360. Regulation of the Federal Minister for Transport, Innovation and Technology on the permitted entry and excursions to and from airfields (Flight FelderBorder Ordinance 2013-F-GÜV 2013)

On the basis of § 8 of the Aviation Act, BGBl. N ° 253/1957, as last amended by the Federal Law BGBl. I No 108/2013 shall be assigned:

Scope

§ 1 This Regulation lays down the rules on the admissibility of the implementation of entry and exit trips to and from Flying fields of/or flying in the territory of Austria in the case of non-European Union states and/or States which belong to the European Union, but which do not belong to the contracting states pursuant to Section 1 (6) of the Border Control Act, BGBl. No 435/1996.

Conditions for the admissibility of the entry and excursion

§ 2 (1) A-and outings of in accordance with the states referred to in § 1, the customs and border control provisions shall be subject to the following conditions: from the airfields Dobersberg, Eferding, helicopter field Feldkirch, Feldkirchen-Ossiacher See, Ferlach-Glainach, Freistadt, Friesach-Hirt, Fürstenfeld, Gmunden, Goldeck Talstation, Hofkirchen, Hohenems-Dornbirn, Helipad Glock Ferlach, Kapfenberg, Kirchdorf-Micheldorf, Krems-Langenlois, Kufstein-Langkampfen, Lanzen-Turnau, Leoben-Timmersdorf, Lienz-Nikolsdorf, Mariazell, Mayerhofen, Niederöblarn, Nötsch im Gailtal, Pinkafeld, Pöchlarn-Wörth, Punitz-Güssing, Reutte-Höfen, Ried-Kirchheim, St. Andrä im Lavanttal, St. Donat-Mairist, St. Georgen on Ybbsfeld, St. Johann/Tirol, Scharnstein, Schärding-Suben, Helipad Schruns "Sanatorium Dr. Schenk", Seitenstetten, Spitzerberg, Stockerau, Trieben, Helipad Villach LKH, Völtendorf, Vöslau, Weiz-Unterfladnitz, Wels, Wiener Neustadt/Ost, Wolfsberg, Zell am See and Zwatzhof helicopter airfield, allowed.

(2) A-and outings of in accordance with the States referred to in Article 1, Subject to further customs and border control regulations, only with the approval of Austro Control GmbH pursuant to Section 3 (1) (1) of this Regulation are those which are not listed in paragraph 1 of this Article. a Border Flood Regulation (GÜV), BGBl. No 249/1987, as amended.

(3) On-and outings of foreign civilian state aircraft to or from of all airfields located in Austria's federal territory, is the Boundary Crossing Ordinance (GÜV), BGBl. No 249/1987, as amended.

Obligation to transfer and retain data

§ 3. (1) The pilot responsible shall have the holder of the airfield concerned, unless otherwise specified in paragraph 2, on a flight from the States referred to in § 1 at the latest before departure, on excursions in accordance with the states referred to in § 1. at least one hour before departure, to submit the following data:

1.

the licence plate and the type of the aircraft,

2.

used immediately before the entry into the Austrian federal territory, or Immediately after the trip from the same airport to the landing,

3.

the airfield provided for landing in the Austrian federal territory

4.

the prospective country and/or Departure time,

5.

the names, dates of birth and nationality of the pilot responsible and of the passengers.

(2) Pilots of rescue flights (§ 2 of the Civil Aviation Vehicle Ambulance and Rescue Flight Ordinance (ZARV 1985), BGBl. No 126/1985), the data transmission as referred to in paragraph 1 shall be carried out as far as possible, but at the latest immediately after return to the base of the rescue organisation.

(3) The holder of the airfield shall immediately communicate the data referred to in paragraph 1 (1) to (5), by telephone, by fax, in electronic form or in any other technically possible manner by the locally competent intelligence unit for air traffic services, the local security service and the customs office responsible for the passport control. Furthermore, he must keep records of all the data transmitted and keep it up for one year.

(3) The sections 1 to 3 apply, in the case of a regulation pursuant to § 10 para. 2 of the German border control law, also applicable to excursions to and excursions from the territory of the Federal Republic of Germany (Germany). States which are Contracting States pursuant to Section 1 (6) of the Border Control Act.

(4) The rules on the flight plan in the 2010 air traffic rules, BGBl. II No 80/2010, as amended, shall remain unaffected.

In-and out-of-power

§ 4. (1) This Regulation shall enter into force with the day following the presentation.

(2) The Regulation of the Federal Minister of Transport, Innovation and Technology on the permitted entry and excursions to and from airfields (Flight Field Border Flight Ordinance 1996-F-GÜV 1996), Federal Law Gazette (BGBl). No 372/1996, shall expire at the end of the day of the presentation of this Regulation.
