472. by-laws of the Federal Ministry of economy, family and youth about the notice of an application for exemption from the application of Directive 2004/17/EC coordinating the procurement procedures of entities operating in the water, energy, transport and postal services the European Commission
Pursuant to § 179 para 6 of the Federal Procurement Act 2006, Federal Law Gazette I no. 17, as last amended by the Federal Act Federal Law Gazette I no. 128/2013, will be published:
The European Commission has in the OJ No. C 303 of the 19.10.2013 made known p. 28:
"The Commission a request pursuant to article 30 was received on October 1, 2013 (5) of Directive 2004/17/EC of the European Parliament and of the Council of 31 March 2004 coordinating the procurement procedures by entities operating in the water, energy, transport and postal services. The 2 October 2013 was the first working day after receipt of the application.
The application provided by Austrian Post AG concerns postal services and other services than postal services within the meaning of article 6 paragraph 2 b and c of Directive 2004/17/EC in Austria. Pursuant to article 30, the Directive 2004/17/EC does not apply if the activity in markets with free access is directly exposed to competition. These conditions are evaluated solely within the meaning of Directive 2004/17/EC and without prejudice to the application of the competition rules.
The Commission must decide within three months on this request from the above date of work. The deadline expires on January 2, 2014.
The period may be extended, if necessary, for three months. The extension requires the publication.
Within the meaning of article 30 paragraph 6, subparagraph 2 of Directive 2004/17/EC are additional applications, the postal services as well as related services other than postal services in Austria and at a later date, but before expiry of the period opened with the first application, enter, not as new applications considered, but in the context of the first request."
