380. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on temporary exceptions to the individual provisions of the Emissions Certificate Act 2011 (ECG-Exceptions-Regulation on Air Transport)
On the basis of § 53a of the Emissions Trading Act 2011, BGBl. I No 118/2011, in the version of the Federal Law BGBl. I n ° 98/2013, shall be arranged:
International aviation activities
§ 1. For the purposes of this Regulation, "International aviation activities" means air transport activities to and from airports in countries outside the European Union, which:

Still overseas territories or protected areas of EEA States, |
|||||||||
3. |
countries which have signed an accession treaty with the European Union, |
|||||||||
. |
Temporary exceptions
§ 2. When an aircraft operator
1. |
In the calendar years 2010, 2011 or 2012, emissions from international aviation activities have not been reported, or |
|||||||||
2. |
for international aviation activities in 2012 |
|||||||||
a) |
does not issue the corresponding amount of emission allowances to cover these emissions for 2012; and |
|||||||||
b) |
the corresponding amount of free emission allowances |
|||||||||
aa) |
has not been received or |
|||||||||
bb) |
has been received in the Union Register for the purpose of deleting it until 27 May 2013, |
|||||||||
§ 52 (1) (2) and (§ 53) of the ECG 2011 shall not be applied. |
