Regulation of the Federal Minister for Labour, Social Affairs and Consumer Protection on functional fees and meeting fees for the members of the administrative bodies and the Advisory Board members of the Social Security Institutions and the Main Association of the Social Security Institutions Austrian social insurance institutions (function fee and meeting regulation)

Because of

1.

§ 420 (5) (2) and (3) in conjunction with Section 440a (5) of the General Social Security Act (ASVG), BGBl. No. 189/1955, as last amended by the Federal Law BGBl. I No 187/2013;

2.

§ 197 (5) (2) and (3) in conjunction with Section 214 (4) of the Industrial Social Security Act (GSVG), BGBl. No 560/1978, as last amended by the Federal Law BGBl. I No 139/2013;

3.

§ 185 (5) (2) and (3) in conjunction with Section 202 (4) of the Farmers ' Social Security Act (BSVG), BGBl. N ° 559/1978, as last amended by the Federal Law BGBl. I No 139/2013;

4.

§ 132 (5) (2) and (3) in conjunction with Section 149b (4) of the Official Health and Accident Insurance Act (B-KUVG), BGBl. No 200/1967, as last amended by the Federal Law BGBl. I No 139/2013;

5.

§ 67 (5) (2) and (3) of the NotarInsurance Act 1972, BGBl. N ° 66/1972, as last amended by the Federal Law BGBl. I No 139/2013,

shall be assigned in agreement with the Federal Minister for Health:

Subject matter

§ 1. This Regulation lays down

1.

the amount and payment of the functional fees for members of the administrative bodies of the social insurance institutions and of the main association of the Austrian social insurance institutions (hereinafter referred to as the main association) and the duration of the the right to these functional charges;

2.

the amount of the meeting for the members of the administrative bodies and the members of the Advisory Board of the Social Security Institutions and the Main Association.

Function fee height

§ 2. (1) The amount of the functional fee is limited to the annual maximum extent according to para. 2 and depends on the membership of the respective administrative body group according to paragraph 3 as well as according to the respective function within the individual Administrative body referred to in paragraph 4.

(2) The annual maximum amount of the functional fee is four-tenfold of 40% of the initial amount according to § 1 of the Federal Constitutional Law on the limitation of the references of public officials, BGBl. I n ° 64/1997, rounded off to the full amount of the euro.

(3) The following administrative body groups shall be distinguished:

Group 1: Administrative body of the Main Association; Administrative bodies of the General Accident Insurance Institution, the Pension Insurance Institution, the Social Insurance Institute of the Industrial Economy, the Social Insurance Institution of the Farmers, the Insurance institution for public servants and the insurance institution for railways and mines; administrative bodies of the health insurance institutions with an average annual total insurance of more than 400 000 persons;

Group 2: Administrative bodies of health insurance institutions with an annual average total insurance of more than 250 000 persons;

-

Group 3: Administrative bodies of health insurance institutions with an annual average total insurance of more than 100 000 persons;

-

Group 4: Administrative bodies of health insurance institutions with an annual average total insurance of more than 50 000 persons;

-

Group 5: Administrative bodies of health insurance institutions with an annual average total insurance of more than 10 000 persons;

-

Group 6: Administrative body of the insurance institution of the Austrian notary; administrative bodies of the health insurance institutions with an average annual total insurance of 10 000 persons per year.

For the calculation of the annual average total insured stock, the second preceding calendar year shall be used in each case.

(4) The amount of the functional fee shall be

for the Chairman of the Board of Directors and for the Obbers/Obwives (for the President/President) of the administrative body group in the left column, the percentage of the annual percentage of the annual The maximum amount of the functional fee referred to in paragraph 2, rounded off to the full amount of the euro:

For the persons listed in the left-hand column, the fraction of the function fee, given in the right-hand column, which is due to the persons belonging to the same group after Z 1, rounded off to the full amount of the euro:

Chairman of the supervisory assemblies .............................................................. five tenths each;

-

Chairmen of the Landesstellencommittees ............................................................. four tenths each;

-

Chairmen of the regional power committees .............................................................. three tenths each;

-

Members of the Board of the Union of the Union with the exception of the Chairman of the Union

-

and his/her deputy (s) .......................................................... in each case three tenths;

3.

for the substitutes of the persons referred to in the first and second divisions, half of the functional fee payable by the person to be represented shall be rounded off to the full amount of the euro.

The amount of the functional fee in the exercise of several functions

§ 3. (1) In the case of two or more social security institutions, if a person performs a function in accordance with Article 2 (4), only the higher or highest functional fee shall be paid in full; the remaining functional fees shall be granted at half of the amount. In the case of equal function fees, only the social security institution, which is larger or largest after the number of insured persons, has to pay the functional fee in full; the other social security institution or institutions shall have the functional fee at half the height of the functional fee. ,

(2) In the case of a person with the same social security institution two or more functions according to § 2 (4), only the higher or highest function fee shall be granted.

Payment of the functional fee

§ 4. The annual amount of the functional fee (§ 2) shall be divided equally between the calendar months of the year (including the aliquots ' special payments) and shall be paid out in retrospect.

Duration of the claim to function fee

§ 5. The functional fee is due for the duration of the official exercise.

Session Money

§ 6. (1) Session money must be paid

1. the members of the administrative bodies of the social insurance institutions and of the main association for each day on which they participate in meetings of one or more administrative bodies of the same social security institution or of the main association; the The same shall apply to the members of the supervisory assemblies when, in the exercise of their control function, they are involved in the individual examination of the security of the social insurance institution;

2. the members of the advisory councils of the social insurance institutions and of the main association for each day on which they attend meetings of one or more administrative bodies according to § 440a (5) Z 2 of the ASVG (§ 214 para. 4 Z 2 GSVG, § 202 paragraph 4 Z 2 BSVG, § 149b para. 4 Z 2 B-KUVG) or in Advisory Board meetings.

(2) In addition to a functional fee according to § 2, no meeting fee is due. In order to participate in meetings of the Advisory Board, the session allowance shall be subject to a maximum of four times in the calendar year.

(3) The daily session allowance shall be 0.085% of the annual maximum amount of the functional fee in accordance with § 2 para. 2, rounded off to the full euro amount.

Final destination

§ 7. This Regulation shall enter into force on 15 April 2014. The BGBl Regulation. II No 96/2005 will expire at the end of 14 April 2014.
