377. Ordinance of the Federal Ministry of Labour, Social Affairs and Consumer Protection at the Federal Ministry of Labour, Social Affairs and Consumer Protection, with which a home-work tariff for home workers in the derelict embroidery sector is issued

The Federal Office of the Federal Ministry of Labour, Social Affairs and Consumer Protection is the Federal Ministry of Labour, Social Affairs and Consumer Protection in accordance with Section 34 (1) of the Home Labour Act 1960, BGBl No. 105/1961, in the version of the Federal Law BGBl. I No 74/2009, authorizing the adoption of homework tariffs at the request of a collectivelycontractable body of workers.

The Federal Ministry of Labour, Social Affairs and Consumer Protection has issued a decision of 19 November 2013 following the implementation of a senate hearing:

Homework tariff

for home workers in chain stitchstitching

H 11/2013/V/33/1

Scope

§ 1. This home work tariff applies:

a)

Spatial: for the province of Vorarlberg.

b)

Factual: for all homework in the field of chain stitchstitching.

c)

Personal: for all clients (middle persons) who employ homeworkers for the work listed under Z 2, and for all homeworkers to which such work orders are issued.

Date of effectiveness and duration of validity

§ 2. In accordance with Section 35 (1) of the Heimarbeitsgesetz (Heimarbeitsgesetz), this home-working tariff will apply to all persons starting from the 1st In January 2014, work orders executed by the home workers (home work) are in force and are valid until a repeal or amendment in accordance with Section 36 (1) of the German Home Labour Act 1960.

Tariff provisions

§ 3.

1.

Minimum hourly wage:

For other embroider work (fixed and burning) the minimum hourly wage is 6.70 €.

2.

Supplement:

Embroidery work orders with three or more colors, respectively Embroidery materials are awarded a surcharge of 10%.

3.

Supplement

Embroidery orders, in which the sewing (manual work) of at least five threads is provided, is awarded a surcharge of 10%.
