470. Regulation of the Federal Minister of Transport, Innovation and Technology, which changes the Civil Aviation Vehicle and Aeronautical Equipment Regulation 2010

On the basis of § § 16, 21 and 24g of the Aviation Act, BGBl. N ° 253/1957, as last amended by the Federal Law BGBl. I n ° 108/2013, shall be arranged:

The Civil Aviation Vehicle and Aeronautical Equipment Ordination 2010, BGBl. II No 143/2010, shall be amended as follows:

(1) The following paragraph 4 is added to § 1:

" (4) The provisions of this Regulation shall apply to unmanned aerial vehicles of Class 2 (§ 24g LFG), including their equipment, subject to the provisions applicable to civil aircraft, provided that no special arrangements for unmanned Aircraft shall be fixed. "

2. § 4 Z 5 reads:

" 5.

unmanned aerial vehicles of class 2 according to § 24g LFG. "

3. In § 5 Z 5 there is no parenthesis after the word "Fesselallone" the dash and the phrase "Flight models, insofar as these do not qualify as UAV according to § 4 Z 5" .

(4) In § 10, the following paragraph 1 is inserted after paragraph 1:

"(1a) If the documents referred to in Articles 44 and 58 are deposited at the authority responsible for the registration for a specified period, the provisions relating to the deletion shall not apply for that period."

5. In Section 11 (2), the word order shall be deleted "and flight models, the empty mass of which exceeds 20 kg without any holding device," .

6. In § 14 para. 5, the citation shall be "§ 6 (4)" through the citation "§ 6 (3)" replaced.

Section 22 (4) reads as follows:

" (4) The other provisions of Regulation (EU) No 748/2012 laying down detailed rules for the granting of airworthiness and environmental events for aircraft and related products, construction and equipment parts and for the approval of the of development and manufacturing operations, OJ C No. 1., requirements for the identification of aircraft and/or aircraft, respectively for the labelling of aeronautical equipment (Part 21, Section Q, Regulation (EU) No 748/2012) shall apply. '

8. In § 30 (5) and (6), § 37 (6), § 53 (2) and (4), § 58 (7) and § 65, the citation shall be "(EC) No 1702/2003" through the citation "(EU) No 748/2012" replaced.

9. In § 44 (1) Z 5, the word "where appropriate" .

10. In § 58 (1) the citation shall be " (EC) No 1702/2003 laying down detailed rules for the granting of airworthiness and environmental events and for the approval of development and manufacturing operations, OJ L 327, 30.4.2003, p. No. OJ L 243, 27.9.2003 p. 6, " through the citation "(EU) No 748/2012" replaced.

11. In § 58 (7) the citation shall be " Regulation (EC) No 2042/2003, 1702/2003 " through the citation " Regulation (EC) No 2042/2003, (EU) No 748/2012 " replaced.

12. In Section 61 (1), the phrase "the conditions laid down in Article 2 of Regulation (EC) No 1702/2003" through the phrase "the conditions in this respect in accordance with Regulation (EU) No 748/2912" replaced.

(13) In § 66, the following paragraph 3 is added:

" (3) A mark assigned to a lift surface shall remain upright even after the exchange of this lift surface, if the serial number of the new lift surface after completion of the required inspection pursuant to Article 69 (1) into the Certificate of verification has been registered. "

14. In § 71 Z 4 the word is deleted "where appropriate" .

15. In § 71 Z 5, the word "from" by the word "from" replaced.

16. In § 81, the following paragraph 4 is added:

" (4) § 1 para. 4, § 4 Z 5, § 5 Z 5, § 10 para. 1a, § 11 para. 2, § 14 para. 5, § 22 para. 4, § 30 para. 5 and 6, § 37 paragraph 6, § 44 para. 1, § 53 para. 2 and 4, § 58 para. 1 and 7, § 61 para. 1, § 65, § 66 para. 3, § 71 Z 4 and 5 as well as article 7 with headline, Pkt. 9 Z 2 and Pkt. 13 of Annex D, as amended by the Regulation BGBl. II No 470/2013 are 15. Jänner 2014 in force. "

17. Annex D, point 7 together with the heading is:

" 7. Hangings and paragliders as well as motorized slopes and paragliders:

7.1 Hangglider:

1.

Basic equipment for use in general aviation:

a)

Flights by day by visual flight rules:

-

a height meter that can be read at any time,

-

a rescue device, suitable for the actual take-off weight, or an emergency parachute for each person,

-

a head protection for each occupant.

Equipment according to Z 1, additional equipment:

none.

3.

Training:

Equipment according to Z 1, additional equipment:

none.

an ignition switch for the engine,

-

a rescue device, suitable for the actual take-off weight, or an emergency parachute for each person,

-

a head protection for each occupant.

2.

Transport of persons and goods:

Equipment according to Z 1, additional equipment:

none.

3.

Training:

Equipment according to Z 1, additional equipment:

-

all the necessary control and operating organs for safe school operation as well as instruments must be in place for the teacher and be operational.

18. Annex D Pkt. 9 Z 2 reads:

" 2.

a head protection for the passenger. "

19. In Annex D, point 13, the following sentence shall be added:

"The competent authority may, on request in justified cases, grant derogations from the provisions of Annex D if it has been shown that there is no risk of disruption to road safety."
