435. Regulation of the Financial Market Supervisory Authority (FMA), which amelaes the operating provisions of the Preliminary Provisions of the Preliminary Assassination Directive

Pursuant to § 39 (3) of the Operating Staff and Self-employment Act-BMSVG, BGBl. No 100/2002, as last amended by the Federal Law of the Federal Republic of Germany (BGBl). I n ° 184/2013, is assigned with the approval of the Federal Minister for Finance:

The Ordinance on Occupational Pension Fund-BVQA-V, BGBl. II No 253/2004, as last amended by the BGBl Regulation. II No 269/2013, shall be amended as follows:

1. In § 1 (1), the reference " § 74 of the Banking Act-BWG in the version of the Federal Law BGBl. I No 72/2010 " by reference " § § 74 and 74a of the Banking Act (BWG), BGBl. No. 532/1993 in the version of the Federal Law BGBl. I No 184/2013, " replaced.

2. In § 2 Z 1, the reference "§ 23 BWG" by reference " Part 2 of Regulation (EU) No 575/2013 on the prudential requirements of credit institutions and investment firms and amending Regulation (EU) No 646/2012, OJ L 378, 27.9.2012, p. No. OJ L 176, 27.06.2013 p. 1, " replaced.

(3) The following paragraph 6 is added to § 5:

" (6) § 1 para. 1 and § 2 Z 1 as well as the Annexes 1 to 7 in the version of the BGBl Regulation. II No 435/2013 shall be applied for the first time on the quarterly pass of 31 March 2014. "
