460. Regulation of the Federal Minister for Science, Research and Economics on the definition of a catalogue of criteria for the objectification of the damage-benefit analysis of animal experiments (animal test-criteria catalogue-Regulation-TVKKV)
On the basis of the Animal Experiments Act 2012 (TVG 2012), BGBl. I n ° 114/2012, in particular § 26 (2) (8), Section 29 (2) (4) and (3) (3), is ordered:
Subject matter
§ 1. The subject matter of this Regulation is the determination of a catalogue of criteria for objectification of the damage-benefit analysis of animal experiments within the meaning of Section 29 (2) Z 4 TVG 2012.
Criteria Catalog
§ 2. The criteria catalogue for objectification of the damage-benefit analysis shall include the information provided in accordance with the Annex .
Performance of the damage-benefit analysis
§ 3. (1) The Authority shall carry out an objectified damage-benefit analysis of the project, taking into account ethical considerations, on the basis of the set of criteria to be submitted to the project application in accordance with § 26 TVG 2012.
(2) In carrying out the damage-benefit analysis, the Authority may use experts or commissions in accordance with § 36 TVG 2012. In the setting up of commissions pursuant to § 36 TVG 2012, the Authority shall, as far as possible, also draw on persons with expertise in the field of animal, medical or research ethics.
Implementation Notice
§ 4. This Regulation provides for Directive 2010 /63/EU on the protection of animals used for scientific purposes, OJ L 327, 30.4.2010, p. No. 33., in particular Article 38 (2) (d), transposed into Austrian law.
Transitional provision
§ 5. According to § 42 paragraph 7 TVG 2012, completed criteria catalogues are subject to six months from the publication in accordance with § 31 paragraph 4 TVG 2012 Application requirement pursuant to § 26 paragraph 2 Z 8 TVG 2012.

§ 6. This Regulation shall enter into force 1. Jänner 2016 in force.
