351. Ordinance of the Federal Ministry of Labour, Social Affairs and Consumer Protection at the Federal Ministry of Labour, Social Affairs and Consumer Protection, which sets the minimum wage rate for domestic carers for Vienna

The Federal Ministry of Labour, Social Affairs and Consumer Protection is the Federal Ministry of Labour, Social Affairs and Consumer Protection in accordance with Section 22 (1) of the German Labour Constitution Act, BGBl. No. 22/1974, in the version of the Federal Law BGBl. I No 71/2013 authorises the minimum wage rate to be fixed at the request of a collective contractual body if no collective contract is effective for the sector concerned.

The Federal Ministry of Labour, Social Affairs and Consumer Protection has fixed the following minimum wage rate with a decision of 15 November 2013 following the implementation of a senate negotiation:

Minimum wage rate

for careerers-Vienna

Scope

§ 1. This minimum wage is valid:

1.

Spatial: for the Land of Vienna;

2.

Personal and professional: for home-care workers, to which the House Concern Act, BGBl. No 16/1970, and its employers,

a)

who are not members of a collective-contracting entity in their capacity as employers of homeowners/domestic careerers, or

b)

if, after the entry into force of the minimum wage, they acquire collective bargaining capacity or join a collectivelycontractual body as long as no collective agreement is concluded for them.

Services according to § § 3 and 4 (1) Hausanxigergesetz

§ 2. (1) The monthly fee for the services to be provided in accordance with § § 3 and 4 (1) of the Hausanxigergesetz (Hausanxigergesetz) shall be:

1.

in the case of apartments per square metre of floor space 0,2440 €,

2.

for other premises per square metre of floor space 0,2440 €,

3.

for the cleaning of the pavings and their scattering at Glatteis per square metre of walking area 0,4401 €.

(2) As a substitute for the costs of the procurement of the cleaning works within the meaning of § 4 paragraph 1 Z 1 lit. a to d the materials required by the Hausanxigergesetz shall be fixed in the form of a surcharge for the remuneration in accordance with paragraph 1 (1) (1) and (2) to 15% of the amount. This surcharge is not an integral part of the fee.

(3) Those who take up the services of the house concerned or the appointed representative/representative in order to open the gate in the prescribed blocking period shall have the right to open the gate to the house concerned (substitute). At midnight, € 4.50, after midnight 5,-€, to be paid.

(4) The sum resulting from para. 1 and 2 shall be rounded off in commercial terms by cent.

Services in accordance with § 4 para. 3 Hausanxigergesetz

§ 3. (1) In addition to the remuneration guaranteed to him/her by virtue of the § § 7 (1) and (12) of the House Concerned Law, the house concerned shall be entitled to the following remuneration in the case of the following work carried out at a house, with this additional fee being paid. is composed of the sum for the residential areas, other premises, sidewalks, other accessible areas and the supervision of the elevator.

2.a)

The fee for work after Z 1 is due in principle upon completion of the respective work. In the case of a remediation period of more than three months, half of the remuneration after Z 1 shall be paid for the fourth month after the start of the actual construction work, and the other half after completion of the work.

b)

If the service ends before the completion of the work referred to in Z 1, then the house concerned is to be paid in proportion to the services already provided.

c)

If cleaning work after Z 1 has to be carried out on special grounds on Sundays and public holidays, an additional charge of 8.75 € per hour must be charged.

(2) An hourly wage of € 8.75 is due for extraordinary other agreed work. This is increased to € 17.50 if the work is carried out for special reasons in the night hours and/or at the end of the day. on Sundays and holidays. (5) The fee referred to in paragraphs 1 to 4 shall be added to the surcharge in accordance with § 2 para. 2 if the cleaning work is concerned.

(6) For the supervision of a washing machine and any additional equipment, a monthly fee of 21,29 € is payable. In case of collection, a surcharge of € 5.28 per washing machine is required.

(7) If an obligation of attendance of the home-care provider is agreed, which goes beyond the provisions of § 4 (1), (3) and (4) of the Hausanxigergesetz (Hausanxigergesetz), an hourly wage of 5.90 € is to be paid on Sundays and public holidays. 11.80 € increased.

Cleaning of garbage boxes

§ 4. § 6. Beneficiary clause

§ 7. Existing more favourable agreements will not be affected by this minimum wage.

§ 8. This minimum wage rate changes the minimum wage rate of 26 November 2012, M 4/2012/XXVI/99/2, BGBl. II No 389/2012, and 1. Jänner 2014 in force.
