The Constitutional Court has recognized to rightly G 59/2013-9, the Federal Chancellor with knowledge from 26 February 2014, on 27 March 2014:

"Article 12a para. 1 Federal law concerning the granting of asylum (asylum Act 2005 - AsylG 2005), Federal Law Gazette I no. 100 idF BGBl I no. 122/2009, was unconstitutional."
