457. Regulation of the Federal Minister for the Interior, amending the regulation of the Federal Minister for the Interior on the determination of compensation for legal advice

On the basis of § § 49 to 51 of the BFA-procedural law (BFA-VG), BGBl. I n ° 87/2012, as last amended by the Federal Law BGBl. I No 144/2013, shall be arranged:

The regulation of the Federal Minister of the Interior on the setting of compensation for legal advice, BGBl. II No 324/2011, shall be amended as follows:

Article I

1. In the promulgation clause, the turn will be " § § 64 and 65 of the Asylum Act 2005 (Asylum G 2005), BGBl. I No 100/2005 " through the turn " § § 49 to 51 of the BFA-procedural law (BFA-VG), BGBl. I No 87/2012 " and the turn " BGBl. I No 38/2011 " through the turn " BGBl. I No 144/2013 " shall be replaced by the following phrase " as well as § § 84 and 85 of the Foreign Police Act 2005 (FPG), BGBl. I n ° 100/2005, as last amended by the Federal Law BGBl. I No 38/2011, " .

2. In § § 1 Z 1 and 2 Z 1 the citation shall be "§ 64 (5) Asylum Act 2005" by quoting "§ 49 (5) BFA-VG" replaced.

3. In § § 1 Z 2 and 2 Z 2 the citation shall be "§ 65 (4) Asylum Act 2005" by quoting "§ 50 (4) BFA-VG" replaced.

4. In § 2 Z 3, the word order shall be "in the foreign police procedure of first and second instance in accordance with § § 84 (4) and 85 (4) FPG" through the phrase "with other legal advice pursuant to § 51 para. 4 BFA-VG" replaced.

5. In § 3, after the word order "for all in the relevant proceedings" the phrase "or in case of other legal advice" and after the phrase "Foreign in the appropriate procedure" the phrase "or in case of other legal advice" inserted.

6. In § 4 (2), the turn-of-the- " Asylum court (BGBl. II No 320/2011) through the turn " Federal Administrative Court (BGBl. II No 457/2013) " replaced.

7. In § 5 (1) the turn shall be "pursuant to § § 64 and 65 Asylum Act 2005 as well as § § 84 and 85 FPG" through the turn "in accordance with § § 49 or 50 BFA-VG or with other legal advice pursuant to § 51 BFA-VG" replaced.

Article II

This Regulation shall enter into force 1. Jänner 2014 in force.
