109. Regulation of the Federal Minister for health, modifies the regulation on infant formulae and follow-on formulae

On the basis of § 6 para 1 and 2 of the food safety and Consumer Protection Act - LMSVG, Federal Law Gazette I no. 13/2006, as last amended by Federal Law Gazette I is no. 171/2013, - with respect to the sections 7 and ordered 8 in agreement with the Federal Minister for science, research and economy -:

The regulation on infant formulae and follow-on formulae, Federal Law Gazette II No. 68/2008 is amended as follows:

1. in section 4, paragraph 2, the word "Cow's milk proteins" is replaced by the words "Cow's milk or goat's milk proteins".

2. paragraph 4 section 5:

"(5) if follow-on formulae from the defined in annex 2 Z 2.2. protein hydrolysates with a protein content between the minimum and 0,56 g / 100 kJ (2,25 g/100 kcal) manufactured, the suitability of follow-on formulae for particular nutritional use by infants is through to demonstrate appropriate studies, performed on the basis of recommendations accepted in professional circles in the design and conduct of such studies;" the corresponding specifications of annex 6 must be observed."

3. the previous section 4 paragraph 5 is to § 4 paragraph 6.

4. in article 7, second sentence is replaced by the words "Cow's milk or goat's milk proteins" the word "Cow's milk proteins".

5. in section 8 be the previous Z 3-6 to the Z 2 to 5.

6 paragraph 15:

"§ 15. Following EU directives are implemented by this Regulation:



-Directive 2006/141/EC on infant formulae and follow-on formulae OJ Directive 2013/46/EC amending Directive 2006/141/EC with regard to the protein requirements for infant formulae and follow-on formulae, OJ, no. L 401 of 30.12.2006 No. L 230 of the 29.8.2013."

7. in Appendix 1 Z 2.1., the words "on the basis of cow's milk proteins" be replaced by the words "on the basis of cow's milk or goat's milk proteins" in the heading.

8. in annex 1 Z 2.1. footnote 1 is replaced in the "Cow's milk proteins" "Cow's milk or goat's milk proteins" through the words.

9. the heading in Schedule 1 Z 2.3. is:

"2.3. infant formulae based on soya protein isolates, alone or in a mixture with cow's milk or goat's milk proteins"

10. the heading in Schedule 1 Z 10.1. is:

"10.1. infant formulae based on cow's milk or goat's milk proteins or protein hydrolysates"

11. the heading in Schedule 1 Z 10.2 is as follows:

"10.2 infant formulae based on soya protein isolates, alone or mix it with cow's milk or goat's milk proteins"

12. in annex 2 Z 2.1. heading is replaced in the "Cow's milk proteins" by the words "Cow's milk or goat's milk proteins".

13. the table in annex 2 Z 2.2 is as follows:

14. the heading in Appendix 2 Z 2.3 is as follows:

"2.3. follow-on formulae based on soya protein isolates, alone or in a mixture with cow's milk or goat's milk proteins"

15. the heading in Appendix 2 Z 8.1 is as follows:

"8.1 follow-on formulae based on cow's milk or goat's milk proteins or protein hydrolysates"

16. the heading in Appendix 2 Z 8.2 is as follows:

"8.2 follow-on formulae based on soya protein isolates, alone or in a mixture with cow's milk or goat's milk proteins"

17. the footnote in annex 3 Z 3 is as follows:

"1) L-arginine and its hydrochloride may be used only for the production of infant formula in accordance with § 4 para 3 and follow-on formulae according to § 4 paragraph 5."

18. the heading in annex 6 is as follows:

"Specification for protein content and source and protein processing in the manufacture of infant formulae and follow-on formulae with a protein content less than 0,56 g / 100 kJ (2,25 g/100 kcal) on the basis of hydrolysates from cow's milk protein"
