479. Regulation of the Regulatory Commission of E-Control, which provides for the charging of
for the Gas-System-Use-charges-Regulation 2013 is amended
(Gas-Systems usage charges-Ordination 2013-Novelle 2014, GSNE-VO 2013-Novelle 2014)

On the basis of § 24 and § 70 Gaswirtschaftsgesetz 2011-GWG 2011, BGBl. I n ° 107/2011 in the version of the Federal Law BGBl. I Nr. 174/2013 iVm § 12 sec. 2 Z 1 Energy Control Act-E-ControlG, BGBl. I No 110/2010 in the version of the Federal Law BGBl. I No 174/2013, shall be arranged:

The regulation of the Regulatory Commission of E-Control, which determines the charges for the use of systems in the gas industry (Gas-Systems-Use-charges-Ordination 2013, GSNE-VO 2013), BGBl. II No. 309/2012 in the version GSNE-VO 2013-Novelle 2013, BGBl. II No 478/2012, shall be amended as follows:

1. § 2 para. 1 Z 9 reads as follows:

" 9.

"minimum benefit" means the share of 20% of the contractually agreed maximum performance per counting point in the case of a monthly settlement of the performance-related share in accordance with § 10 (5). If natural gas is obtained exclusively in the months from March to October and a monthly settlement of the performance-related share is effected in accordance with § 10 (5), the minimum performance shall be 10% of the contractually agreed maximum performance per counting point for the entire accounting period; in the case of a daily offset of the service price in accordance with Article 10 (6a) shall apply a minimum performance of 15% of the contractually agreed maximum rate per counting point; "

2. In accordance with § 2 (1) Z 11 the following Z 11a is inserted:

" 11a.

"Standard capacity" means the capacity at the input or exit points in the from the distribution area. It shall be composed of a fixed and a interruptible proportion, the availability of the fixed share being dynamic and dependent on the current paragraph in the distribution area. "

3. § 2 para. 1 Z 13 reads as follows:

" 13.

Offset calorific value " the calorific value in kWh/Nm³ used for the calculation of the energy quantity for the final consumer. This amounts to 11.24 kWh/Nm³ for the market area of East Germany, 11.20 kWh/Nm³ for the Tirol market and 11.20 kWh/Nm³ for the Vorarlberg market. If the average monthly value published by the respective distribution area manager differs by more than 2% from the prescribed offset calorific value, the published average monthly value shall be used for this period; "

4. In § 9 paragraph 1 Z 1 lit. a and Z 3 lit. a dispense with the words "for fixed capacity and/or" .

5. § 10 (6), first sentence reads:

"If the contractually agreed maximum performance is exceeded within one month per counting point, the double performance price referred to in paragraph 5 shall be offset for the exceeding of the performance."

6. According to Article 10 (6), the following paragraphs (6a) and (6b) are inserted:

" (6a) By way of derogation from paragraph 5, at the request of the final consumer for installations with a contractually agreed maximum power per counting point of more than 400,000 kWh/h, which are connected to the network level 2, it may be possible to determine the basis for the settlement. The performance-related share of the network usage fee is used to draw on the daily measured maximum hourly output. For the purpose of determining the basis for daily calculation, the daily measured maximum hourly performance shall be multiplied by the power price prescribed in accordance with this paragraph. A modification of the settlement arrangements is possible once within twelve months. In any case, the minimum performance in accordance with § 2 (1) Z 9 shall be used for the calculation of the basis for the calculation of the performance-related share of the network usage fee, irrespective of the actual measured maximum hourly performance of one day.

(6b) If the contractually agreed maximum performance is exceeded within one day per counting point, the double performance price referred to in paragraph 6a is to be offset for exceeding the excess performance. The offsetting is the highest measured hourly performance of the day to be used. The double service price shall not apply in the event of a short-term overrun, which shall be used by the distribution system operator in accordance with the general distribution network conditions with end consumers with an agreed maximum capacity per unit of time. 14. § 15 (3) reads:

" (3) With the exception of load profile counters, which are to be read on a daily basis, as well as intelligent measuring instruments, which are read out in accordance with § 129 (1) of the GWG 2011, the meter reading has to be performed annually. In addition to the fee referred to in paragraph 1, a charge of no more than 8,-€ per month may be charged for the monthly data read-out of load profile counters. This fee shall be charged on the invoice separately from the fee referred to in paragraph 1. "
