102. Presentation of the Federal Minister of Arts and Culture, the Constitution and the Civil Service to the amendment of Article IV and V of Annex V to the Convention establishing a European Space Agency
On the basis of § 5 paragraph 1 Z 6 of the Federal Law on the Federal Law Gazette 2004 (BGBlG), BGBl. I n ° 100/2003 idgF, shall be made known:
According to Art. XVI (3) of the Convention establishing a European Space Agency (BGBl). No. 95/1987, idF BGBl. III n ° 90/2014), the ESA Council, acting unanimously on 15 November 2001, adopted the following amendment to the provisions of Article IV and V of Annex V to the Convention:
Amendment of Article IV of Annex V
| " (5) Every five years, formal verifications of the geographical distribution of contracts shall be carried out, with a preliminary examination before the end of the third year.

" 5. Formally reviews of the geographical distribution of contracts shall take place every five years, with an interim review before the end of the third year. |

| (6) Between formal reviews, contracts should be distributed in such a way as to ensure that each formal review does not substantially deviate from the ideal value of each Member State's cumulative overall coefficient of return. For each formal review, the Council may redefine the lower limit of the cumulative reflux coefficient for the subsequent section, but it shall never be less than 0.8.

6. The distribution of contracts between formal reviews of the situation should be such that, at the time of each formal review, the cumulative overall return coefficient of each Member State does not substantially deviate from the ideal value. At the time of each formal review, the Council may revise the lower limit for the cumulative return coefficient for the subsequent period, provided that it shall never be lower than 0.8. |
6. | (7) Separate assessments of the reflux coefficient shall be carried out for various categories of contracts to be fixed by the Council, in particular contracts for advanced research and development and contracts for project-related technology; and notified to the Council. 7. Amendment of Article V of Annex V
| " (1) A preliminary review shall draw up a development which indicates that the overall coefficient of return of a Member State is likely to be lower than the lower limit laid down in Article IV (6); the Director-General shall make proposals to the Council for compensation within one year. These proposals have to be kept within the framework of the rules of the organisation for the award of contracts. If the development continues after the end of this year, the Director-General shall submit proposals to the Council which shall give priority to the need for compensation in the light of the rules of the organisation for the award of contracts.

" 1. If, at one of the interim reviews a trend is identified, that the overall return coefficient of any Member State is likely to be below the lower limit defined according to Article IV.6, the Director General shall submit to the Council proposals designed to redress the situation within one year. These proposals shall keep within the Agency's rules governing the placing of contracts. If, after this period of one year, the trend still persists persists, the Director General shall submit to the Council proposals in which the need to remedy the situation takes precedence over the Agency's rules governing the placing of contracts. |
