463. Regulation of the Federal Minister for labour, Social Affairs and consumer protection for the temporary employment of foreigners in the agriculture and forestry

Due to section 5 paragraph 2 of the aliens Employment Act - aliens, BGBl. No. 218/1975, as last amended by Federal Law Gazette I no. 113/2015, is prescribed:

§ 1 (1) of the sector of agriculture and forestry is a quota set in the amount of 2 640 for the temporary employment of foreign workers and on the provinces, divided as follows:

(2) within the framework of these quotas employment permits may be granted from 1 January 2016 up to six months with a period of validity. For foreigners, who were employed in agriculture and forestry and are subject to the transitional provisions for the EU – free movement of workers (Article 32a aliens), each within a quota for the temporary employment of foreign workers in the sector in the previous three years, employment permits may be granted with a duration up to nine months. The duration of the employment permits do not end after December 31, 2016.

§ 2 (1) for the economic activity is agriculture an additional quota is set at a height of 395 for short-term employment of foreign harvesters and divided on the Federal States as follows:

(2) within the framework of these quotas employment permits may be granted from 29 February 2016 up to six weeks with a period of validity. The duration of the employment permits do not end after 30 November 2016.

§ Are 3. foreigners who are subject to the transitional provisions for the EU – free movement of workers, and asylum seekers in the granting of employment permits under the quotas referred to in §§ 1 and 2 to be preferred.



§ 4. This Regulation shall enter upon the expiry of the 30 November 2016 override.
