12. Federal Law on authentic Interpretation of Section 13a (2) Tobacco Act 1995, BGBl. No 431/1995, as last amended by BGBl. I No 120/2008
The National Council has decided:
Article I
Section 13a (2) Tobacco G 1995, BGBl. No 431/1995, as last amended by BGBl. I n ° 120/2008, is interpreted in accordance with § 8 of the German Civil Code (ABGB) to the effect that the guests are on their way to the main room, or on other smoke-free areas of the premises, such as sanitary installations or WC facilities can be reasonably expected to pass through the smoking room.
Article II
The Federal Government is responsible for the enforcement of this federal law.
Art. I is to be applied by the authorities and courts in all current and future proceedings within the meaning of Section 8 of the ABGB.
