317. Presentation of the Federal Chancellor concerning the scope of the European Agreement on the regulation of the movement of persons between the Member States of the Council of Europe

According to the note by the Secretary-General of the Council of Europe, Hungary adopted on 30 August 2013 its instrument of ratification of the European Agreement on the regulation of the movement of persons between the Member States of the Council of Europe (BGBl. No 175/1958, as last amended by BGBl. III No 60/2013, last proclamation of the BGBl scope. III, No 151/2006), on the occasion of which the following statements were made:

Declaration on Art. 7:

In accordance with Article 7 of the Agreement, Hungary, for reasons of public policy (ordre public), is postponing the entry into force of the Agreement with regard to Turkey and Ukraine. Whereas the application of the Agreement with regard to the above States is incompatible with Regulation (EC) No 539/2001 of 15 March 2001, listing the third countries whose nationals are in possession of a crossing of the external borders of the Member State concerned; Visas must be visas and those whose nationals are exempt from that requirement, see Annex 1, which states that Turkey and Ukraine belong to those States whose nationals are in possession of a visa when crossing the The external borders of the Member States of the European Union must be.

Declaration on Art. 11:

In accordance with Article 11 of the Agreement, Hungary declares that the list of documents referred to in Article 1 (1) shall read as follows:

-		valid ordinary passport or expired within one year,
-		valid temporary passport,
-		valid diplomatic passport,
-		valid service passport for foreign service,
-		valid service passport,
-		valid shipman's service passport,
-		valid identity card or expired within one year.

-		passeport diplomatique en cours de validité,
-		passeport de service en cours de validité pour service à l' étranger,
-		passeport de service en cours de validité,

No objections have been made to the list by the contracting parties to the agreement. The list shall therefore be added to the Annex in accordance with Article 11.

The Agreement entered into force on 1 September 2013 in accordance with its Article 9 for Hungary.
