35. Federal Act amending the Family Law Balancing Act 1967 and the Child Care Money Act

The National Council has decided:

Article 1

Amendment of the Family Law Compensatory Act 1967

The Family Law Balancing Act 1967, BGBl. No. 376, as last amended by the Federal Law BGBl. I No 163/2013, shall be amended as follows:

1. In § 2 para. 1 lit. b shall be replaced by a stroke at the end of the twelfth sentence of the point and the following half-sentence shall be added:

" The same applies if all courses and examinations of the study entry and orientation phase in accordance with § 66 of the University Act 2002, BGBl. I n ° 120/2002, have been successfully completed as long as they are valued at least 14 ECTS credits. "

2. § 2 para. 1 lit. l sublit. dd is:

" dd)

European voluntary service pursuant to Regulation (EU) No 1288/2013 establishing 'Erasmus +', OJ L 327, 28.12.2013, p. No. OJ L 347, 20.12.2013 p. 50.

3. In Section 3 (1), the phrase " according to § § 8 and 9 of the German Law on the Law of the Niederlassungs-und Aufenthaltsgesetz (NAG), BGBl. I No 100/2005 " through the phrase " according to § § 8 and 9 of the German Law on the Law of the Niederlassungs-und Aufenthaltsgesetz (NAG), BGBl. I n ° 100/2005, or in accordance with § 54 of the Asylum Act 2005 (Asylum G 2005), BGBl. I No 100/2005 idF BGBl. I No 87/2012 " replaced.

4. In Section 3 (2), the word order shall be "according to § § 8 and 9 of the German Law on the Law of the Niederlassungs-und Residence" through the phrase "according to § § 8 and 9 NAG or pursuant to § 54 Asylum Act 2005" replaced.

Section 8 (2) reads as follows:

" (2) The family allowance shall be monthly

1.

from 1 July 2014

a)

109,7 € for each child from the beginning of the calendar month of birth,

b)

117.3 € for each child from the beginning of the calendar month, in which it is the 3. Year of age,

c)

136,2 € for each child from the beginning of the calendar month in which it is 10. Year of age,

d)

€ 158.9 for each child from the beginning of the calendar month, in which it is the 19th. Year of age;

2.

from 1. Jänner 2016

a)

111.8 € for each child from the beginning of the calendar month of birth,

b)

119.6 € for each child from the beginning of the calendar month, in which it is the 3. Year of age,

c)

€ 138.8 for each child from the beginning of the calendar month, in which it is the 10th. Year of age,

d)

162 € for each child from the beginning of the calendar month in which it is 19. Year of age;

3.

from 1. Jänner 2018

a)

114 € for each child from the beginning of the calendar month of birth,

b)

€ 121.9 for each child from the beginning of the calendar month, in which it is the 3. Year of age,

c)

€ 141.5 for each child from the beginning of the calendar month, in which it is 10. Year of age,

d)

165,1 € for each child from the beginning of the calendar month, in which it is the 19. "Year of Life."

6. § 8 (3) reads:

" (3) The family allowance shall be increased monthly for each child

1.

from 1 July 2014, when

a)

is granted for two children, by 6.7 €,

b)

is granted for three children, at 16,6 €,

c)

is granted for four children, around 25.5 €,

d)

for five children is granted for € 30.8,

e)

is granted for six children, by 34.3 €,

f)

for seven and more children to be granted by 50 €;

2.

from 1. Jänner 2016, if they

a)

for two children is granted for € 6.9,

b)

is granted for three children, by 17 €,

c)

is granted for four children, by 26 €,

d)

is granted for five children, by 31.4 €,

e)

is granted for six children, by 35 €,

f)

for seven and more children to be granted by € 51;

3.

from 1. Jänner 2018, if it

a)

for two children is granted for 7,1 €,

b)

is granted for three children, by 17,4 €,

c)

is granted for four children, for € 26.5,

d)

is granted for five children, by 32 €,

e)

is granted for six children, at € 35,7,

f)

for seven and more children is granted, € 52. "

7. § 8 (4) reads:

" (4) The family allowance shall be increased monthly for each child who is significantly impeded,

1.

from 1 July 2014 by 150 €;

2.

from 1. January 2016 at 152,9 €;

3.

from 1. Jänner 2018 at € 155.9. "

§ 55, the following paragraph 27 shall be added:

" (27) For the entry into force by the Federal Law BGBl. I No 35/2014 of new and new provisions shall apply to:

a)

§ 2 para. 1 lit. b twelfth sentence shall apply for the first time in relation to the academic year 2013/2014;

b)

§ 2 para. 1 lit. l sublit. dd is 1. Jänner 2014 in Kraft,

c)

§ 3 (1) and (2) shall enter into force 1. Jänner 2014 in Kraft,

d)

§ 8 para. 2 Z 1, 3 Z 1 and 4 Z 1 shall enter into force on 1 July 2014 and with effect from 31 December 2015,

e)

§ 8 para. 2 Z 2, 3 Z 2 and 4 Z 2 shall enter into force 1. Jänner 2016 in force and with 31 December 2017 repeal,

f)

§ 8 para. 2 Z 3, 3 Z 3 and 4 Z 3 occurs with 1. Jänner 2018 in force. "

Article 2

Amendment of the Child Care Money Act

The Child Care Money Act (KBGG), BGBl. I n ° 103/2001, as last amended by the Federal Law BGBl. I No 197/2013, shall be amended as follows:

1. In § 2 para. 1 Z 5 the word order shall be " according to § § 8 and 9 of the German Law on the Law of the Niederlassungs-und Aufenthaltsgesetz (NAG), BGBl. I No 100/2005, legally residing in Austria, " through the phrase " according to § § 8 and 9 of the German Law on the Law of the Niederlassungs-und Aufenthaltsgesetz (NAG), BGBl. I n ° 100/2005, or in accordance with § 54 of the Asylum Act 2005 (Asylum G 2005), BGBl. I No 100/2005 idF BGBl. I n ° 87/2012, legally residing in Austria, " replaced.

2. In Section 33 (1), the phrase "to an account at a domestic financial institution" through the phrase " to an account with a payment service provider, for the purpose of Article 9 of Regulation (EU) No 260/2012 laying down the technical requirements and the business requirements for credit transfers and direct debits in euros, OJ L 327, 22.3.2012, p. No. OJ L 94 of 30.03.2012 p. 22, replaced.

3. § 50 shall be added to the following para. 11 and 12:

" (11) § 2 para. 1 Z 5 in the version of the Federal Law BGBl. I n ° 35/2014 is 1. Jänner 2014 in force.

(12) § 33 (1) in the version of the Federal Law BGBl. I n ° 35/2014 will enter into force on 31 March 2012. "
