175. Regulation of the Federal Minister of Health on the transfer of information on unpacked foods containing substances or products that can cause allergies or intolerances and other general information Labelling requirements for food products (Allergen Information Regulation)

Due to § § 4 (3) and 6 (1) and (2) of the Food Safety and Consumer Protection Act-LMSVG, BGBl. I n ° 13/2006, as last amended by the Federal Law BGBl. I n ° 171/2013-with regard to § § 5, 6 and 7-is in agreement with the Federal Minister for Science, Research and Economy:

Scope

§ 1. The purpose of this Regulation is to pass on certain information on foods.

Information on allergenic substances

§ 2. (1) Food business operators shall be obliged to provide information on unpacked food containing substances or products which may cause allergies or intolerances to be obtained in the manufacture or preparation of a food shall be passed on to final consumers.

(2) Substances or products which may cause allergies or intolerances are those set out in Annex II to Regulation (EU) No 1169/2011 on the provision of food information to consumers, OJ L 327, 30.11.2011, p. No. OJ L 304 of 22 November 2011, as amended by the delegated regulation (EU) No 78/2014, OJ L 378, 27.12.2011, p. No. OJ No L 27, 30. Jänner 2014, substances and products.

Disclosure of information

§ 3. Food business operators who make unpacked food to end users shall ensure that the information referred to in § 2 is available and easily accessible. They are to be made available to the end users unsolicitated.

(2) The obligation laid down in paragraph 1 shall also be deemed to be fulfilled if, in a clearly visible place, it is clearly and clearly legible that the information referred to in § 2 is available orally on demand.

(3) The oral disclosure of the information pursuant to § 2 shall be carried out by persons trained for this purpose. The training is to be repeated at least every 3 years and proof of the training has to be documented. Proof of initial training shall be carried out one year after the entry into force of this Regulation.

Documentation

§ 4. Food business operators shall ensure that the information referred to in § 2 is based on a written documentation.

Information on sweeteners

§ 5. (1) In the case of unpacked food, aspartame/aspartame-acesulfame salt, in accordance with Regulation (EC) No 1333/2008 on food additives, OJ L 327, 30.4.2008, p. No. OJ L 354 of 31 December 2008, as last amended by Regulation (EU) No 519/2014, OJ L 136, 31.5.2014, p. No. OJ L 147 of 17 May 2014, the notice 'Contains a source of phenylalanine' shall be affixed.

(2) In the case of unpacked foods containing more than 10% of polyhydric alcohols added in accordance with Regulation (EC) No 1333/2008, the reference "may have a leading effect on excessive consumption" shall be affixed.

(3) The information referred to in paragraphs 1 and 2 shall be clearly legible, permanent and in good-visible place on a sign, including a list of prices, on or near the food or, in establishments of Community supply, on food, or beverage cards, in other cases, on a slope which the final consumer can inspect.

Self-service delivery

§ 6. In the case of foodstuffs packaged in self-service for their immediate sale, the information referred to in Article 9 (1) (1) (1) shall be the same. a to h and Art. 10 (1) of Regulation (EU) No 1169/2011.

Minimum durability date

§ 7. An extension of the minimum durability period is not permitted in the case of packaged foods. If the minimum durability period has already expired, the placing on the market must be made clear and intelligible to this circumstance.

Personal names

§ 8. In the case of the personal names used in this Regulation, the chosen form shall apply to both sexes.

Final provisions

§ 9. This Regulation lays down detailed rules for the application of Article 44 (1) (lit). (a) and (b) and (2) of Regulation (EU) No 1169/2011 on the provision of food information to consumers, OJ L 327, 28.11. No. OJ L 304 of 22 November 2011, as amended by the delegated regulation (EU) No 78/2014, OJ L 378, 27.12.2011, p. No. OJ No L 27, 30. Jänner 2014, issued.

§ 10. This Regulation shall enter into force on 13 December 2014.
