463. Regulation of the Federal Minister for Labour, Social Affairs and Consumer Protection for the temporary employment of foreigners in agriculture and forestry
Due to § 5 (2) of the Foreigners Employment Act-AuslBG, BGBl. No. 218/1975, as last amended by the Federal Law BGBl. I n ° 113/2015, shall be arranged:
§ 1. (1) For the agricultural and forestry sector, a quota of 2 640 for the fixed-term employment of foreign workers shall be established and divided among the Länder as follows:

(2) Within the framework of these quotas, the following shall be allowed: 1. January 2016 Employment permits with a period of validity of up to six months will be granted. For foreigners who have already been employed in the past three years under a quota for the fixed-term employment of foreign workers in the agricultural and forestry sector, and which have been Transitional provisions on the free movement of workers of the EU (Article 32a of the AuslBG) may be granted to employment permits with a period of validity of up to nine months. The period of validity of the employment permits shall not end after 31 December 2016.
§ 2. (1) An additional quota of 395 for the short-term employment of foreign harvest workers shall be established for the agricultural sector in the agriculture sector, and shall be allocated among the Länder as follows:

(2) In the framework of these quotas, employment permits may be issued from 29 February 2016 for a period of up to six weeks. The period of validity of the employment permits shall not end after 30 November 2016.
§ 3. Foreign nationals who are subject to the transitional provisions on EU free movement of workers and asylum seekers are to be preferred in the granting of authorisations for employment under the quotas in accordance with § § 1 and 2.
§ 4. This Regulation shall expire on the expiry of 30 November 2016.
