13. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management, which amends the old-vehicle regulation

On the basis of § § 14, 23 and 36 of the Waste Management Act 2002 (AWG 2002), BGBl. I n ° 102/2002, as last amended by Federal Law Gazette (BGBl). I n ° 193/2013, will be arranged in agreement with the Federal Minister for Economic Affairs, Family and Youth:

The End-of-Life Vehicle Ordinance, BGBl. II No 407/2002, as last amended by the BGBl Regulation. II No 53/2012, shall be amended as follows:

1. In § 13, the word "and" at the end of Z 7; the Z 8 becomes the word "and". After Z 8, the following Z 9 is inserted:

(2) The following paragraph 9 is added to § 14:

1) This exception will be reviewed by the European Commission in 2015.

2) Disassembly, if an average threshold of 60 grams per vehicle is exceeded in connection with entry 10a. Electronic equipment which is not installed by the manufacturer during manufacture shall be excluded from the application of this clause.

3) This exception will be reviewed by the European Commission in 2014.

4) Disassembly, if an average threshold of 60 grams per vehicle is exceeded in relation to entries 8a to 8j. Electronic equipment which is not installed by the manufacturer during manufacture shall be excluded from the application of this clause.

Notes:

-

A maximum concentration value of up to 0.1% by weight of lead, hexavalent chromium and mercury per homogeneous material and up to 0.01% by weight of cadmium per homogenous material shall be tolerated.

-

The re-use of vehicle parts which have already been placed on the market before the expiry of the period of validity of an exemption shall be permitted without restriction, as it does not fall within the scope of Article 4 (1).

-

Spare parts placed on the market after 1 July 2003 and used for vehicles placed on the market prior to 1 July 2003 shall be exempted from the provisions of Section 4 (1) (*) .

(*) This clause shall not apply to balancing weights, carbon brushes for electric motors and brake linings. "
