On the basis of articles 16, 21 and 24 g of the Aviation Act, Federal Law Gazette No. 253/1957, as last amended by the Federal Act Federal Law Gazette I no. 108/2013, is prescribed:

The civil aircraft and aviation equipment regulation 2010, Federal Law Gazette II No. 143/2010, is amended as follows:

1 the following paragraph 4 is added to § the 1:

"(4) the provisions of this Regulation apply to unmanned aerial vehicles of class 2 (section 24 g LFG) including their equipment, with the for civil aircraft provisions to apply, if no special rules for unmanned aerial vehicles are set."

2. paragraph 4 No. 5:



"5. unmanned aerial vehicles of class 2 in accordance with § 24 g LFG."

3. in article 5 "Captive balloons" the comma and the word sequence 'Flight models' eliminates Z 5 in the bracket expression after the Word as far as these are not considered Z 5 UAV pursuant to section 4.

4. in article 10, para 1 the following paragraph 1a is inserted:

"(1a) which are deposited referred to documents for the registration authority for a specific time period in section 44 and section 58, shall apply the provisions on not the deletion for this period."

5. in article 11, paragraph 2, the phrase "and flight models, whose unladen mass exceeds, without any locking device 20 kg" is omitted.

6. in article 14, paragraph 5, the citation "§ 6 section 4" by the citation "§ 6 section 3" will be replaced.

7 paragraph 22, section 4:

9. in article 44, paragraph 1, the word "may" eliminates Z 5.

10. in article 58, paragraph 1, the citation is "(EC) No 1702/2003 laying down the implementing rules for the airworthiness and environmental certification, as well as for the approval of development and manufacturing establishments, OJ" "No. L 243 of the 27.9.2003 p. 6," by the citation "(EU) No. 748/2012" replaced.

11. in article 58, paragraph 7, the citation is "Regulation (EC) No. 2042 / 2003 or 1702/2003" by the citation "Regulation (EC) No. 2042/2003 or (EU) No. 748/2012" replaced.

12. in article 61, paragraph 1, the phrase is "the requirements pursuant to article 2 of Regulation (EC) No 1702/2003" by the phrase "the relevant requirements pursuant to the Regulation (EU) No. 748/2912" replaced.

13. in article 66 the following paragraph 3 is added:

"(3) a flag that is allocated for an upwelling area remains still maintained even after sharing this upwelling area when entering the serial number of the new lift area after carrying out the required verification in accordance with section 69, paragraph 1 in the inspection certificate."

14. in paragraph 71, the word 'where necessary' eliminates No. 4.

15. in article 71 Z 5 is the word "of" by the word "by the" replaced.

16. in article 81, the following paragraph 4 is added:

"(4) § 1 para 4, § 4 sub-para. 5, § 5 Z 5, § 10 par. 1a, § 11 para. 2, § 14 para 5, § 22 para 4, § 30 para 5 and 6, § 37 para 6, article 44, paragraph 1, § 53 para 2 and 4, article 58, paragraph 1 and 7, article 61, paragraph 1, section 65, article 66, para. 3, § 71 Z together with 4 and 5, and PT. 7 heading, PT. 9 No. 2 and PT. 13 of Annex D as amended the regulation BGBl. II No. 470/2013" with 15 January 2014 into force."

17 Annex D item 7 together with the heading is as follows:

7.1 hang glider:



1 basic equipment for use in general aviation: a) flights for day visual flight rules: - an any readable altimeter is to carry, - a rescue device, suitable for the actual take-off weight, or a parachute for each person, a head protection for all occupants.

2. transport of persons and things: equipment in accordance with subpara 1, additional equipment: No.

3. Education: Equipment in accordance with subpara 1, additional equipment: No.

4. (reserved) 5 (reserved) 6 (reserved) 7 other additional equipment: - for flights of fancy in accordance with ICAO Annex 6 part II.

7.1.2 motorized hang gliders:



1. basic equipment for use in general aviation for: a) flights during the day according to visual flight rules: - an any readable altimeter is to carry, - a a fuel stock indicator, - an ignition switch for the motor - rescue device, suitable for the actual take-off weight, or a parachute for each person, a head protection for all occupants.

2. transport of persons and things: equipment in accordance with subpara 1, additional equipment: No.

3. Education: Equipment in accordance with subpara 1, additional equipment: - all for the safe operation of school must necessary tax - control devices and instruments for the teachers present and ready for use.

7.2 paragliding:

7.2.2 motorized para-glider:

19. in Annex D PT. 13 the following sentence is added:

"The competent authority may grant derogations from the provisions of the annex D in justified cases upon request, if it has been shown that any adverse effect on road safety is expected to."
