

§ 1. For the winter tourism sector, quotas for the temporary employment of foreign workers are fixed and are divided among the federal states as follows:

Until 31 December 2013: 1 780

from 1. Jänner 2014: 1 460

§ 2. (1) The quotas may be granted from 18 November 2013 on authorisations for employment which shall not exceed 24 weeks and shall not be allowed to end after 15 May 2014. The granting of employment permits for holdings in the glacial regions and their catchment area and for show-making establishments may be granted from the entry into force of this Regulation.

(2) Employment permits, which are before 1. Jänner 2014 will be available until the end of the period of validity of the contract, which will be valid from 1 January 2014. The quotas applicable in January 2014 are to be expected.

(3) Nationals subject to the transitional provisions on the free movement of workers of the EU (§ 32a AuslBG), and asylum seekers are to be preferred in the granting of employment permits.

§ 3. This Regulation shall not enter into force on 30 April 2014.
