75. Regulation of the Federal Minister for labour, Social Affairs and consumer protection fees and attendance fees for the members of the management body and the Advisory Board members of the social insurance institution and the main Association of Austrian social insurance institutions (fees and attendance allowance Regulation)

On the basis of



1 of § 420 5 Nos. 2 and 3 in conjunction with § 440a para 5 of the General Social Insurance Act (ASVG), Federal Law Gazette no 189/1955, as last amended by Federal Law Gazette I no. 187/2013;

2 of § 197 5 Nos. 2 and 3 in conjunction with § 214 section 4 of the industrial property law on social insurance (GSVG), Federal Law Gazette No 560/1978, as last amended by Federal Law Gazette I no. 139/2013;

3 of § 185 5 Nos. 2 and 3 in conjunction with § 202, para 4 of the farmers Social Insurance Act (BSVG), Federal Law Gazette No 559/1978, as last amended by Federal Law Gazette I no. 139/2013;

4 of § 132 5 Nos. 2 and 3 in conjunction with § 149b para 4 of the officials-sick and accident insurance Act (B-KUVG), Federal Law Gazette no 200/1967, as last amended by Federal Law Gazette I no. 139/2013;

5. Article 67 para 5 Nos. 2 and 3 of the law on notary insurance in 1972, Federal Law Gazette No. 66/1972, as last amended by the Federal Act Federal Law Gazette I no. 139/2013, is in agreement with the Federal Minister of health prescribed: subject

§ 1. This regulation lays down



1. the amount and the payment of the fees for members of the administrative bodies of social security institutions and the main Association of Austrian social insurance institutions (hereafter referred to as Federation), as well as the duration of the claim on these fees;

2. the amount of the attendance allowance for the members of the management body and the Advisory Board members of the social insurance institution and the Central Office.

The function fee

Section 2 (1) is the function fee with the annual scale (2) limited and aimed for the membership to the relevant administrative body group pursuant to paragraph 3, as well as for the respective function within the single administrative body pursuant to paragraph 4.

(2) the annual maximum extent of the function fee is the step of 40% of the initial amount pursuant to section 1 of the Federal Constitutional law on the limitation of payments to public officials, Federal Law Gazette I no. 64/1997, rounded on the full amount of the euro.

(3) the following administrative body groups are:



-Group 1: governing body of the Confederation; Management body of the General accident insurance institution, the superannuation fund, the social security institution of the commercial economy, the social insurance institution of the farmers, the insurance institution of public servant and the insurance institution for railroads and mining. Management body of the insurance institution with an annual average total insured level by more than 400 000 people;

-Group 2: governing body of the health insurance carriers with an annual average total insured level by more than 250 000 people;

-Group 3: governing body of the health insurance carriers with an annual average total insured level by more than 100 000 people;

-Group 4: governing body of the health insurance carrier with an annual average total insured level of more than 50 000 people;

-Group 5: governing body of the health insurance carrier with an annual average total insured level of more than 10 000 people;

-Group 6: management body of the insurance institution of the Austrian solicitor; Management body of the insurance institution with an annual average total insured level by not more than 10 000 people.

Second vorangegangene calendar year is to be used for the determination of the annual average total insured level.

(4) the amount of the fee of the function is



1 for the Association Presidents / Chairman of the Association and the stewards/Obfrauen (for the President / President) which in the left column-led administrative body group the percentage stated in the right column of the annual maximum extent of the function fee referred to in paragraph 2, rounded on the full amount of euro: Group 1...              100 %,

              Gruppe 2              ..................                88 %,

              Gruppe 3              ..................                76 %,

              Gruppe 4              ..................                64 %,

              Gruppe 5              ..................                52 %,

              Gruppe 6              ..................                40%;

2. for the persons listed in the left column, the fraction of those function fee, which is due to the persons belonging to the same group to Z 1, stated in the right column rounded off on the full amount of euro:-Chairman of control meetings... each five tenths.

-Heads of country offices committees... each four-tenths;

-Chairman of the regional service committees... each three tenths;

-Members of the Association Board of Directors with the exception of / the Association Chairman - and his or her representatives... each three tenths;

3. for the representatives of the people after the Z 1 and 2 first and second tick each half of the function fee that goes to the person responsible, rounded on the full amount of euro.

The function fee when exercising multiple functions

3. (1) exercising each a function a person with two or more social security institutions according to § 2 para 4, so deserves only the higher or highest function fee in full; the remaining fees are in half-height. At the same high fees, only the has according to the number of insured persons to grant larger or largest social security institutions the function fee in full; the or the other social security institutions have the function fee in half way up to grant.

(2) a person with one and the same institution performs two or more functions according to § 2 para 4, only the higher or highest function fee shall be granted.

Payment of the fee of the function

§ 4. The annual amount of the function fee (section 2) is to distribute the calendar months of evenly (including the divided into aliquots special payments) and afterwards to pay off.

Duration of the claim on function charge

§ 5. The function fee is due for the duration of the Office.

Attendance allowance

Section 6 (1) is due to attendance

1. the members of the management body of the social insurance institution and the main Association for every day, where they take part in meetings of one or more administrative bodies of the same social security institution or the Central Office; the same applies to the members of control meetings, if they are involved in the exercise of their monitoring function with the single audit of the management of the social insurance institution;

2. the members of the Advisory Board of the social insurance institution and the Central Office for each day on which they meetings one or more administrative bodies according to section 440a para 5 Z 2 ASVG (section 214 (4) Z 2 GSVG, section 202, para. 4 Z 2 BSVG, § 149 b para 4 Z 2 B KUVG) or participate in the meetings of the Advisory Board.

(2) in addition to a feature fee pursuant to article 2, no attendance is due to. Session money deserves no more than four times in a calendar year for participating in Advisory Committee meetings.

(3) the daily attendance is 0.085% of the yearly maximum of the function fee pursuant to article 2 paragraph 2, rounded on the full amount of euro.

Final provision

§ 7. This Regulation shall enter into force April 15, 2014. Regulation Federal Law Gazette II No. 96/2005 occurs upon the expiry of the 14 April 2014 override.
